All preliminaries must be priced and explicitly allocated to one of three categories: Fixed, Value Related, or Time Related. Any item not priced will be deemed included elsewhere in the BoQ, which may disadvantage your bid.

Contract framework: JBCC Principal Building Agreement (Edition 4.1, March 2005) and JBCC Preliminaries Code 2103 (May 2005) apply. Contractors must keep a copy of these documents on-site for access by the employer, principal agent, and agents. Compliance: Strict adherence to the Occupational Health and Safety Act and Construction Regulations is mandatory. A health and safety plan must be submitted within 21 calendar days of the commencement date. Risk: Contractor bears full risk for damage to works during construction and must indemnify the employer. Insurance for works, liability, and high-risk areas (if applicable) is required.
Financial Requirements
Source: CLUSTER-66-III_BoQ Print.pdfSecurity for contracts above R1 million: Contractor selects one of the following within 21 calendar days of commencement: 1) 10% cash deposit of contract sum (excluding VAT); 2) 10% variable construction guarantee; 3) 5% fixed construction guarantee + 5% payment reduction on certified values; 4) 5% cash deposit + 5% payment reduction; or 5) 10% payment reduction on certified values. For contracts up to R1 million: 5% payment reduction applies. Payment terms: Interim payments are subject to percentage adjustments (90-100%) based on completion stage and selected security option. Interest on late payments is set by the Minister of Finance under the PFMA. Employer may recover expenses/losses from security if contractor defaults.

Proof of adequate insurance (works, liability, and high-risk if applicable) must be submitted within 21 calendar days of commencement if requested. Anti-corruption: Contract includes explicit definitions and prohibitions against corrupt and fraudulent practices, including collusion. Contractors must avoid any such practices in procurement or execution. Contract may be cancelled for non-compliance, insolvency, or default.
