Bidders must not be listed on the Register for Tender Defaulters or the List of Restricted Suppliers. They must truthfully disclose any conflicts of interest as outlined in the disclosure form. The bidder and its associates must comply with the Prevention and Combating of Corrupt Activities Act and the Competition Act. Failure to provide true and complete disclosure will result in disqualification.

Returnable Documents: This preference points claim form (SBD 6.1) must be completed and submitted as part of your tender. Failure to submit required proof/documentation for specific goals will be interpreted as not claiming those preference points.

All tenderers are eligible to bid on price. However, to be competitive, tenderers should qualify for the specific goal points. To claim these, the tenderer's company/firm should ideally be: 1) A Small, Medium, or Micro Enterprise (SMME), including Exempted Micro Enterprises (EMEs) and Qualifying Small Enterprises (QSEs). 2) At least 50% owned by black people. 3) At least 30% owned by black youth. 4) At least 30% owned by black women. 5) At least 30% owned by black people with disabilities. The company must be a legally registered entity (e.g., (Pty) Ltd, Close Corporation, etc.).

You must complete and submit the SBD 6.1 Preference Points Claim Form.

• The form requires your company/firm name, registration number, and type of entity (e.g., Pty Ltd, Close Corporation).
• You must declare that the information and preference points claimed are true and correct.
• The organ of state may require documentary proof to substantiate any claims before adjudication or at any time.
• Fraudulent claims can lead to disqualification, contract cancellation, cost recovery, blacklisting for up to 10 years, and criminal prosecution.
• Specific goals for preference points include:
• SMME (EME & QSE) status.
• Ownership by black people (50% or more).
• Ownership by black youth (30% or more).
• Ownership by black women (30% or more).
• Ownership by black people with disabilities (30% or more).
• Points for these goals are allocated differently under the 80/20 and 90/10 systems as per Table 1 in the form.

Preference points are awarded for specific B-BBEE goals as per the Preferential Procurement Regulations 2022.

• The information and points claimed are true and correct and comply with the general conditions.
• If awarded, you may be required to furnish documentary proof to support your claims.
• Fraudulent claims or breach of contract conditions may result in:
• Disqualification from the tendering process.
• Recovery of costs, losses, or damages by the organ of state.
• Contract cancellation and claim for damages.
• Recommendation for blacklisting from all organs of state for up to 10 years.
• Criminal prosecution.

The tender uses a preference point system as per the Preferential Procurement Regulations 2022.

• The maximum points for this tender are allocated as: Price 80, Specific Goals 20, Total 100.
