The scope involves the appointment of a panel of electrical consultants to provide professional electrical services to uMngeni Local Municipality for a contract period of 36 months. Services must conform to the standards and specifications outlined in the bidding documents. Suppliers must ensure all goods and services meet the technical requirements and are subject to inspection and testing as per the contract terms.

Bidders must declare any relationships with competitors or state employees involved in evaluation or adjudication. Competitors are defined as entities that could submit a bid based on qualifications, abilities, or experience, or provide similar goods/services.

Goods and services must conform to the standards specified in the bidding documents. Pre-bidding testing costs are for the bidder’s account. Inspections may be conducted during production, execution, or upon completion. If inspections reveal non-compliance, the supplier bears the cost and must rectify or replace defective items. The purchaser may inspect supplier records and audit performance. Non-compliant supplies may be rejected, and the supplier must remove and replace them at their own cost.

Payment terms: Invoices must be accompanied by a delivery note, and payments will be made within 30 days after receipt of the invoice. Prices must cover all obligations and remain binding for 120 days from the closing date. Performance security may be required within 30 days of contract award.

Tax Compliance: Bidders must submit a Tax Compliance Status (TCS) PIN or CSD number. Foreign suppliers must complete the pre-award questionnaire. Consortia/joint ventures must submit separate TCS certificates for each party. Municipal Rates and Services: Submit proof that municipal accounts (rates, taxes, electricity, water, refuse) for the company and all directors are up to date (not in arrears for more than 90 days). Options for proof include: current municipal statement, lease agreement with landlord certification, Rate Clearance Certificate, or affidavit (if not liable for rates). B-BBEE: Preference points may be claimed as per Preferential Procurement Regulations 2022. Declaration of Interest: Must be completed to disclose any relationships with state employees. Past SCM Practices: Declaration required to confirm no abuse of supply chain management, fraud, corruption, or contract defaults. Certificate of Independent Bid Determination: Must be submitted to confirm no collusive bidding.

Contract period: 36 months. Offers must remain valid for 120 days from the closing date. Contract terms include: warranty of 12-18 months for goods, payment within 30 days of invoice receipt, penalties for late delivery (calculated using the prime interest rate), termination for default or insolvency, force majeure clauses, and dispute resolution via mediation or South African courts. Performance security may be required. Subcontracts must be notified in writing. Contract amendments require written agreement. Suppliers must indemnify the purchaser against third-party claims of patent or trademark infringement.
