• Integrity Pact and Non-Disclosure Agreement are part of the bid conditions and must be complied with.

Respondents must: (1) Be registered on CSD prior to submission; (2) Have valid tax compliance status; (3) Pass administrative responsiveness test (on-time submission, complete returnable documents, valid documents, proper authorization); (4) Pass substantive responsiveness test (meet qualification criteria, provide priced offer, comply with scope/specifications); (5) Meet minimum technical/functionality threshold; (6) Comply with Employment Equity Act requirements; (7) Foreign suppliers must disclose agents/representatives and comply with South African tax laws if applicable.

• Scope: Supply, installation, and maintenance of thermal, noise, and PNOC-R stress real-time monitors for three years.
• Detailed scope of work is in Annexure A.
• Supplier must share Foskor's mission and business objectives, aiming for reduced costs, improved service, proactive improvements, leading-edge technology, reliable personnel support, and streamlined acquisition.
• Green economy/carbon footprint: Bidders must submit details of their environmental policies regarding waste disposal, recycling, and energy conservation.
• General service provider obligations: Fully responsible for acts/omissions of employed persons and must comply with all RFP requirements.
• Service levels: Guaranteed 95% service level on random quality/quantity/specification checks and on-time delivery. Failure results in 1.5% rebate on quarterly sales.
• Risk mitigation: Bidders must elaborate on control measures for quality/specification, continuity of supply, and compliance with Occupational Health and Safety Act.

• Pricing format: Complete pricing table as per Annexure A (item -8 of Scope of Work). Prices must be in ZAR.
• Options for price firmness:
• Keep prices firm and fixed for the contract duration.
• Keep prices firm for 12 months, then subject to adjustment using a specified index/formula.
• Discounted prices only considered if unconditional.
• Annual price review: Successful bidder must submit to benchmarking against lowest price received; must match or better within 30 days or risk termination.
• Performance bond/security may be required as per General Bid Conditions.
• Payment terms: As per Terms and Conditions of Contract; conditional discounts calculated from receipt of correct tax invoice.
• Advance payment guarantee may be required.

• Mandatory registration on National Treasury Central Supplier Database (CSD). Foreign suppliers without local entity exempt.
• Tax compliance: Provide Tax Compliance Status PIN or certificate. For consortia/JV/subcontractors, each party must submit separately.
• B-BBEE: Submit valid B-BBEE certificate or sworn affidavit for scoring (20 points).
• Employment Equity Act compliance required.
• COIDA certificate required.
• Beneficial Ownership certificate issued by CIPC required.
• Integrity Pact and Non-Disclosure Agreement must be adhered to, prohibiting corrupt practices, collusion, and requiring disclosure of conflicts of interest.
• Security clearance may be required for personnel to CONFIDENTIAL/SECRET/TOP SECRET level.
• Compliance with all applicable laws and regulations is mandatory.
• Blacklisting: Grounds include withdrawal of bid in bad faith, failure to sign contract, unsatisfactory performance, bribery, fraud, incorrect statements on local content/B-BBEE, causing damage, or bad faith litigation.

• Evaluation stages: Administrative responsiveness, substantive responsiveness, technical threshold (70 points), weighted scoring (Price 80 points, B-BBEE 20 points), post tender negotiations (if needed), award.
• Technical/functionality criteria and weightings must be stipulated in the tender document.
• Foskor may conduct stages in parallel.
• Price scoring uses formula: Ps = 80 (1 − (Pt−Pmin)/Pmin) or Ps = 80 (1 + (Pt−Pmax)/Pmax).
• B-BBEE points awarded per Preference Points Claim Form.
• Post tender negotiations occur sequentially if price not market-related.
