The Public Procurement Act (Act 28 of 2024) represents the most significant reform of South African procurement law in decades. It consolidates and replaces the fragmented framework currently governed by the PFMA, MFMA, and PPPFA into a single unified procurement statute. The Act introduces a Public Procurement Tribunal for dispute resolution, establishes a central procurement authority, and modernizes preference systems. As of early 2025, the Act has been signed but is not yet in effect pending the proclamation date.
Unified Procurement Framework
Replaces the fragmented PFMA/MFMA/PPPFA procurement provisions with a single, comprehensive framework (Section 3).
Public Procurement Tribunal
Establishes a tribunal to hear appeals and resolve procurement disputes (Chapter 6).
Central Procurement Authority
Creates a central authority to coordinate and oversee government procurement (Chapter 4).
Modernized Preference System
Reforms the current 80/20 and 90/10 preference points system with updated transformation criteria.
