Bids must be sealed and endorsed on the envelope with: "SUPPLY AND DELIVERY OF HEAVY-DUTY REFUSE BAGS: SLM/SCM/01/2026/2027". No faxed, couriered, or emailed tenders accepted. Bids will be opened in public immediately after closing. Tender documents must be obtained from the e-tender portal (www.etenders.gov.za). Tender validity period: 90 days after closing. Late bids will be rejected. Bids must be submitted on official forms provided; do not re-type. Corrections must be lined through and initialed. Unauthorized amendments may lead to disqualification. Withdrawal of bids is allowed via written notice before closing. The municipality reserves the right to extend the tender period via public notice.

Quantity: 200 bale bags per quarter (total 800 bales). Condition: New, unused, free from defects, tear-resistant, and leak-resistant. Size: Standard heavy-duty municipality refuse bag size. Quality Requirements: Bags must comply with acceptable industry standards. Municipality reserves the right to inspect goods upon delivery. Defective or substandard goods must be replaced at no additional cost within the municipality’s specified period.

Bidders must provide details of similar projects/services completed satisfactorily in the past, including: description of work, contract value, employer name, contactable references, duration, and completion date. Declaration of Interest: Bidders must disclose any relationship (family, business, or otherwise) with persons in the service of the state involved in evaluation/adjudication. Failure to disclose may result in disqualification.

Refuse bags must comply with acceptable industry standards. Municipality reserves the right to inspect goods upon delivery and during production. Defective or substandard goods must be replaced at no additional cost within the municipality’s specified period. Supplier premises must be open for inspection at reasonable hours if required. Costs of inspections/tests: Municipality covers costs if goods comply; supplier covers costs if goods do not comply. Rejected supplies must be removed and replaced by the supplier at their own cost and risk.

Pricing must include VAT at 15%. Bid pricing table must include: Unit Price, Total, Sub-Total, VAT @15%, and Grand Total. Quantity: 200 bale bags per quarter (800 bales total). Specifications: Heavy-Duty Black Refuse Bags, 35 microns thickness, packed in bales, tear-resistant, leak-resistant, standard municipality size.

Include VAT at 15% in bid pricing. Prices must remain fixed for the contract period; no adjustments allowed. Payment terms: Invoices must be accompanied by a delivery note. Payment will be made within 30 days of invoice submission. Payment in South African Rand. Penalties: 10% of invoice amount may be withheld for failure to deliver as specified. Performance security may be required within 30 days of contract award (form and amount specified in Special Conditions of Contract).

Termination for default: Municipality may terminate if supplier fails to deliver or perform obligations. Force majeure events may relieve supplier of penalties. Payment: Within 30 days of invoice submission, in Rand. Prices must not vary from bid. Contract amendments require written agreement. Supplier may not assign obligations without prior written consent. Subcontracts must be notified in writing. Disputes: Resolved via mutual consultation, mediation, or South African court. Governing law: South African law. Contract language: English. Taxes and duties: Supplier responsible for all applicable taxes until delivery.

Tender validity period: 90 days after closing date. Municipality is under no obligation to accept any bid and reserves the right to accept the whole or part of any bid. No bids will be considered from persons in the service of the state or listed on the Register of Tender Defaulters. Bidders must not have abused the municipality’s Supply Chain Management System or failed to perform on previous contracts without written notice. Municipality’s supply chain policy applies to all tender stages.

Evaluation uses the 80/20 Preferential Procurement Regulations 2022 system: 80 points for price (lowest bidder scores 80), 20 points for Specific Goals. Specific Goals: Woman Owned Company (6 points), Black Owned Company (6 points), Locality (8 points for Sakhisizwe Local Municipality, 5 for Chris Hani District, 3 for Eastern Cape, 1 for outside Eastern Cape).
