• All bids must be delivered in a sealed envelope to the Tender Box at the municipality’s main office (Lot 103, Main Street, Nongoma, 3950) no later than 12:00 pm on 26 February 2026. Late, faxed, emailed or telegraphic submissions will be rejected.

• Evaluation is conducted in two stages: Administrative compliance (mandatory documents) and Functionality scoring.

1. Company overall experience – max 30 points (based on number of favourable case orders).

2. Experience in local government – max 40 points (appointment letters/reference letters, not older than 10 years).

3. Personnel – max 30 points (number of admitted attorneys with active Legal Practice Council registration, organogram and CVs required).

• Only bidders achieving at least 80 points proceed to further evaluation.
• A maximum of ten (10) bidders per legal category will be appointed to the panel; if more than ten meet the threshold, ties are broken by drawing of lots.
• Scores are rounded to two decimal places.

Scope of work: Provide specialised legal services on an as‑and‑when‑required basis for a 36‑month period, covering:

• Labour & Employment Law
• General Litigation
• Contract & Commercial Law
• Conveyancing & Property Law
• By‑law drafting & enforcement
• Legal opinions and advisory services

Functionality evaluation criteria as detailed above (experience, local‑government experience, personnel). Joint ventures/consortia must submit a statement describing the work split between parties. All supporting evidence must be submitted in the prescribed format to achieve full functionality points.

• Pricing to be submitted in the Municipal Pricing Schedule (MBD 3.3) – hourly rates for Director, Attorney and Candidate Legal Practitioner for Years 1‑3. Prices must be VAT‑inclusive.
• Performance security (bank guarantee or certified cheque) to be provided within 30 days of contract award notification, as per Clause 7 of the General Conditions of Contract.
