The contractor must be able to sign the Form of Offer and Acceptance and provide the required data in C1.2b (company details, key personnel CVs, risk register items). Key personnel (Site Manager, Technicians) must be identified with qualifications and experience. The contractor must have the financial capacity to handle the contract value and provide proof of insurance as per C1.4. Compliance with South African law, BBBEE, and tax regulations is required. For joint ventures, members are jointly and severally liable.

• Scope: Maintenance of fire system infrastructure at Bram Fischer International Airport for 36 months.
• Systems include: Fire extinguishers, hose reels, hydrants, detection system, suppression system, booster pump stations, and fire escape equipment.
• Maintenance activities: Servicing, repairs, replacement of components, system performance tests, and statutory tests.
• Compliance: All work must comply with SANS 10400-part T, SANS 1475, SANS 10139, SANS 10287, SANS 246, OHS Act regulations, and other relevant legislation.
• Standards: Work must meet Original Equipment Manufacturer (OEM) specifications; the more stringent requirement applies where standards differ.
• Staffing: Contractor must provide sufficiently skilled and qualified staff, comply with minimum staffing schedules, and ensure staff are always reachable.
• Response times: All work must be performed within required response times as stipulated in annexes.
• Uniforms: Staff must wear safety shoes, work suits, and uniquely numbered reflective jackets as per airport requirements.
• Location: Works are at Bram Fischer International Airport in Bloemfontein.

• Key personnel: Contractor must provide CVs for key persons: Site Manager, Technician, Technician's Assistance, and others as required.
• Staff requirements: Staff must be sufficiently skilled, qualified, and competent; replacements must not be of lesser ability.
• Experience: Details of qualifications and experience must be provided for each key person.
• Risk register: Contractor must include matters in Risk Register as specified.

• Standards: All work must comply with SANS standards, OHS Act regulations, and other relevant legislation.
• Quality plans: Contractor must draft quality plans for Service Manager to improve system reliability and ensure maintenance work is performed.
• Maintenance schedule: Preventative maintenance must be scheduled to annexure requirements; allowances must be included in pricing.
• Defect guarantee: All repair work carries a defect-free guarantee for 3 months after completion.

• Price list: Located in Section C2.2 of Pricing Data.
• Activity schedule: Includes items for Preventative Maintenance, Call-Outs, and Repairs and Spares provisional sums.
• Pricing instructions: Costs must be VAT exclusive; cover all risks, expenses, allowances; payments made per activity upon completion.
• Provisional sums: For repairs and spares with 15% mark-up; amounts provisional and may be deducted if unspent.
• Contract value: Estimated over 3 years with CPI adjustments; illustrative 6% escalation used.
• Summary schedules: Provide totals for Year 1 and 3-year projections including VAT.

• Pricing strategy: Based on Price List (including activity schedule).
• Prices: Must be VAT exclusive and cover all risks, liabilities, obligations, profit, expenses, allowances, and consumables.
• Payment: Made per activity only when complete; 'complete' means the complete system or unit as specified.
• Variations: Measured and priced at rates in Activity Schedule; non-scheduled items agreed separately.
• Provisional sums: Expended as directed; unspent balances deducted from contract sum.
• Pricing schedules: Include Preventative Maintenance, Call-Outs, and Repairs and Spares provisional sums.
• Contract value: Estimated over 3 years with CPI adjustments; illustrative 6% escalation used.
• Payment terms: Assessment interval is 15th of each month; payments made within 30 days.

• B-BBEE and Tax Clearance: Contractor must annually present compliant BEE Certificate and Tax Clearance Certificate; failure is a material breach.
• Insurance: Contractor must provide minimum insurances: Contractors Equipment, Compensation for Occupational Injuries and Diseases Act coverage, Motor Vehicle Liability, and Public Liability.
• Subcontracting: No part may be subcontracted without written approval from ACSA.
• Ethics: Contractor must not engage in corrupt practices; breach grounds for termination.
• Confidentiality: All contract information is confidential; cannot be disclosed without prior written consent.
• Health and Safety: Contractor is an employer under OHS Act; must ensure all work complies with OHS Act and Construction Regulations.
• Permits: Contractor responsible for all ACSA required permits; costs must be included in pricing.
• Legal compliance: Service Manager may request proof of compliance with any law or regulation.

• Compliance: Contractor fully responsible for OHS Act compliance for all persons, equipment, and installations.
• Fines: Service Manager may fine contractor R2000 for each health and safety non-conformance.
• Permits: Hot works permit required for areas like airside, basements, terminal building; obtainable from ACSA Safety.
• Safety equipment: Contractor must provide safety gear (e.g., goggles, boots, harness) at own expense.
• Uniforms: Staff must wear safety shoes, overalls with company logo, and numbered reflective jackets.
• Cell phones: Use on airside requires ACSA Security permit; two-way radios must be approved by ACSA IT.
• Public protection: Work must be hoarded and guarded to safeguard public.
• Housekeeping: Maintain good housekeeping standards on site.
• Emergency procedures: Staff must be familiar with emergency procedures and cooperate in drills.

• Environmental protection: Contractor must not release pollutive substances into air or storm water systems, interfere with system functionality, or cause fire hazards.
• Noise and dust: Keep levels minimal to avoid nuisance or danger to public or other workers.

• Contract documents: Include Part C1 (Agreements and contract data), C2 (Pricing data), C3 (Service information), C4 (Site information), schedules, drawings, and documents.
• Precedence: Service information (C3) prevails, then Contract Data (C1.2), General Conditions of Contract, Pricing data, and other documents.
• Conditions: NEC3 Term Service Contract (April 2013) with main Option A (Priced contract with price list), dispute resolution Option W1, secondary Options X1 (Price Adjustment for inflation) and X18 (Limitation of Liability), and Additional conditions Z.
