• If prices are variable due to exchange rate fluctuations, forward exchange rate cover must be obtained within 14 days of order placement.
• No price increases will be considered after the closing date and time of the quotation.

Note: Suppliers must comply with the Codes of Good Practice on B-BBEE as published by the Minister of Trade and Industry. False declarations may lead to disqualification or legal action.

The successful tenderer must comply with the Occupational Health and Safety Act, 1993, and its regulations. This includes:

• Ensuring all relevant duties, obligations, and prohibitions imposed by the Act are fully adhered to.
• Accepting sole liability for compliance with the Act and its regulations.
• Allowing the City of Johannesburg to inspect sites, premises, or records to verify compliance.
• Reporting any investigations, complaints, or criminal charges arising from the Act to the City of Johannesburg.
• Signing an Article of Agreement in terms of the Occupational Health and Safety Act (Form I).

Contractual terms and conditions:

• The City of Johannesburg reserves the right to accept the whole or any portion of a quotation. The lowest price or any quotation will not necessarily be accepted.
• Quotations must remain open for acceptance for 30 days from the date of submission.
• All purchases will be made through an official purchase order. No goods or services may be delivered before receiving an official purchase order.
• The municipality reserves the right to cancel and re-issue the quotation.
• The successful bidder must execute orders in strict accordance with the accepted specification and within the quoted delivery period.
• The municipality may terminate the contract if the successful bidder commits any corrupt or fraudulent act during the bidding process or contract execution.
• Copyright and patent rights for any documents, systems, or processes produced during the contract vest in the municipality.
• Suppliers must comply with the City of Johannesburg SCM Policy and Procedures, available on the CoJ website.
• Forward exchange rate cover is required if prices are based on exchange rates. Proof must be submitted within 14 days of order placement; failure to do so may result in contract cancellation.

Evaluation uses the 80:20 point system as per the Preferential Procurement Policy Framework Act and Regulations, 2022:

• Price: 80 points (formula: Ps = 80(1 - (Pt - Pmin)/Pmin), where Pt = tender price, Pmin = lowest acceptable tender price).
• Preferential Goals: 20 points maximum, allocated as:
• 5 points: Business owned by 51% or more Black People (requires CSD report, valid B-BBEE certificate/affidavit, ID copy of owner(s), shareholder’s certificate).
• 5 points: Business owned by 51% or more Women (requires CSD report, valid B-BBEE certificate/affidavit, ID copy of owner(s), shareholder’s certificate).
• 10 points: Enterprise located within the City of Johannesburg Metropolitan Municipality (requires CSD report and proof of municipal account).

Note: Failure to submit required proof for preferential goals will result in zero points for those goals. The organ of state may request additional substantiation at any time.
