ATNS Business Environment
ATNS is a State-Owned Company (SOC), established in 1993 under the ATNS Company
Act (Act ) to provide air traffic services aligned with ICAO standards and South
African Civil Aviation Regulations. As a commercialised air navigation service provider
(ANSP), ATNS operates on a “user-pays” principle, relying on revenues and debt funding

Regulated Business Activities
ATNS regulated activities contribute 90% of its revenue. Key offerings include:
Air navigation services: Planning, operating, and maintaining airspace infrastructure

2.1. ATNS seeks to appoint a service provider to provide rigging services as well as VHF
antenna mast maintenance, repairs, replacement, and support services on an ad
hoc basis for a period of (5) five years at the King Phalo Airport, Mthatha Airport,
Mount Madeira and King Phalo remote sites.
3.1. ATNS seeks to appoint a service provider to provide rigging services as well as VHF
antenna mast maintenance, repairs, replacement, and also support services on an
ad hoc basis for a period of (5) five years at the ATNS King Phalo Airport, Mthatha
Airport, Mount Madeira and King Phalo remote sites
3.2. Antenna mast Maintenance activities may include, but not limited to the following
activities:
3.2.1. Annual routine inspection and certification of the mechanical structures (antenna
masts) including site grounding and anchor maintenance.
3.2.2. Conduct visual inspections annually, and do necessary repairs as follows: -
3.2.2.1. Obstruction Lighting systems (Compliant with Aviation standards)
3.2.2.2. Climbing devices
3.2.2.3. Anchor points
3.2.2.4. Painting and anticorrosion treatment of the masts
3.2.2.5. Mast finish
3.2.2.6. Antenna systems inspection, repairs and erection of new antennas
3.2.2.7. Replacement and installation of panel antennas, omnidirectional antennas and
folded dipoles used at ATNS sites.
3.2.2.8. Inspect the earthing of the mast and do necessary repairs.
3.2.2.9. Antenna repairs and replacement of the mast
3.2.2.10. Antenna cable replacement and maintenance
3.3. It is recommended that the service provider must adhere to the following
requirements: -
3.3.1. In case of a unit failure that is beyond repairs or uneconomical to repair; the service
provider must supply and replace the faulty unit.
3.3.2. Should new requirements for installation of new mast related items arise, the service
provider should submit in writing a quotation for the new requirement.
3.3.3. All replacement units shall comply with the Occupational Health and Safety Act of
1993, as amended, and with local authorities’ by-laws.
3.3.4. Special care shall be taken in transporting, delivery, storage on site and installation
to ensure that the replacement unit is installed and maintained in "as new" condition
at the start-up of the installation.
3.3.5. Sufficient space shall be provided for the installation and service of the unit in
accordance with the manufacturer’s instructions.
3.4. The deliverables will be as follows:
3.4.1. Maintenance of the existing masts on an ad-hoc basis. See Appendix A for more
details of antenna masts to be maintained, and Appendix B for the suggested
maintenance Task List.
3.4.2. Provide repair services on existing ATNS EAST LONDON, MTHATHA, MOUNT
MADEIRA VHF site masts (Including local and remote sites) as and when required.
3.4.3. If uneconomical to maintain or to repair; supply new antenna masts related item as
replacements for failed items.
3.4.4. Provide antenna mast related maintenance services on a callout basis.
3.4.5. Supply and deliver antenna masts related material on quotation basis.
3.4.6. Recommend on required repairs after maintenance/inspection.
3.4.7. Inspecting of ATNS antenna masts and mechanical structures on request.
3.4.8. Response to call outs for emergency repairs.
3.5. All replaced items shall come with 12 Month warranty and guarantee.
General
3.5.1. Explain their approach on mast maintenance, including audit methodology, nature,
timing and extent of approaches to be followed.
3.5.2. Demonstrate experience and expertise in mast maintenance and compliance with
applicable laws and regulations.
3.5.3. Provide details of the core team.
3.5.4. Maintain the core team throughout the duration of the contract.
3.5.5. The service provider must provide all materials, labor, and transport to complete
maintenance, the removal of existing antenna mast items and the installation of the
new items.
3.5.6. In the case of new installations, the contractor must remove existing units and install
new units and leave the working area neat and tidy on completion.
3.5.7. The quoted prices must include all preparations, materials, labor and transport
costs.
3.5.8. The performance of any other ADHOC requirement requested by management on
a quotation basis.
3.5.9. All building mast maintenance reports and working papers shall remain the property
of ATNS.
3.6. The supplier must create and submit an OHS Safety file, and comply with the
following safety requirements: -
3.6.1. Service providers are to note the requirements of the Occupational Health and
Safety Act No. , and the Construction Regulations 2003 issued in terms
of Section 43 of the Act. The tenderer shall be deemed to have read and fully
understood the requirements of the above Act and Regulations and to have allowed
for all costs in compliance therewith. The Occupational Health and Safety Act, 1993
(Act ) stipulates that the Chief Executive Officer is primarily responsible
or liable for the health and safety of all his/her employees. This is embedded in
Section 16(1) of the said Act. This responsibility or liability is also extended to
include a mandatory requirement to perform work on behalf of the employer on
his/her premises.
3.6.2. A “mandatory” is defined in the said Act as: - “Including an agent, contractor or sub-
contractor for work, but without derogating from his status in his own right as an
employer or user”
3.6.3. In terms of Section 37(2), read with Section 41, of the said Act, it is legally possible
for an employer to indemnify himself from this responsibility or liability regarding the
actions of the mandatory. Section 37(2) stipulates that there should be a written
agreement in place between the employer and the mandatory regarding the
arrangements and procedures between them to ensure compliance by the
mandatory with the provisions of the Occupational Health and Safety Act, 1993.
3.6.4. Regular inspections of the work that is performed will be conducted in order to
ensure that this written agreement is always honored, and if found not complying
with the said agreement, a notice of non-compliance will be issued. All work will be
stopped and reasons for non-compliance must be given and what corrective action
will be taken to rectify the situation must be stipulated.
3.6.5. The service provider would need to have a valid letter of good standing with regards
to Occupational Health and Safety from the Compensation Commissioner for his
tender to be valid and evaluated.
3.6.6. The performance of any other ADHOC requirement requested by management on
quotation basis; these includes Supply, inspection / testing, delivery at site,
installation, supervision, commissioning, and statutory certification.
3.6.7. All inspection / testing, delivery at site, installation, supervision, commissioning, and
statutory certification reports and working papers shall remain the property of ATNS.
3.7. Delivery
3.7.1. Delivery must take place within 7 working days once an official order is issued,
unless it if agreed with management.
3.7.2. The service provider shall always remain fully and solely responsible for the timeous
delivery of services/goods to ATNS.
3.7.3. Delivery address is Air Traffic and Navigation Services (ATNS) ;66 Settler’s Way,
Greenfields, King Phalo Airport.
3.7.4. A special arrangement will be made for deliveries at remote site.
3.7.5. Delivery of products must include the off-loading thereof at the service provider’s
own risk and cost to the designated delivery addresses as indicated above.
3.7.6. Service provider must supply and use their own labourers for the offloading of the
products at the designated ATNS sites.
3.8. Quality, Environmental and Occupational Health and Safety standards
3.8.1. The delivery of services to ATNS Shall be carried out with best quality and to a high
class of workmanship, and in compliance with OHS safety standards.
3.8.2. Products delivered to ATNS should be certified with SABS or equivalent quality
standards. In the event where ATNS elects to accept an alternative item purported
to be equal/similar by the tenderer, acceptance of the item(s) will be conditional on
ATNS’s inspection and testing after receipt.
3.8.3. If, in the sole judgment of ATNS, the item is determined not to be equal/similar, the
item shall be collected by the service provider and a correct shall be delivered.
3.8.4. The bidder must also comply with the provisions of the National Environmental
Management Act (NEMA) as well as the OHS Safety standard when operating in
ATNS environment.
3.9. Quality Tests
3.9.1. ATNS may from time to time test the quality of services and non-compliance may
result in the termination of the contract.
3.9.2. All replacement items should carry (minimum of 1 year) guarantees or warrantees
and defaults will be replaced at the cost of the service provider.
3.7. Contractors’ Responsibilities
The Contractor shall
3.7.1. Provide all the necessary skills, resources, tools, equipment and experts, to
carry out the works; as a minimum each team to carry out the repairs.
3.7.2. Review, familiarize and understand the proposed sites including all constraints and
environmental factors.
3.7.3. Supply complete method statement of new installation as well as any repairs as per
above scope of works.
3.7.4. Review, familiarize and understand the operational requirements of the facilities at
all ATNS sites.
3.7.5. Any other reasonable works required to successfully deliver the services to the
Employer on time, on budget, at the accepted quality.
3.7.6. Hand over all documentation including condition reports after services, repairs and
installations.
3.7.7. Provide Annual compliance audits.
3.7.8. Attendance and reporting to the ATNS FAEL Management on an annual basis any
significant findings identified.
3.8. Sites location

4. Validity period
4.1. Proposals must remain valid for 120 days from submission.
4.2. Bidders may request an extension to this validity period in advance, providing
reasons and justifications for the additional time required.
4.3. However, ATNS reserves the right to approve or decline such requests in the interest
of maintaining the competitiveness, fairness, and transparency of the bidding
process.
4.4. Bidders will be notified in writing regarding any matters related to extensions, if
and/or when necessary.

The bid evaluation process for this RFP will be conducted in three (3) distinct stages

8. Stage 1: Administrative requirements

the Company accepts no liability in relation to the accuracy of any representations
made. Bidders should accept that their tender response is on the basis and reliance
of its own judgment and information. ATNS reserves the right to vary the scope and
terms as described in this document. If any variation does take place tenderer will
be advised as soon as possible in writing.
14.2. The successful tenderer will be engaged subject to acceptance of a contract
containing the standard Terms and Conditions as given. The contract contains
standard clauses including a retention clause for non-satisfactory completion,
breach of contract and confidentiality clauses and a requirement for the tenderer to
have adequate professional indemnity insurance. All Tenderers must bear in mind
that if circumstances dictate, ATNS reserves its right to withdraw from any
commitments that will be entered into within this statement of work.
14.3. All designs and documentation submitted by the tenderer will be treated as
confidential.
14.4. ATNS reserves the right to reject, withdraw or cancel any or all Proposals/Tenders,
to undertake discussions with one or more Tenderers and to accept that tender or
modified tender which in its sole judgment, will be most advantageous to the
Company, price and other evaluation factors having been considered.
15. Cancellation of procurement process
15.1. This procurement process can be postponed or cancelled at any stage at the sole
discretion of ATNS provided that such cancellation or postponement takes place
prior to entering a contract with a specific service provider to which the bid relates.
16. Bid submission conditions, instruction and evaluation process/criteria
16.1. The Bid submission conditions and instructions as well as the evaluation
process/criteria have been noted. Non-compliance to any of these will result in a bid
being rejected.
17. Negotiation and contracting
17.1. ATNS have the right to enter negotiation with one or more Bidders regarding any
terms and conditions, including price(s), of a proposed contract.
17.2. Under no circumstances will negotiation with any Bidders, including preferred
Bidders, constitute an award or promise/ undertaking to award the contract.
17.3. ATNS shall not be obliged to accept the lowest or any bid, offer or proposal.
17.4. A contract will only be deemed to be concluded when reduced to writing in a formal
contract and Service Level Agreement (if applicable) signed by the designated
responsible person of both parties.
17.5. ATNS also reserves the right to enter one contract with a Bidder for all required
functions or into more than one contract with different Bidders for different functions.
18. Reasons for rejection
18.1. ATNS shall reject a proposal for the award of a contract if the recommended Bidder
has committed a proven corrupt or fraudulent act in competing for the particular
contract.
18.2. ATNS may disregard the bid of any bidder if that bidder, or any of its directors:
18.2.1. Have abused the SCM system of the ATNS.
18.2.2. Have committed proven fraud or any other improper conduct in relation to such
system.
18.2.3. Have failed to perform on any previous contract and the proof exists.
18.2.4. Such actions shall be communicated to the National Treasury.
19. General conditions of contract
19.1. The General Conditions of Contract must be accepted.
20. Additional information requirements
20.1. During evaluation of the bids, additional information may be requested in writing from
Bidders. Replies to such request must be submitted, within 7 working days or as
otherwise indicated. Failure to comply, may lead to your bid being disregarded.
20.2. No additional information will be accepted from any individual Bidder without such
information having been requested.
21. Confidentiality
21.1. The bid and all information in connection therewith shall be held in strict confidence
by Bidders and usage of such information shall be limited to the preparation of the
bid. Bidders shall undertake to limit the number of copies of this document.
22. Intellectual property, inventions and copyright
22.1. Copyright of all documentation relating to this contract belongs to the client. The
successful Bidder may not disclose any information, documentation, or products to
other clients without the written approval of the accounting authority or the delegate.
22.2. This paragraph shall survive termination of this contract.
23. Non-compliance with delivery terms
23.1. As soon as it becomes known to the contractor that he/she will not be able to deliver
the services within the delivery period and/or against the quoted price and/or as
specified, ATNS must be given immediate written notice to this effect. ATNS
reserves the right to implement remedies as provided for in the GCC.
24. Warrants
24.1. The bidder warrants that it can conclude this Agreement to the satisfaction of
Atns.
25. Parties not affected by waiver or breaches
25.1. The waiver (whether express or implied) by any Party of any breach of the terms or
conditions of this contract by the other Party shall not prejudice any remedy of the
waiving party in respect of any continuing or other breach of the terms and
conditions hereof.
25.2. No favour, delay, relaxation or indulgence on the part of any Party in exercising any
power or right conferred on such Party in terms of this contract shall operate as a
waiver of such power or right nor shall any single or partial exercise of any such
power or right under this agreement.
26. Retention
26.1. On termination of this agreement, the bidder shall, on demand hand over all
documentation provided as part of the project and all deliverables, etc., without the
right of retention, to ATNS.
26.2. No agreement to amend or vary a contract or order or the conditions, stipulations or
provisions thereof shall be valid and of any force and effect unless such agreement
to amend or vary is entered into in writing and signed by the contracting parties.
Any waiver of the requirement that the agreement to amend or vary shall be in
writing, shall also be in writing.
27. Central supplier database
27.1. It is a requirement that all suppliers/ services providers to ATNS shall be registered
on the National Treasury Central Supplier Database (CSD).
27.2. Bidders are therefore required to register as a supplier on the CSD before submitting
a bid. The CSD website can be accessed on the following link:

27.3. Bidders are therefore required to submit proof of their registration on the CSD, or if
not yet registered, provide proof of their application to be registered, with their bid.
27.4. No bid will be awarded, and a contract concluded with a bidder who is not registered

28. Format of bids
28.1. Bidders must complete all the necessary bid documents and undertakings required
in this bid document. Bidders are advised that their proposal should be concise,
written in plain English and simply presented.
28.2. If applicable, Bidders are to set out their proposal in the format prescribed
hereunder. This means that the proposal must be structured in the parts noted
below. Information not submitted in the relevant part, may not be considered for
evaluation purposes.

29.1. Bidder must ensure compliance with their tax obligations.
