• Course Content:
• Role of an initiator in workplace discipline.
• Purpose and implementation of disciplinary codes.
• Investigating, preparing, and presenting employer’s case in hearings.
• Formulating misconduct allegations.
• Differentiating between misconduct and poor performance.
• Collecting and preparing evidence.
• Responsibilities of an initiator before, during, and after hearings.
• Preparing and questioning witnesses.
• Motivating disciplinary measures.
• Ensuring fair outcomes.
• Modules:

1. Law of Evidence (admissibility, types of evidence, evaluation).

2. Chairing a Disciplinary Hearing (rights/responsibilities, fairness, sanctions).

3. Fair Procedure (preparation, conduct, appeals, record-keeping).

4. Difficult Situations and CCMA Guidelines (investigations, new charges, delays, subpoenas, legal representation, case law).

• Supplier Requirements:
• Must be registered with relevant SASSETA.
• Supply own resources: projector, pens, whiteboard markers, flip charts.
• Manage attendance registers and provide them to PRASA.
• Handle all administrative tasks during the course.
• Issue hardcopy certificates of competency upon completion.
• Delivery: Specify earliest possible delivery period in working days from the date of order.

• Similar Projects: Bidders are scored based on the number of successfully completed similar projects (0 to 5+).
• Evidence Required: Appointment letters, purchase orders, client details (name, email, phone), project start/end dates, contract value (incl. VAT), and completion certificates.
• Scoring:
• 0 projects: 0 points.
• 1 project: 20 points.
• 2 projects: 40 points.
• 3 projects: 60 points.
• 4 projects: 80 points.
• 5+ projects: 100 points.
• Minimum Threshold: 60% for technical/functionality criteria to proceed to price evaluation.

• Mandatory Forms: Complete the Pricing and Delivery Schedule (Section 4) and BOQ/Pricing Schedule (Section 10). Failure to submit these results in disqualification.
• Format: Submit pricing strictly in the provided schedule format. Deviations may lead to non-responsiveness.
• Discounts: Unconditional discounts are considered only in the final evaluation stage.
• Arithmetic Errors: PRASA will notify bidders of errors/omissions in the BOQ for clarification.
• Market-Related Pricing: PRASA may negotiate with top bidders if prices are deemed non-market-related.

• Pricing:
• Quote in South African Rand (ZAR), inclusive of all applicable taxes (VAT 15%).
• Prices must be firm and clearly indicate the basis (e.g., fixed price, escalation formula).
• Complete the Bill of Quantities (BOQ)/Pricing Schedule (Section 10) as provided. Deviations may result in non-responsiveness.
• Provide a cost breakdown and price escalation basis/formula if applicable.
• Discounted prices will only be considered in the final evaluation stage on an unconditional basis.
• Payment Terms:
• PRASA pays within 30 days of receipt of a correct tax invoice.
• Payment may be made in a currency other than ZAR, subject to PRASA’s approval and a single exchange rate.
• Market-Related Pricing: If the highest-scoring bidder’s price is not market-related, PRASA may:
• Negotiate with the highest-scoring bidder.
• Proceed to the second or third highest bidder if negotiations fail.
• Cancel the RFQ if no agreement is reached.

• Tax Compliance:
• Submit a valid SARS Tax Compliance Status (TCS) PIN or CSD registration number. Apply via e-Filing at [www.sars.gov.za](http://www.sars.gov.za).
• Foreign suppliers with no local entity are exempt from CSD registration but must comply with other tax obligations.
• Consortia/JVs/Subcontractors: Each party must submit a separate TCS PIN/CSD number.
• Central Supplier Database (CSD):
• Mandatory registration on the National Treasury’s CSD ([https://secure.csd.gov.za/](https://secure.csd.gov.za/)). Business will not be awarded to unregistered bidders.
• B-bbee:
• Preference points for Black Youth Ownership (10 points) and EME/QSE 51% Black Owned (10 points). Submit supporting documents (e.g., certified ID copies, audited financials, B-BBEE certificates).

• Disqualifications:

• False declarations (e.g., PEP/PIP status) may lead to disqualification or contract termination.
• Politically Exposed Persons (PEPs) and Prominent Influential Persons (PIPs):
• Disclose any PEP/PIP involvement in the organisation or beneficial ownership. PRASA reserves the right to reject bids with PEP/PIP ties if not justified.
• Subcontracting: Requires prior written approval from PRASA. The primary bidder remains liable for performance.

• Warranty: Supplier guarantees that services are fit for purpose and free from defects for 1 year from acceptance (unless otherwise stated).
• Indemnity: Supplier indemnifies PRASA against claims arising from negligence, breach of statutory duty, or defective workmanship/materials.
• Subcontracting: Requires prior written approval from PRASA. The primary bidder remains liable for performance.
• Governing Law: Contracts are governed by South African law, with disputes subject to South African courts.
• Rejection: PRASA may reject non-compliant items/services. Supplier bears costs for returns, replacements, or third-party procurement.
• Assignment: Contracts cannot be assigned without PRASA’s consent.
• Termination: PRASA may terminate if the supplier fails to meet obligations, with potential penalties or recovery of costs.
• Dispute Resolution: Legal review of proposed terms by PRASA’s Legal Counsel before award.
