Submit bids in sealed envelopes to the tender box at Sappi Building, 48 Ameshhoff Street, Braamfontein, Johannesburg 2001 by 07 July 2026 at 10:30 AM (Telkom time). Late submissions will not be accepted. Bid documents must be completed in black ink, fully, correctly, and truthfully. Mark irrelevant sections as 'N/A'. Errors must be scratched out, signed next to the correction, and accompanied by a correction letter on company letterhead if price-related. No tipex or white-out is allowed. All requested documents, including returnables, must be attached to the relevant annexures. Bid documents must be signed where required. Attendance at the compulsory briefing session on 19 June 2026 is mandatory; failure to attend may disqualify the bid. Bids are subject to public adjudication, and all bids/prices will be published on the municipality’s website after opening.

Disqualification risks: Bidders in the service of the state (as defined in the Municipal Finance Management Act) are ineligible. Bidders with directors or principals who owe municipal charges in arrears for over 3 months, have failed to perform satisfactorily on previous municipal/state contracts in the last 5 years, have abused supply chain management processes, or are listed in the Register of Tender Defaulters will be disqualified. Tax compliance: Valid Tax Compliance Status (TCS) PIN or CSD registration is mandatory. Foreign bidders must complete a pre-award questionnaire and provide proof of tax compliance. B-BBEE: Submit a valid B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs and QSEs). Business structure: Individuals, companies, joint ventures, consortia, subcontractors, or partnerships may bid but must submit relevant certificates (e.g., Joint Venture Agreement, Consortium Agreement, Subcontracting Certificate). Compliance: Must adhere to the Preferential Procurement Policy Framework Act, 2000, and its 2022 Regulations. POPIA compliance is required for processing personal data. The tender may not necessarily be awarded to the highest-scoring bidder. Negotiations may occur with selected bidders where necessary. The municipality reserves the right to award to multiple bidders or not award at all.

Inspection: Bidders must allow municipality representatives to inspect their premises at reasonable hours if required. If inspections are not initially required but later deemed necessary, the municipality will arrange and cover the costs. If services comply with contract requirements, inspection/testing costs are covered by the municipality. Non-compliant services may be rejected, and the supplier must cover the costs of removal, replacement, or re-testing. Rejected items must be replaced at the supplier’s cost and risk.

Standards: All services must conform to the standards specified in the bidding documents. Inspection: Bidders must allow municipality representatives to inspect their premises at reasonable hours if required. If inspections are not initially required but later deemed necessary, the municipality will arrange and cover the costs. If services comply with contract requirements, inspection/testing costs are covered by the municipality. If services are non-compliant, the supplier bears all inspection/testing costs, and services may be rejected. Rejected items must be removed or replaced at the supplier’s cost and risk.

Performance security: Successful bidders must provide a performance security (bank guarantee, irrevocable letter of credit, or cashier’s/certified cheque) within 30 days of award notification. The security must be in the contract’s currency or a freely convertible currency acceptable to the municipality. The security will be discharged within 30 days of contract completion, including warranty obligations. Costs: Pre-bidding testing costs are the bidder’s responsibility. If inspections/tests are required and services comply, the municipality covers the costs. If services are non-compliant, the supplier bears all inspection/testing costs and risks associated with rejection and replacement.

Tax compliance: Submit a valid Tax Compliance Status (TCS) PIN or CSD registration number. If no TCC is available, a CSD number is mandatory. Joint ventures, consortia, or subcontractors must each submit separate TCC/PIN and CSD numbers. Foreign bidders must complete the pre-award questionnaire and provide proof of tax compliance in their country. B-BBEE: Submit a valid B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs and QSEs). Municipal compliance: Bidders, their directors, subcontractors, or partners must not owe municipal charges in arrears for over 3 months. Additional: Bidders must not be listed in the Register of Tender Defaulters, must not have directors in state service, and must not have failed to perform satisfactorily on previous municipal contracts in the last 5 years. POPIA: Bidders must consent to the processing of personal information for verification purposes, as per the Protection of Personal Information Act, 2013.

Contract duration: Three (3) years. General Conditions of Contract (GCC) apply and cannot be amended. Special Conditions of Contract (SCC) may supplement GCC, with SCC prevailing in case of conflict. Contract may be divisible and awarded to multiple bidders. Municipality reserves the right to cancel the bid at any stage or not award it. Successful bidders must sign a written contract (MBD7) and a service level agreement. Performance security (bank guarantee, irrevocable letter of credit, or cashier’s/certified cheque) must be provided within 30 days of award. Security is discharged within 30 days of contract completion, including warranty obligations. Dispute resolution: Refer disputes first to the Accounting Officer. Remedies for non-compliance include disqualification, contract termination, or legal action. Municipality may verify bidder information from various sources (e.g., commercial risk ratings, tax status, financial stability, trade references, shareholding, judgments). Bidders must consent to POPIA-compliant processing of personal information for verification purposes.
