Expression of interest: supply, installation, and commissioning of sulphur trioxide skids and common plant for ESKOM

• The Invitation to Tender documents include any annexures and additional requirements stated in the Tender Data.
• Addenda to the Invitation to Tender will be published or issued in the same manner as the original tender and form part of the documents.
• All communication between Eskom and tenderers must be made to or from the Eskom Representative only, in writing.

• Closing date and time: As specified in the Tender Data. All references to time are South African Standard Time (SAST).
• Compulsory site visit and/or clarification meeting: Details (date, time, venue) are stated in the Tender Data. Failure to attend results in disqualification.
• Tenderers must check the Eskom Tender Bulletin and NT e-Tender Portal regularly for addenda, extensions, and clarifications.

• All communication must be made to or from the Eskom Representative only, in writing.
• Contact details (name, email, phone, address) for submission and queries are specified in the Tender Data.
• The Eskom Representative will publish clarifications and addenda on the Eskom Tender Bulletin and NT e-Tender Portal.

• Submit a complete original tender in paper form plus one (1) complete hard copy of the original tender at the address and tender box specified in the Tender Data by the closing date and time.
• For e-tendering, upload and finalise the tender via Eskom Tender Bulletin site on the Eskom E-tendering page by the closing date and time. Electronic submission only is accepted for e-tenders.
• Ensure documents are submitted and accessible for downloading/evaluation without corruption or readability issues.
• Tenders must be submitted in English, completed in ink (not pencil), and result in a permanent record.
• Sign the original tender. Eskom will hold the signatory liable.
• Package the original and copy separately, marking them as “ORIGINAL” and “COPY”. If an electronic copy is required, package it separately marked “ELECTRONIC COPY”.
• Seal separate packages together in an outer package marked “Confidential” with the Eskom address, Invitation to Tender number, tenderer’s name, physical address, email, and contact telephone.
• Return mandatory tender returnables by the closing date and time. All documents must be fully completed.
• Proof of posting or courier delivery does not equate to proof of delivery. Eskom is not responsible for misplacement or premature opening if packages are not sealed or addressed incorrectly.
• Late tenders will not be accepted. The e-tendering system will not allow submissions after the closing time.
• Tenderers must attend compulsory site visits or clarification meetings; failure results in disqualification.
• Sub-contracting 100% of the scope of work is not permitted; such tenders will be deemed ineligible.

Tenderer must meet eligibility criteria in Tender Data; not be restricted from business with Eskom/state-owned companies; cannot sub-contract 100% of scope; must provide proof of CIDB registration if applicable; must comply with B-BBEE requirements; and must not have misrepresented/falsified information (fraud leads to suspension).

• The scope includes procurement, design, manufacturing, shipping, transportation, storage, decommissioning, installation, testing, commissioning, documentation, and handover of unit 1 to 6 Sulphur trioxide skids and common plant.
• Tenderers must check Invitation to Tender documents on receipt and notify the Eskom representative of any discrepancies or omitted documents.
• The Acknowledgement Form must be completed and submitted with the tender, stating if the tender is for the whole or part of the works/services/supply.

• Eskom will not compensate tenderers for costs incurred in preparation, submission, testing, or negotiation.
• Check Invitation to Tender documents on receipt and notify Eskom representative of discrepancies or omitted documents.
• Complete and submit the Acknowledgement Form with the tender, stating if tender is for whole or part of works/services/supply.

• Include all duties, taxes (including VAT), and levies payable, applicable 14 days prior to closing.
• Provide fixed rates and Prices for contract duration, not subject to adjustment except as provided.
• State in South African Rand unless instructed otherwise; submit in Rands per stipulated exchange rate and base date.
• Do not alter tender documents except to comply with instructions or correct errors; alterations must be initialed.
• Submit alternative tenders only if main tender submitted and permitted.
• Clarification and correction of Prices may be requested during evaluation, but mandatory returnables cannot be submitted after closing.
• Designated materials and thresholds information must be submitted by contract award.
• If functionality is a criterion, meet minimum threshold to proceed.
• Financial analysis assesses risk; mitigating factors considered.
• Price evaluation considers CPA, FOREX, commodity exposure, discounts, technical adjustment, PV, invoicing rates.
• Arithmetical errors checked; discrepancies resolved in favour of words.
• Specific Goals scoring requires supporting documentation; failure results in zero points within 90/10 or 80/20 allocation.
• Ranking combines Pricing and Specific Goals scores per PPPFA.
• Objective Criteria may be used if stipulated; functionality and B-BBEE elements cannot be used.

• Include all duties, taxes (including VAT), and levies payable by the tenderer if successful, applicable 14 days prior to closing.
• Provide rates and Prices fixed for the contract duration, not subject to adjustment except as provided in the Invitation to Tender.
• State rates and Prices in South African Rand unless instructed otherwise. Submit in Rands according to exchange rate and base date stipulated.
• Do not make alterations or additions to tender documents except to comply with instructions or correct errors; all alterations must be initialed by signatories.
• Submit alternative tenders only if a main tender is also submitted and if permitted by the Invitation to Tender.
• Clarification and correction of Prices may be requested during evaluation, but mandatory returnables cannot be submitted after closing.
• Financial analysis may assess risk; tenderers may need to meet mitigating requirements.
• Arithmetical errors will be corrected; tenderers must confirm or accept corrected prices.

• Comply with relevant legislation: National Treasury Instructions, CIDB Regulations, PPPFA Regulations, Amended B-BBEE Codes, COIDA, OHS Act, Eskom’s SHEQ requirements, and other applicable laws.
• Provide proof of Safety, Health, Environment, and Quality (SHEQ) systems, policies, and capabilities at closing date and time. All SHEQ costs and personnel must be reflected in the tender.
• If CIDB grading is stipulated, tenderers must be registered with CIDB at closing or capable of registration within 21 working days. Proof of registration (or application) is mandatory.
• Contract Skills Development Goals (CSDG) apply if contract duration ≥12 months and value ≥R5 million (professional/services) or CIDB grade ≥7 (engineering/construction).
• Contract Participation Goals (CPG) apply to construction works contracts in GB/CE classes, duration ≥6 months, and ≥25% subcontracting in CE, EB, GB, or ME classes.
• Misrepresentation or falsification of information, including B-BBEE certificates, may lead to disqualification, reporting to B-BBEE Commission, suspension for up to 10 years, or legal action.
• Submit SDL&I Undertaking by contract award.
• B-BBEE level must be provided via CSD report or certificate/affidavit. If a pre-qualification criterion, proof is required at closing.
• Sub-contractors’ B-BBEE status may need to be provided if sub-contracting to designated groups is utilised.

• Comply with relevant legislation including OHS Act and Eskom’s Safety, Health, Environment, and Quality (SHEQ) requirements.
• Provide proof of SHEQ systems, policies, and capabilities at closing date and time.
• If CIDB grading is stipulated, be registered or capable of registration within 21 working days. Proof mandatory.
• Contract Skills Development Goals (CSDG) apply to contracts ≥12 months and meeting value/grade thresholds.
• Contract Participation Goals (CPG) apply to construction works contracts in specified classes with duration ≥6 months and ≥25% subcontracting.
• Misrepresentation or falsification may lead to disqualification, reporting, suspension, or legal action.
• Submit SDL&I Undertaking by contract award.
• Clarifications and addenda are published on Eskom Tender Bulletin and NT e-Tender Portal.
• Grounds for rejection include influence, collusion, bid rigging, or fraudulent/illegal activity.
• Reverse e-auction may be used; if so, submit tender without prices.
• Contract documents are revised to include addenda, returnables, negotiated changes, and other agreed revisions.

• Eskom reserves the right to enter into mandated negotiations with selected tenderer(s) per approved procurement policies.
• Eskom disclaims liability for accuracy or completeness of tender documents and any losses arising from participation.
• Tenders must be held valid for acceptance within the validity period after closing. Extensions may be requested; refusal excludes further consideration.
• Treat all procurement matters as confidential. Use Eskom documents only for preparing and submitting the tender.
• Attend compulsory site visits or clarification meetings; details are in Tender Data.
• B-BBEE level scoring: proof required at closing if pre-qualification criterion; disqualification for fraudulent/expired documents.
• For PPPFA points, lack of B-BBEE proof results in zero points but not disqualification if otherwise responsive.
• Specific Goals scoring requires supporting documentation.

• Eskom will not measure a criterion twice in different evaluation phases (no ‘double dipping’).
• If functionality is a criterion, tenderers will be scored against functionality criteria and must meet a minimum threshold stated in the Tender Data to proceed.
• Financial analysis may assess the risk of doing business with a supplier; mitigating factors are considered.
• Price evaluation considers factors such as CPA, FOREX, commodity exposure, unconditional discounts, technical adjustment, PV, and forecasted invoicing rates.
• B-BBEE level is scored as per CSD report or certificate/affidavit. If a pre-qualification criterion, proof must be provided at closing.
• For PPPFA point allocation, lack of valid B-BBEE proof results in zero points but not disqualification if otherwise responsive.
• Specific Goals are scored with supporting documentation; failure results in zero points within 90/10 or 80/20 allocation.
• Ranking combines Pricing and Specific Goals scores per PPPFA.
