Submit a sealed hard copy of the tender document, addressed to the City Manager and marked with the tender number, to the Tender Box at 166 KE Masinga Road (Old Fort Rd), Durban by 10 July 2026 at 11:00. Bidders must be Original Equipment Manufacturers (OEMs) or accredited agents of OEMs. Accredited agents must submit a letter of accreditation from the OEM. New OEMs not part of the existing municipal fleet may be subjected to a 12-month pilot testing period. Bidders must state the names of manufacturers of goods/equipment offered. Non-manufacturers must provide a valid agreement with the manufacturer. Bidders may be required to submit samples for inspection. Delivery must include transportation to the specified delivery point, and the risk remains with the supplier until delivery is complete. Bidders must specify delivery periods in their submissions.

Bidders must be Original Equipment Manufacturers (OEMs) or accredited agents of OEMs. Accredited agents must submit proof of accreditation. New OEMs not part of the existing municipal fleet may be subjected to a 12-month pilot testing period. Bidders must provide the names of manufacturers of the goods/equipment offered. Non-manufacturers must provide a valid agreement with the manufacturer, covering the contract period.

Bidders must state where samples of the full range of products can be inspected or submit samples for inspection prior to the closing date. All goods must be supplied against the Municipality’s official order. Bidders must quote unit prices inclusive of delivery to the specified delivery point. The risk for goods remains with the supplier until delivery is complete. Bidders must specify delivery periods after receipt of the official order.

Prices must be quoted in South African Rand (ZAR), exclusive and inclusive of VAT, and stated separately on the Official Tender Form. Unit prices must be quoted for each item in the Bill of Quantities/Schedule of Rates (Section 8). Prices must hold good for the full contract period. Bidders may submit firm prices for each 12-month period, free from fluctuations. Estimated quantities are provided for information only; the supplier must supply actual quantities required by the Municipality.

Prices must be quoted in South African Rand (ZAR), exclusive and inclusive of VAT, and stated separately on the Official Tender Form. Unit prices must be quoted for each item and must hold good for the full contract period. Bidders may submit firm prices for each 12-month period, free from fluctuations. Payment will be made only to the supplier; factoring arrangements are not accepted. For imported goods, suppliers must arrange forward exchange cover within 7 days of the purchase order to fix the exchange rate. Bank charges for this are for the Municipality’s account. Suppliers must submit documentary proof of exchange rates if requested. Financial standing may be verified, and bidders may be required to submit audited financial statements for the past three years.

Registration on the National Treasury Central Supplier Database (CSD) is mandatory. Tenderers must provide their CSD Supplier Number (starting with 'MAAA'). Joint Ventures must have each party individually registered on CSD. Tax Compliance Status PIN (TCS PIN) or original Tax Clearance Certificate must be submitted and remain valid for the evaluation period. Declaration of Municipal Fees must be signed, confirming fees are paid or an acknowledgment of debt agreement is in place. Account numbers must be included; failure to do so invalidates the tender. Bidders must complete MBD 4 (Declaration of Interest), MBD 5 (Declaration for Procurement Above R10 Million, if applicable), MBD 6.1 (Preference Points Claim), MBD 8 (Declaration of Bidder’s Past SCM Practices), and MBD 9 (Certificate of Independent Bid Determination). B-BBEE certificates and CIPC registration documents may be required to verify preference claims. Occupational Health and Safety Act compliance is required, including a documented Health and Safety Plan subject to approval.

Bidders must comply with the Occupational Health and Safety Act and relevant regulations. A documented Health and Safety Plan must be submitted and is subject to approval by the Municipality. Bidders must declare acceptance of undertaking in terms of the Act and acknowledge liability for penalties for non-compliance. Fraudulent claims for preference points or non-fulfillment of contract conditions may result in disqualification, cost recovery, contract cancellation, or criminal prosecution.

The Municipality reserves the right to award tenders based on operational, environmental, and strategic requirements aligned with the Durban Climate Strategy. Bidders may be required to tender for variants of equipment in different Euro standards to meet environmental criteria.

Contract duration is 36 months. The Municipality reserves the right to accept the whole or any part of a tender and to place orders as needed. Bidders are not bound to minimum quantities per order but must supply any quantities stipulated in the specification. The Municipality may negotiate with preferred bidders under Regulation 24 of the Municipal Finance Management Act, provided it does not disadvantage other bidders or lead to higher prices. The Municipality may cancel the tender at any time without liability. Successful tenderers must sign a written Contract Form (MBD 7). Payment terms and conditions are as per the General Conditions of Contract. Factoring arrangements are not accepted.

Evaluation uses the 80/20 preference points system. Price points (max 80) are calculated using the formula: NFO = W (1 - (Pt - Pmin)/(Pmax - Pmin)), where W is 80 or 90 (depending on tender value). Preference points (max 20) are awarded for B-BBEE Ownership (30% weighting) and RDP Goals (70% weighting). Ownership: Black ownership >0% and <51% scores 2.4 points, >51% and <100% scores 4.2 points, 100% scores 6 points. RDP Goals: South Africa-based entities score 5.6 points, KZN-based score 9.8 points, eThekwini Municipality-based score 14 points. Proof of claims (CIPC, CSD, B-BBEE certificates) is required.
