Operation and Maintenance contract for bulk wastewater infrastructure in Tswaing Local Municipality (Atamelang, Delareyville, Ottosdal, Sannieshof) for 36 months. • Prices must be quoted in South African Rand, VAT‑inclusive, and every item must be priced – missing prices render the bid non‑responsive.
• Bids are valid for 90 days from the closing date.
• Disqualification triggers: failure to provide any returnable document, non‑compliance with tax status, being a person in the service of the state, or outstanding municipal rates/taxes beyond the limits (> 90 days for contracts < R10 million, > 30 days for contracts ≥ R10 million).

Bidders must be registered with the CIDB with a grading of 8ME or higher. They must be tax compliant (provide SARS PIN or TCS certificate). Companies or persons in the service of the state are disqualified. Bidders must not be listed on the National Treasury's prohibited database or the Register for Tender Defaulters. For contracts over R10 million, bidders must have no undisputed municipal arrears over 30 days. Specific municipal rates and taxes proof for both the company and all directors is mandatory.

Scope of Work:

1. Operate and maintain the four bulk wastewater treatment works (WWTWs) in Tswaing LM – Ottosdal (BNR 3 MLD, Cat C), Delareyville (BNR 4 MLD, Cat C), Sannieshof (Oxidation Ponds 2.5 MLD, Cat E) and Atamelang (Oxidation Ponds 1 MLD, Cat E).

2. Compliance with:

– Water Use Licence conditions.

– Regulation 3630 (Compulsory National Standards for Process Controllers).

– DWS Green‑Drop certification criteria.

– Section 26 of the National Water Act.

3. Deliverables:

– Preventive & corrective maintenance plans (NMMDM approval required).

– Full Operational Plan before work starts (includes operating schedules, KPIs, data‑collection, SOPs, work instructions, check‑lists, operator logs, chemical dosage & inventory).

– 24‑hour monitoring coverage.

– Monthly maintenance & optimisation reports signed by NMMDM senior technician.

– Daily water quality testing; monthly surveillance monitoring by third party.

– Immediate response to breakdowns – plant must be back‑online within 24 hours; penalties of 0.5 % per week (max 10 %) for non‑performance.

– Equipment replacement to be quoted cost + 10 %.

– All spare parts, consumables and chemicals to be recorded and reported weekly.

– SHEQ officer on‑site full‑time; maintain risk register (W2RAP).

– All work to be performed by personnel meeting the skill/experience requirements of Regulation 3630.

1. Submit preventive and corrective maintenance plans for NMMDM approval before implementation.

2. Submit an Operational Plan (operating schedules, KPIs, data collection, SOPs, work instructions, check‑lists, operator logs, chemical inventory) for approval before work starts.

3. Record all instructions from NMMDM senior technicians in a logbook.

4. Perform minor repairs (labour included); replace parts/materials on a cost‑plus 10 % basis.

5. Respond to breakdowns within 24 hours; penalties apply for delays.

6. Conduct regular maintenance per OEM schedules and submit signed reports.

7. Maintain a site‑based SHEQ system and update the plant risk register (W2RAP).

• Service Provider must have staff meeting the skill and experience requirements of Regulation 3630.
• Minimum staffing must satisfy the National Standards for Process Control registration (Appendix A).
• 24‑hour coverage for plant performance monitoring is required.
• Demonstrated experience in operating BNR and oxidation‑pond wastewater treatment plants of similar capacity is expected.

• Operational plan must ensure the plant consistently produces design‑quality effluent.
• Include Operating KPIs, data collection, SOPs, work instructions, check‑lists, operator logs, and chemical inventory.
• Monthly surveillance monitoring is performed by a third party.
• All maintenance work must be signed off by the NMMDM Senior Technician before claim submission.
• Maintain complete records for audit purposes.

• All prices must be quoted in South African Rand, VAT‑inclusive, and every item must be priced.
• Complete the Pricing Schedule (MBD 6.1) and any other price tables attached to the tender.

Preference‑Points Claim Form (Preferential Procurement Regulations 2022) – companies based within NMMDM may claim specific‑goal points. The tenderer must indicate how points are claimed for each preference system. The organ of state may require substantiation of any claim. Fraudulent claims can lead to disqualification, recovery of costs, contract cancellation and a possible 10‑year restriction from state contracts, with criminal prosecution where appropriate.

• Provide proof of registration or a letter of good standing with the Compensation Fund for Occupational Injuries and Diseases Act (COIDA) or a letter from Employment & Labour confirming no employees.
• The Service Provider is solely responsible for any damage to property, life, or equipment arising from non‑performance or negligence.

• All work must comply with the Water Use Licence, Regulation 3630 and DWS Green‑Drop criteria.
• Treated effluent must meet the design standards on the licence; where not specified, it must meet DWS general limit standards.
• The wastewater works are registered and classified under Section 26 of the National Water Act.

• Contract Form (MBD 7.2) must be completed in duplicate and signed in original by both parties.
• The agreement incorporates: invitation to bid, tax‑compliance proof, pricing schedule(s), completed task directive/proposal, preference claim form, declarations of interest and SCM practices, certificate of independent bid determination, special conditions of contract, and the General Conditions of Contract (Annexure B).
• The Service Provider accepts full responsibility for execution of all obligations.
• Payment terms: within 30 days of receipt of a correct invoice.
• All other contractual provisions are those set out in the General Conditions of Contract and any Special Conditions attached to the tender.

• Companies based within NMMDM are eligible for the specific‑goals points.
