Liability and penalties:

• Contractor is liable for damages, theft, or losses due to negligence or non-performance.
• Penalties for non-conformance will be imposed as per the Eskom deficiency schedule.
• Contractor is encouraged to maintain insurance covering contract terms and conditions.

Ethics and confidentiality:

• Zero tolerance for bribery, inducements, or corrupt practices.
• Contractor must maintain confidentiality of all NTCSA information and images unless authorized.
• Prior written consent is required for taking photos or recording on-site.

Firearms management:

• Only NTCSA-approved firearms (9mm pistols, shotguns with rubber bullets) are permitted.
• Training for business purposes is mandatory for all armed personnel.
• Contractor is responsible for firearms, ammunition, safes, registers, and crowd control equipment.
• Strict adherence to firearm handling procedures during shift changes.
• No private firearms are permitted for business use.

Contingency planning:

• Contractor must disclose and maintain contingency plans for:
• Labour unrest or strikes.
• Manpower shortages.
• Equipment failures (vehicles, communication systems).
• Internal grievances.

SHEQ (Safety, Health, Environmental, and Quality) compliance is a key evaluation criterion. Contractors must demonstrate adherence to:

• NTCSA SHEQ standards.
• South African legislative requirements (e.g., OHSA, Firearms Control Act).
• Contractor’s ability to provide a SHEQ Officer with SAMTRAC certification and 3 years’ experience.
• Submission of a safety file including OHS policy, risk assessments, incident investigation procedures, and monthly safety agendas.

Applicable to the 2026/2027 tax year. Pack is valid from 1 March 2026 to 28 February 2027.

Submit the completed PAYE Questionnaire (signed summary sheet and signed affidavits) to your Eskom contractor representative. Copy Group Tax at [email protected]. Failure to sign required affidavits (e.g., Appendices 1-9) will result in PAYE withholding from payments.

PAYE withholding depends on contractor classification: Labour Brokers with valid IRP30 certificates avoid withholding (IT3(a) code 3617, reason code 07). Without IRP30, PAYE is withheld at individual rates (IRP5 code 3617). PSPs/Dependent Contractors have PAYE withheld (coded 3601 or 3616 on IRP5).

If classified as a Labour Broker: provide a valid IRP30 exemption certificate to avoid PAYE withholding. Without it, PAYE will be deducted at individual tax rates until the certificate is submitted. IT3(a) (code 3617, reason code 07) or IRP5 (code 3617) certificates will be issued. For PSP/Dependent Contractors, PAYE is withheld at prevailing rates (coded 3601 or 3616).

Compliance with the Income Tax Act is mandatory. Contractors must: declare tax status truthfully, sign applicable affidavits (Appendices 1-9), and notify Eskom of any changes in status. Definitions (e.g., Connected Person, Resident, Labour Broker) are per Appendix 10. Non-compliance risks PAYE withholding and liability for taxes, penalties, and interest.

Evaluation is based on a structured questionnaire (Evaluation Pack A for Companies/CCs/Trusts, Pack B for Individuals). Key tests include: Residence, Number of Employees Exclusion, Services Rendered by Connected Persons, 80% Income Test, Place/Control/Supervision Test, and Dominant Impression Test. Responses determine tax classification and PAYE withholding requirements.

Scope: Provide 24/7 armed response and ad-hoc guarding services at Cradock Depot for 60 months. Key requirements: PSIRA-accredited officers, alarm system integration with SP6000 Paradox system, approved transmitters, and electric fence monitoring via Zone 6 outputs. Contractor must retain a copy of the scope of work. The awarded contractor will be the principal contractor; any subcontractors will be appointed contractors.

Contractors must appoint competent personnel with the knowledge, training, experience, and qualifications specific to the work. Qualifications must be registered with the South African Qualifications Authority (SAQA) where applicable. Principal contractors and appointed contractors must carry out duties as listed in Sections 8, 9, and 10 of the OHS Act and Regulation 7 of the Construction Regulations. SACPCMP registration is mandatory for SHE professionals, Construction Managers, and Construction Agents.

Contractors must ensure compliance with Eskom’s substance abuse procedure (32-37), which enforces a zero-tolerance policy for alcohol and drugs (0% permissible level). Ad-hoc alcohol testing will be conducted. Contractors are encouraged to implement their own testing programs. Test records must be treated as confidential and filed in employees’ personal files. Contractors must provide an organizational organogram depicting all levels of responsibility, including names, positions, and legal appointments, and keep it updated.

Mandatory compliance: B-BBEE Minimum Level 2. Legal: Section 37(2) agreement must be signed between Eskom and the principal contractor, and between the principal contractor and all appointed contractors. Child labour is prohibited per the Constitution and Basic Conditions of Employment Act. Contractors must comply with: Constitution of South Africa (Section 24), Occupational Health and Safety Act 1993 and Regulations, National Environmental Management Act 1998, Environment Conservation Act 1989, National Water Act 1998, Civil and Building Work Act, National Road Traffic Act, Compensation for Occupational Injuries and Diseases Act, and applicable SANS Standards. SACPCMP registration required for SHE professionals, Construction Managers, and Construction Agents. Valid Letter of Good Standing (COID) required for all contractors. Contractors must have a substance abuse program aligned with Eskom’s procedure 32-37 (zero tolerance for alcohol/drugs).

Contractors must comply with the OHS Act and Eskom’s Life-Saving Rules, which include: Open/Isolate/Test/Earth and create an equipotential zone before touch, hook up at heights, buckle up (seat belts mandatory), be sober (zero tolerance for intoxication), permit to work, and ensure safe live working. Non-compliance is considered serious misconduct. Contractors must appoint a full-time SHEQ Officer with SAMTRAC certification and 3+ years’ experience. Safety files must include OHS policy, risk assessments, incident investigation procedures, and monthly safety agendas. All officers must undergo safety induction prior to deployment. Vehicles must be equipped with GPS tracking. Strict compliance with the Criminal Procedure Act regarding minimum force is required.

Contractors must comply with environmental legislation, including the National Environmental Management Act 1998, Environment Conservation Act 1989, and National Water Act 1998. An Environmental Management Plan (EMP) must be implemented to enhance positive impacts and limit negative ones, preferably as part of Eskom’s Environmental Management System. Contractors are responsible for environmental management associated with their project activities and must ensure minimal damage to the environment.

Risk assessments are a legal requirement under Section 8(2)(d) of the OHS Act. The process involves: identifying all hazards, evaluating the risks, and implementing measures to control the risks. Assessments must be reviewed periodically and updated for new or changed processes. Daily or task-specific risk assessments must be conducted on-site. Completed assessments require approval from the Eskom project manager and must be documented with responsible persons and employee competence records.
