Bidders must comply with tax obligations. Submit a Tax Compliance Status (TCS) PIN (obtainable via e-filing at www.sars.gov.za) or a printed TCS certificate with the bid. If no TCS PIN is available but the bidder is registered on the Central Supplier Database (CSD), provide the CSD number. For consortia/joint ventures/sub-contractors, each party must submit a separate TCS certificate/PIN/CSD number. Bids from persons in the service of the state, or companies with directors/members in the service of the state, will not be considered. Failure to comply may render the bid invalid.

• The SBD 6.1 Preference Points Claim Form must be completed and submitted as part of the tender.
• Failure to submit required proof or documentation to claim points for specific goals will be interpreted as not claiming those preference points.
• The organ of state reserves the right to require substantiation of any preference claim before adjudication or at any time subsequently.

• B-BBEE: Must achieve a B-BBEE status level of 1 or 2 (for QSE or EME) to claim the allocated 3 points.

• Forward the matter for criminal prosecution.

• For disposal or leasing of state assets and income-generating procurement, price points are calculated using the formula: Ps = 80(1 + (Pt - Pmax)/Pmax), where Pt is your tender price and Pmax is the highest acceptable tender price.

Bidders must complete the SBD4 disclosure form, declaring:

• Whether the bidder or any director/trustee/shareholder/member/partner (or person with controlling interest) is employed by the state. If yes, provide full names, ID numbers, and state employee numbers.
• Whether the bidder or any connected person has a relationship with anyone employed by the procuring institution. If yes, provide details.
• Whether the bidder or any director/trustee/shareholder/member/partner (or person with controlling interest) has an interest in any other related enterprise bidding for this contract. If yes, provide details.
• The bidder must certify that the bid was prepared independently, without collusion with competitors, and that no bid details were disclosed to competitors before the official opening.
• No consultations, communications, or arrangements were made with procuring institution officials except for clarification purposes.
• Bidders listed in the Register for Tender Defaulters or the List of Restricted Suppliers will be automatically disqualified.
• False or incomplete disclosures may result in bid disqualification, reporting to the Competition Commission or NPA, and a public sector business restriction of up to 10 years.
