Mandatory: Valid COIDA certificate of good standing or proof of application (Compensation Fund or licensed insurer) for South African tenderers. Additional SHEQ documents may be required as per scope of work (refer to attached SHEQ requirements).

Contract: NEC3 Supply Contract (SC3) with core clauses and selected options: X1 (Price adjustment for inflation), X2 (Changes in law), X3 (Multiple currencies), X7 (Delay damages), X17 (Low performance damages), X20 (Key Performance Indicators), Z (Additional conditions). Eligibility: Tenderers (single entity, JV, or consortium) must not be restricted from doing business with Eskom or SOCs. Disqualification risks: Nationality of sanctioned country; multiple tenders (except e-tendering size limits); JV/consortium without joint/severe liability; conflict of interest; non-authorized signatories; National Treasury restrictions; Tender Defaulters list; 100% subcontracting of scope. JV requirements: All members registered with CIDB (if applicable), lead partner meets grading requirements, combined grading meets contract value, and JV agreement includes liability and profit-sharing terms.

Pricing (80 points): Evaluated on inclusivity of VAT, correction of arithmetical errors, exclusion of contingencies, adjustments for variations/deviations, Net Present Value comparison, and unconditional discounts. Specific Goals (20 points): Scored per PPPFA 2022 regulations. Tenderers ranked by combined score (80/20 system). Objective criteria (Annexure K) may override highest score. Contractual requirements (e.g., CSD, ISO 9001) are non-scoring but mandatory for award.
