• Delivery: One facilitator per class. Training to be completed within 3 days.
• The supplier must conform to standards mentioned in the bidding documents.
• The department reserves the right to inspect premises and records related to contract performance.

• Price must be valid for 90 days from the quotation closing date.
• Indicate the total price including VAT.
• No advance payments will be made.
• The successful bidder must have capital resources to commence services for at least two months.
• Payments will be made monthly, within 30 days of invoice submission, upon fulfillment of contractual obligations.
• Prices quoted are firm and may not be varied after submission, except as authorized by special conditions.

• Mandatory registration on the Central Supplier Database (CSD). Failure to register by closing time leads to disqualification.
• Submit a valid Tax Compliance Status PIN from SARS or a printed TCS certificate. A CSD number can be provided if no TCS PIN is available yet.
• Submit a B-BBEE Status Level Verification Certificate or Sworn Affidavit (for EMEs & QSEs) to qualify for preference points.
• Declare any interest of persons in the service of the state.
• Bidders listed on the Register for Tender Defaulters or Restricted Suppliers will be disqualified.
• Foreign suppliers must complete a questionnaire; if answer is 'NO' to all questions, a SARS TCS PIN is not required.

• Contract Period: The service is to be rendered over 3 days.
• Warranty: The supplier warrants that all goods/services are new, unused, and defect-free. Warranty remains valid for 12 months after delivery/acceptance or 18 months after shipment, whichever is earlier.
• Payment: The purchaser will pay within 30 days of receiving a valid invoice. Payment in Rand.
• Prices are firm and may not vary from the bid price.
• Contract amendments require written agreement signed by both parties.
• The supplier may not assign obligations without the purchaser's prior written consent.
• Delays in performance may result in penalties or contract termination.
• Penalties may be imposed for late delivery/performance, calculated using the current prime interest rate.
• The purchaser may terminate the contract for default, corruption, or fraudulent practices.
• Force Majeure: The supplier is not liable for delays caused by unforeseeable events beyond their control.
• Disputes should first be resolved amicably, then through mediation, and finally in a South African court.
• The contract is governed by South African law and written in English.

• The 80/20 preference point system applies.
• Price carries a maximum of 80 points.
• Specific Goals carry a maximum of 20 points.
• Specific Goals include: Black Equity Ownership (10 points), HDP Women Equity Ownership (6 points), Disability Persons (4 points).
• Points for price are calculated using the formula: Ps = 80(1 - (Pt - Pmin)/Pmin), where Pt is your price and Pmin is the lowest acceptable tender price.
• Failure to submit proof for Specific Goals claims means you forfeit those points.
• The department may verify any claims before or after adjudication.
