Maintenance contractor for fuel hydrant system at o. R. Tambo international airport (6-Month term)

Scope: Appointment of a contractor for the maintenance of the Fuel Hydrant Reticulation, Monitoring, and Control System at O. R. Tambo International Airport for a period of 6 months. The contract is governed by the NEC3 Term Service Contract (April 2013) with additional conditions as outlined in the tender document.

Contract start date: Upon signing of the Form of Acceptance by the Employer. Service period: 6 months from the start date. Assessment interval for payments: Monthly, between the 1st and 15th day of each month. Payment due within 60 days of receipt of a valid tax invoice. Contractor must submit a first plan for acceptance within 4 weeks of the starting date. Task Order programme must be submitted to the Service Manager within 5 days of receiving the Task Order.

Submit the following returnable documents as part of your quotation: signed Form of Offer and Acceptance, completed Contractor details (C1.2b), CVs of key personnel (Site Manager/Supervisor, Electrician, Electrical/Electronic Technician, Mechanical Technician, and Technical Assistants), baseline risk assessment, proof of COID Act compliance, and insurance certificates. Ensure all documents are signed by a duly authorised representative. Non-compliance with submission requirements may lead to disqualification.

Contractor responsibilities: Provide maintenance services in accordance with Service Information (Part C3). Submit a first plan for acceptance within 4 weeks of the starting date. Ensure all work complies with the Occupational Health and Safety Act and relevant regulations. Key personnel required: Site Manager/Supervisor, Electrician, Electrical/Electronic Technician, Mechanical Technician, and up to 8 Technical Assistants. CVs for all key personnel must be appended to the resource proposal. Risks to be managed: Financial loss/injury to third parties, injury to personnel, work in confined spaces, handling flammable/toxic gases, and other risks detailed in Annexure E.

Contractor must provide CVs for all key personnel, including: Site Manager/Supervisor, Electrician, Electrical/Electronic Technician, Mechanical Technician, and up to 8 Technical Assistants. Each CV must detail: Name, qualifications relevant to the contract, and experience. Key personnel must be competent and trained for their roles, particularly in OHS compliance and technical aspects of fuel hydrant system maintenance. Contractor must ensure all personnel are familiar with the OHS Act and applicable regulations.

Pricing must adhere to the NEC3 Term Service Contract (Option A: Priced contract with price list). Contractor must: Submit a detailed Price List (Section C2.2). Calculate the total offered amount as per the guide in Pricing Data [Total F]. In case of conflict between the stated amount and Pricing Data [Total F], the stated amount prevails. Include VAT at 15%. Provide the total amount in words and figures. Payment is monthly, with assessments between the 1st and 15th of each month. Payments are due within 60 days of receipt of a valid tax invoice. Interest on late payments is not applicable if the delay is due to the Contractor’s failure to provide a correctly rendered VAT invoice.

Pricing format: Priced contract with price list (Option A of NEC3 Term Service Contract). Total offered amount must be calculated as per the guide in Pricing Data [Total F]. In case of conflict between the stated amount and Pricing Data [Total F], the stated amount prevails. Currency: South African Rand (ZAR). Payment terms: Monthly assessments between the 1st and 15th of each month. Payment due within 60 days of receipt of a valid tax invoice. Interest rate: 0.00% above Nedbank’s prime rate for ZAR amounts; LIBOR for other currencies. No performance bond or parent company guarantee is required. Contractor must provide proof of insurance as per Section C1.5 (Insurance Schedule).

CSD Registration: Mandatory. Contractor must confirm good standing with the Compensation Fund or Licensed Insurer under the COID Act before commencing work. Insurance: Contractor must provide Public Liability Insurance and any other cover for losses/claims arising from acts/omissions on the Employer’s premises. Professional Indemnity Insurance is required. Compliance with Occupational Health and Safety Act: Mandatory. Contractor must sign a Section 37(2) OHS Agreement and comply with Construction Regulation 5.1(k). Baseline risk assessment and safe work procedures are required. Ethics: Contractor must comply with the Prevention and Combating of Corrupt Activities Act. Breach of ethics clauses may result in contract termination. Confidentiality: All contract-related information must be treated as confidential unless prior written consent is obtained from the Service Manager. Intellectual Property: Contractor grants the Employer an irrevocable, non-exclusive, royalty-free licence to use IP related to the service.

Occupational Health and Safety (OHS) compliance is mandatory under Section 37(2) of the OHS Act and Construction Regulation 5.1(k). Contractor must: Sign a written OHS Agreement with the Employer before work commences. Ensure all employees and subcontractors are covered under the COID Act. Provide proof of good standing with the Compensation Fund or Licensed Insurer. Maintain Public Liability Insurance and other adequate cover for losses/claims. Perform a baseline risk assessment before starting work, including hazard identification, risk analysis, mitigation plans, and monitoring. Appoint competent, trained personnel for OHS roles. Enforce strict OHS discipline, including PPE use and safe work procedures. Report all incidents/accidents to the Provincial Director (Department of Labour) and the Employer. Obtain permits for work requiring them. Prohibit alcohol/intoxicating substances on-site. Allow Employer inspections and inquiries. Contractor acknowledges its status as an Employer under the OHS Act and must comply with all its provisions. Non-compliance may result in immediate contract cancellation.

Contract type: NEC3 Term Service Contract (April 2013) with main Option A (Priced contract with price list) and secondary Options X2 (Changes in the Law), X17 (Low Service Damages), X18 (Limitation of Liability), and X19 (Task Order). Additional conditions (Z clauses) apply, including: Contractor must provide a performance bond if required (Section C1.4). Contractor’s liability for indirect/consequential loss is limited to R0.00. Total liability is capped at the total of the Prices. End of liability date: 52 weeks after the service period. Dispute resolution: Adjudication (Option W1) with arbitration as the tribunal. Disputes related to termination are excluded from adjudication. Contractor must submit a Task Order programme within 5 days of receipt. Contractor must notify the Service Manager of any joint venture composition changes. Ethics, confidentiality, and intellectual property clauses are strictly enforced. Employer retains step-in rights in case of Contractor default. Contractor must keep equipment free of liens and encumbrances.
