• Labour Broker without valid IRP30 certificate: Employees' Tax withheld at individual tax rates until certificate is provided; IRP5 certificate issued with code 3617.
• Dependent Contractor or Personal Service Provider: Employees' Tax withheld at prevailing rates; payments coded as 3601 or 3616 on IRP5/IT3(a) certificates.
• Independent Contractor: No PAYE withheld if all required affidavits/declarations (e.g., Appendix 8) are signed.

Tax implications based on contractor classification:

• If classified as a Labour Broker with a valid IRP30 certificate: No Employees' Tax withheld; IT3(a) certificate issued with code 3617 (reason code 07).
• If classified as a Labour Broker without a valid IRP30 certificate: Employees' Tax withheld at individual tax rates until certificate is provided; IRP5 certificate issued with code 3617.
• If classified as a Dependent Contractor or Personal Service Provider: Employees' Tax withheld at prevailing rates; payments coded as 3601 or 3616 on IRP5/IT3(a) certificates.
• If classified as an Independent Contractor: No PAYE withheld, provided all required affidavits/declarations (e.g., Appendix 8) are signed.

Compliance requirements for contractors:

• Must complete the PAYE Questionnaire truthfully and sign all applicable affidavits/declarations (Appendices 1-9).
• Must provide accurate information; Eskom may withhold taxes, interest, and penalties if information is inaccurate.
• Must notify Eskom of any changes to information provided during the contract period.
• For Companies/CC/Trusts: Must confirm residency, employee count (3+ full-time, non-connected), income sources (<80% from one client), and control/supervision conditions.
• For Individuals: Must confirm residency, service vs. people provision, employee count, and control/supervision conditions.

Evaluation is conducted via a structured questionnaire to classify contractors. Key criteria:

• For Companies/CC/Trusts (Evaluation Pack A): Residency, employee count (3+ full-time, non-connected), services by connected persons, income sources (<80% from one client), place/control/supervision, and dominant impression test (11 questions).
• For Individuals (Evaluation Pack B): Service vs. people, residency, employee count, place/control, and dominant impression test (11 questions).
• Appendices 1-9 must be signed based on answers to confirm status. Failure to sign required documents results in PAYE withholding.
