RFQ: newspaper publication services with smme affidavit requirements

• This document is an addendum providing a template for a sworn affidavit to be completed by bidders who are EMEs or QSEs.
• The affidavit is required to claim SMME preference points under the B-BBEE criteria.
• It must be completed and returned with the RFQ/RFP.

• Complete and return the Sworn Affidavit of both EME and QSE (Annexure B) with your RFQ/RFP submission.
• The affidavit must be signed by a Commissioner of Oaths and include the deponent's signature and date.
• Tick the applicable box to confirm whether the enterprise is an EME or QSE.
• Ensure the affidavit is valid (not older than 12 months from the date signed by the commissioner) at the time of submission.
• Incomplete or missing affidavit may result in loss of SMME preference points.

• SMME points are allocated only when the completed Sworn Affidavit is returned with the RFQ/RFP.
• To qualify for SMME points, the enterprise must be classified as either:
• EME: annual total revenue of R10 million or less, or
• QSE: annual total revenue between R10 million and R50 million.
• The enterprise must meet the B-BBEE definitions of Black, Black Woman, and Black Designated Group beneficiaries as per the Amended Codes of Good Practice (Act 53 of 2003 as amended by Act 46 of 2013).
• The affidavit must be valid (not older than 12 months) at the time of submission.

• The sworn affidavit must contain a true reflection of the facts to the best of the deponent's knowledge.
• The deponent must be a Director of the enterprise and duly authorised to act on its behalf.
• Provide the following enterprise details in the affidavit:
• Full name and surname of deponent
• Identity number
• Enterprise name and trading name (if applicable)
• Registration number
• Enterprise physical address
• Type of entity (NPO, PBO, etc.)
• Nature of business
• State the percentage of Black Beneficiaries, Black Woman Beneficiaries, and Black Designated Group Beneficiaries as per the Amended Code Series 100.
• Confirm the annual total revenue for the latest financial year-end to determine EME or QSE status.

• The affidavit must be completed and returned with the RFQ/RFP to qualify for SMME points.
• The enterprise must meet the definition of 'Black People' as per the B-BBEE Act 53 of 2003 (as amended by Act 46 of 2013):
• Africans, Coloureds, and Indians who are citizens of South Africa by birth or descent, or
• Who became citizens by naturalization before 27 April 1994, or on or after 27 April 1994 and would have been entitled to acquire citizenship by naturalization prior to that date.
• The sworn affidavit is valid for 12 months from the date signed by the commissioner.

Bidders must not be listed on the Register for Tender Defaulters or the List of Restricted Suppliers. Accurate disclosure is mandatory; false declarations disqualify the bid.

1.1 Any person (natural or juristic) may make an offer or offers in terms of this invitation to bid. In line with the principles of transparency, accountability, impartiality, and ethics as enshrined in the Constitution of the Republic of South Africa, 1996 (Constitution), and further expressed in the various applicable legislation, it is required for the bidder to make this declaration in respect of the details required hereunder.

Returnable form: SBD 4 (Bidder's Disclosure) — declares whether the bidder or any director, trustee, shareholder, member or partner is employed by an organ of state, has a relationship with anyone employed by the procuring institution, or holds an interest in any other related enterprise. All CSD-registered active companies linked to directors must be disclosed; failure leads to disqualification. The declaration also certifies that the bid was prepared independently and that the bidder was not involved in drafting the specifications.
