Mandatory compliance:

• No contract will be awarded to bidders with outstanding tax issues. A valid, original tax clearance certificate from SARS is required.
• The National Industrial Participation Programme (NIPP) applies to contracts subject to NIP obligations.
• Suppliers must comply with anti-dumping and countervailing duty regulations. The State is not liable for additional costs arising from such duties post-bid.

• Testing: Flat roof waterproofing must be tested by flooding and keeping "ponded" for at least 48 hours to ensure watertightness before further work above it.
• Overloading and propping: Contractors must prevent damage from overloading and submit loading/storage details to the principal agent for approval. Propping of floors may be required for vehicle access or storage on suspended slabs, at the contractor's cost.

Quality standards and control:

• Work must comply with SANS construction standards as referenced in the General Preambles for Trades 2017.
• Contractors must:
• Rectify discrepancies, errors, or omissions in descriptions/quantities as instructed.
• Provide and test samples of materials, goods, finishes, and assemblies as required.
• Open up work for inspection, removal, or re-execution if instructed.
• Remove or substitute non-compliant materials/goods at their own cost.
• Protect the works and make good any physical loss or damage.
• Rectify defects and prepare lists for practical, final, and completion stages.
• Expend budgetary allowances, prime cost amounts, and provisional sums as directed.
• Design responsibility lies with the respective engineers (architectural, civil/structural, mechanical, electrical, wet services, and fire) for their disciplines.
• Quality inspection is the responsibility of the relevant consultants (architect, quantity surveyor, civil/structural engineer, mechanical engineer, electrical engineer, wet services engineer, and fire consultant).

Pricing guidelines:

• Bills of quantities use abbreviated descriptions, which must be read with the applicable measuring system (Standard System of Measuring Building Work, 7th Edition) and relevant preambles/specifications.
• If the intent of any description is unclear, contractors must seek written clarification from the principal agent before tender submission. Failure to do so will assume pricing aligns with international best practice for materials and workmanship.
• All obligations, requirements, and specifications in the General Preambles and supplementary preambles must be included in the contractor's prices.

Pricing and payment terms:

• Prices must include all costs: materials, fabrication, conveyance, delivery, unloading, storing, labour, plant, temporary works, duties, taxes (excluding VAT), overheads, profit, and all obligations under the agreement. VAT must be separately stated on the summary page.
• Unpriced items will be deemed covered by other priced items; no claims for extras will be entertained.
• Prices for construction equipment, temporary works, and services must include supply, maintenance, operating costs, removal, and making good.
• Fluctuations in costs (except VAT rate changes) are for the contractor's account.
• Payment: Prices submitted during the works for contract instructions or claims are not presumed accepted unless confirmed in writing by the principal agent.
• Contractor must bear all costs of preparing claims; this does not prevent adjudicators/arbitrators from determining costs.
• Contractor must review, assess, and adjudicate subcontractor claims and submit recommendations to the principal agent.
• Employer does not provide payment guarantees; contractor must waive lien or right of continuing possession of the works.
• Overtime costs are borne by the contractor unless prior written authorisation is obtained from the principal agent.

Mandatory compliance:

• B-BBEE: Tenders will be evaluated based on their B-BBEE empowerment rating. The employer will monitor the contractor's B-BBEE status throughout the project. Contractors must submit an annual schedule of spend, split by subcontractors and suppliers, including their B-BBEE ratings and proof thereof.
• Health and Safety: Contractors must comply with the Occupational Health and Safety Act, 1993 (Construction Regulations). Requirements include:

• Ensuring all subcontractors comply with the regulations and the health and safety plan.
• Pricing for health and safety compliance costs as part of the tender.
• Confidentiality: Contractors must maintain confidentiality of all project information and ensure subcontractors/suppliers do the same. No information may be published or disclosed without the employer's prior written consent.
• Media: All rights to publish media articles or advertisements related to the project vest with the employer. Contractors and subcontractors may not issue statements or advertisements without prior written consent.
• Advertising: The employer may contract with advertising agencies for on-site advertising. Contractors must not hinder such arrangements and must assist in facilitating them, with positions and types agreed upon with the principal agent.

Health and safety requirements:

• Contractors must comply with the Construction Regulations under the Occupational Health and Safety Act, 1993 (as amended).
• Employer responsibilities:
• Prepare and update a documented health and safety specification for the works.
• Ensure the contractor has provisioned for health and safety costs.
• Appoint a health and safety consultant to:
• Act as the employer's agent under the Construction Regulations.
• Prepare and update the health and safety specification.
• Agree on the health and safety plan with the contractor.
• Conduct regular audits for compliance.
• Stop work if the specification or plan is not adhered to.
• Contractor responsibilities:
• Comply with the employer's health and safety specification.
• Prepare and agree on a health and safety plan with the consultant.
• Cooperate fully with the health and safety consultant.
• Manage subcontractor compliance with regulations and the health and safety plan.
• Price for health and safety compliance in the tender.

Environmental requirements:

• Contractors must ensure all work is carried out to avoid unacceptable dust, noise, vibrations, nuisance, or inconvenience beyond legal or local authority limits.
• Contractors are responsible for controlling all forms of pollution from the site, including noise, artificial light, wind-blown sand, dust, and mud deposits.
• Roads bordering the site must be kept clean and free of dirt or debris caused by the works.
• Delays or stoppages to comply with environmental requirements do not justify adjustments to the construction period or contract value.

Contract terms and conditions:

• The JBCC Principal Building Agreement (Edition 6.2, May 2018) and JBCC General Preliminaries (May 2018) form the basis of the contract, with amendments as specified.
• Contract data and special clauses are incorporated into the bills of quantities and take precedence over standard clauses where applicable.
