Bidders must provide their SARS Tax Compliance Status (TCS) PIN or registration number as part of the returnable documents.

• Scope – lease of 2 499,9 m² of land at Marine Drive, Port of Cape Town, for up to 10 years (voetstoots, i.e., as‑is).
• Intended use – workshop/engineering activities (see Annexure 1).
• Exclusions – handling/storage of hazardous chemicals, truck refuelling stations, fertilizer storage, staging of trucks, dust‑mineral storage, and any activity that contravenes applicable laws.
• Obligations of the successful bidder – undertake all necessary refurbishment, repairs, upgrades and capital improvements at own cost; ensure the premises are fit for purpose and compliant with all relevant legislation; obtain any required licences.
• Beneficial occupation – may be negotiated; must be justified in the Business Plan and the bidder will bear all holding costs during that period.
• Inspections – bidders must inspect the site before submitting a proposal; Transnet accepts no liability for any defects discovered later.
• Green economy – bidders are required to provide a statement on waste disposal, recycling and energy‑conservation practices (Annexure 2).

Transnet’s evaluation methodology is illustrated in Diagram 1 and consists of sequential (or parallel) stages: Test for Administrative Responsiveness, Test for Substantive Responsiveness, Technical/Functional Scoring, Rental Offer Pricing, Specific Goals scoring, Objective Criteria assessment and Post‑Tender Negotiations. The schedule for each activity should be linked to the methodology (concise, good or average level as defined).

Bidders must demonstrate at least two (2) years of relevant experience, provide a company profile, at least two reference letters (not older than five years), and a current bank rating (not older than three months). The evaluation also considers track record, financial stability and the ability to meet the technical requirements.

Submit the Rental Offer Summary table with monthly rates, VAT, escalation rate and total annual rent for each of the five years. Include a clear escalation mechanism and ensure all calculations are correct. Rental offers must be quoted in ZAR inclusive of VAT.

• Rental Offer Schedule – submit monthly rental rates (incl. 15 % VAT), escalation rate and total annual rental for each of the five years as per the Rental Offer Summary (Section 4).
• Escalation – annual escalation must be included in the offer; Transnet will verify calculations.
• Currency – all amounts must be quoted in South African Rand, inclusive of VAT.
• Market‑related pricing – if the highest‑scoring rental offer is not market‑related, Transnet may negotiate with the top‑ranked bidders or cancel the RFP.
• Tax compliance – bidders must be tax compliant for the whole contract term and submit a SARS Tax Compliance Status (TCS) PIN or certificate (Section 1 – Tax Compliance).
• CSD registration – all bidders (except foreign entities without a local entity) must be registered on the National Treasury Central Supplier Database before submission.
• B‑BBEE – submit a verified B‑BBEE certificate or sworn affidavit as required (Section 9).
• Validity – bid must remain valid for 120 business days; bidders must respond to any request for an extension.

• Tax compliance – submit SARS TCS PIN or printed certificate; each consortium/sub‑contractor must provide its own TCS/CSD number.
• Central Supplier Database (CSD) – registration is mandatory for South African bidders; foreign bidders must eventually incorporate a South African company.
• B‑BBEE – provide a verified B‑BBEE status level certificate or sworn affidavit (EMES/QSE).
• Employment Equity Act – comply with Section 53 and related provisions.
• Security clearance – successful bidder and key personnel must obtain the required security clearance (Confidential/Secret/Top Secret).
• DPIP/FPPO disclosure – disclose any relationship with Domestic Prominent Influential Persons or Foreign Prominent Public Officials (Annexure 6).
• Integrity Pact – no breach of the Supplier Integrity Pact; any breach leads to automatic disqualification.
• Legal review – lease agreement is subject to Transnet legal counsel approval.
• General compliance – full compliance with all applicable laws, regulations and the National Ports Act.

Provide a verified B‑BBEE status level certificate or a sworn affidavit (for EMES/QSE) as required by the B‑BBEE Act. The certificate must be attached to the bid and will be scored under the Specific Goals criteria.

All bid documents must be signed and dated by an authorised representative. Bidders must comply with occupational health and safety legislation and provide a safety plan if required. Post‑submission changes are not permitted, and any attempt to canvass Transnet staff between the closing date and award will result in disqualification.

Annexure 2 contains a Draft Environmental Management Plan. Bidders must outline waste‑disposal, recycling and energy‑conservation measures and demonstrate how their operations will minimise environmental impact.

Signature of bidder and capacity must be provided (e.g., company resolution). The bid is binding once accepted by Transnet, and failure to sign the lease within five (5) business days after award may result in penalties and recovery of Transnet’s costs.

Foreign bidders must answer the questionnaire confirming RSA residency, branch, permanent establishment, source of income and tax liability. If all answers are “No”, registration for a SARS Tax Compliance Status PIN is not required.
