Bidders NOT listed on the Register for Tender Defaulters or List of Restricted Suppliers. Bidders must provide complete and truthful disclosures. Bidders must certify independent bidding without collusion. Bidders must not have been involved in drafting the tender specifications.

• Any person (natural or juristic) may submit a bid.
• Bidders must complete a detailed declaration form (SBD4).
• Bidders listed on the Register for Tender Defaulters or List of Restricted Suppliers will be automatically disqualified.
• The declaration requires disclosure of:
• Whether the bidder, its directors, trustees, shareholders, members, partners, or any person with a controlling interest is employed by the state. If yes, provide full names, ID numbers, and state employee numbers.
• Whether the bidder or any connected person has a relationship with an employee of the procuring institution. If yes, provide particulars.
• Whether the bidder or any person with a controlling interest has an interest in any other related enterprise bidding for this contract. If yes, provide particulars.
• The bidder must certify that:
• The bid is prepared independently without consultation, communication, agreement, or arrangement with any competitor (except within a joint venture or consortium).
• There have been no discussions with competitors regarding bid details such as quality, quantity, specifications, prices, market allocation, or submission intentions.
• Bid terms have not been disclosed to any competitor before the official bid opening or contract award.
• There have been no improper consultations with officials of the procuring institution, except for clarifications, and the bidder was not involved in drafting the specifications.
• False declarations may lead to bid disqualification, reporting to the Competition Commission and National Prosecuting Authority, and restriction from public sector business for up to ten years.

• False declarations carry risks of disqualification, legal reporting, and business restrictions.
