Scope: Supply, delivery, installation of security fence, and construction of bundwall for mini-substations at O.R. Tambo International Airport. The contract is governed by the NEC3 Engineering and Construction Contract (ECC3) and includes Parts C1 (Agreements & Contract Data), C2 (Pricing Data), C3 (Scope of Work), and C4 (Site Information). Works must be completed within 7 months from the Starting Date.

Contract completion date: 7 months from the Starting Date (date when ACSA representative signs the contract). Defects date: 52 weeks after Completion of the whole of the works. Defect correction period: 4 weeks. First programme submission: within 2 weeks of the Contract Date. Revised programmes: at intervals no longer than 2 weeks. Quality plan submission: within 2 weeks of the Contract Date. Period for reply: 1 week.

Scope: Supply, delivery, installation of security fence, and construction of bundwall for mini-substations at O.R. Tambo International Airport. Works Information is detailed in Part C3: Scope of Work and referenced drawings/documents. Contractor must ensure works are fit for their intended purpose as stated in the Works Information. Contractor is responsible for correct setting out of the Works; errors in positioning must be rectified at the Contractor’s own cost. Site boundaries: O.R. Tambo International Airport. Access dates: Airfield, Cargo & Terminal Building areas are accessible 24 hours, 7 days a week.

Contractor must provide CVs and key personnel data (including qualifications and experience) as appended to the Tender Schedule. Responsibilities for roles such as Bricklayer must be clearly defined. Contractor must satisfy themselves as to the completeness, sufficiency, and accuracy of all provided information and drawings prior to the Contract Date.

Contractor must implement and maintain a quality management system per Works Information. Submit a quality plan for acceptance within 2 weeks of the Contract Date. The Project Manager may reject the plan if it does not allow the Contractor to Provide the Works. Any changes to the quality plan must be resubmitted for acceptance. The Project Manager may instruct corrections to non-compliance; such instructions are not compensation events. Defects date: 52 weeks after Completion. Defect correction period: 4 weeks.

Pricing structure: Priced contract with activity schedule (NEC3 ECC3 Option A). Part C2 contains Pricing Data (10 pages). Part C3 contains Scope of Work (8 pages). Contractor must submit hourly rates for Defined Cost of design outside Working Areas (Category of employee and Hourly rate). Equipment rates and adjustments must be specified per the Shorter Schedule of Cost Components. VAT is excluded unless stated otherwise.

Contract type: Priced contract with activity schedule (NEC3 ECC3 Option A). Currency: South African Rand (ZAR). Payment terms: 30 days from date of valid tax invoice. Assessment interval: between the 20th day of each successive month. Performance bond: 10% of contract value excluding VAT, unconditional and on-demand, provided by an accepted bank or insurer. Delay damages: 0.05% of contract value per day, capped at 10% of contract value. Contractor’s liability for indirect/consequential loss: R0. Contractor must re-insure deductibles for insurance claims (e.g., R275,000 for public liability on landside projects). Contractor must provide proof of insurance before contract signing.

Contractor must comply with NEC3 Engineering and Construction Contract (ECC3) conditions, including secondary Options X7 (Delay Damages), X13 (Performance Bond), and X18 (Limitation of Liability). Additional conditions (Z clauses) apply, including anti-corruption (Z21), confidentiality (Z22), and intellectual property (Z24) provisions. Contractor must provide securities, bonds, guarantees, and proof of insurance as specified in the Contract Data. CIDB registration number must be provided. Contractor must adhere to the Compensation for Occupational Injuries and Diseases Act No. 130 of 1993 for employee-related insurance. Joint ventures/consortia are jointly and severally liable (Z20).

Contractor must submit a quality plan for acceptance within 2 weeks of the Contract Date. The plan must comply with the Works Information and enable the Contractor to Provide the Works. Non-acceptance may occur if the plan is insufficient. Compensation events must be notified within 4 weeks; only those affecting the critical path qualify for adjustments to Prices, Completion Date, or Key Dates.
