• Bidders who are not manufacturers, accredited distributors, or agents must provide a valid agreement/Joint Venture Agreement with the manufacturer/accredited distributor/agent, covering the contract period.
• Delivery: Unit price must include delivery to specified delivery point (as per SCT). Risk remains with supplier until goods are duly delivered.
• Bidders must state delivery period after receipt of official order.
• Samples may be required for inspection prior to closing date.

• Prices must be quoted per Official Tender Form.
• Quantities are estimates; supplier bound to supply actual quantities required.

• Prices must be quoted in South African Rand (ZAR).
• Quote nett prices after deduction of any brokerage or discount.
• Quote one unit price per item, valid for full contract period, subject to variation only as per contract conditions.
• Firm prices may be submitted for each 12-month period, free from fluctuations including statutory increases.
• State prices exclusive and inclusive of VAT separately on Official Tender Form.
• Pricing structure must not deviate from Official Tender Form; deviation precludes bidder.
• Estimated quantities are in Section 8 (Bill of Quantities/Schedule of Rates/Activities) for information only. Supplier bound to supply actual quantities required by municipality.
• Payment conditions as per Conditions of Contract. Payment only to supplier(s); factoring not accepted.

• Mandatory Central Supplier Database (CSD) registration: Tenderer must be registered on National Treasury CSD. Provide MAAA number in Section 1. Joint venture parties must each be registered.
• Tax compliance: Submit Tax Compliance Status PIN (TCS PIN) or original Tax Clearance Certificate. Include printout with submission. Separate TCS PINs required for each joint venture entity.
• Declaration of Municipal Fees: Must be signed, declaring municipal fees are paid or acknowledgement of debt agreement concluded. Include account numbers.
• B-BBEE: Preference points claimed via MBD 6.1. May require B-BBEE certificate, CIPC document, CSD report, or consolidated certificate for joint ventures.
• Required forms: MBD 4 (Declaration of Interest), MBD 5 (Declaration for Procurement Above R10 Million if applicable), MBD 6.1 (Preference Points Claim), MBD 8 (Declaration of Bidder’s Past SCM Practices), MBD 9 (Certificate of Independent Bid Determination).
• Occupational Health and Safety: Submit Declaration with respect to Occupational Health and Safety Act.
• Authority of Signatory: Complete and include required supporting documents (e.g., Board Resolution for companies, Power of Attorney for joint ventures).
• Persons in service of the state (as per Regulation 44) are not eligible.

• Compliance with Occupational Health and Safety Act and relevant Regulations is required.
• Submit Declaration with respect to Occupational Health and Safety Act as part of returnable documents.
• Successful contractor must implement documented Health and Safety Plan approved by employer.

• Contract period: 36 months (as and when required).
• Tender validity: 120 days after opening plus 12 months unless bidder advises otherwise.
• Municipality not bound to accept lowest or any tender, may accept whole or part, and may award to multiple bidders per item.
• No minimum quantity per order; supplier bound to supply quantities stipulated.
• Contract includes General Conditions of Contract (NT Circular 52 July 2010) and Special Conditions of Contract.
• Successful tenderer must sign written Contract Form (MBD 7).
• Breach of Regulation 44 (persons in service of state) allows termination.
• Change of ownership or major policy during contract must be disclosed in covering letter.
• Municipality may cancel tender before award without liability.
• Appeals must be lodged within 14 days of decision, with non-refundable administration fee of R1814.00 (VAT included).

• Evaluation uses 80/20 preference points system.
• Price points calculated per Regulation 4.1.
• Preference points from MBD 6.1 for Specific Goals: RDP Goal (70% weighting, location-based points) and Ownership Goal (30% weighting, Black ownership percentage points).
• Mandatory OEM or accredited agent requirement.
• Municipality may award to more than one responsive bidder per item.
