Required documents:

• Completed Tender Form, handwritten or typed, originally signed in ink (no correction fluid).

Scope: Supply and delivery of the following items to the City Engineers Department, 150 Mayors Walk, Pietermaritzburg, 3201:

• Demolition Breaker: 2050W power output (1 unit).
• High-Pressure Cleaner: 2.5 kW, 230V, 110 bar (1 unit).

Delivery period: Within 14 working days after award date.

Standards: All goods must comply with relevant South African National Standards (SANS). Confidentiality of information is required.

Penalties: Late delivery incurs R500.00 per calendar day, deducted from payments due or invoiced to the Contractor.

Tenderers must propose a detailed implementation plan including:

• Background of the Contractor.
• Experience and capacity relevant to the project.
• Overall management of the project in terms of personnel.
• Approach and understanding of project requirements.
• Implementation plan to achieve objectives within the required timeframe.
• Phasing of tasks, deliverables, and reports.

Curriculum Vitae (CVs) for all proposed professional personnel must include biographic data, educational qualifications, and experience.

Tenderers must detail their experience applicable to the works in Data Sheet 1 (Statement of Previous Experience). This includes listing the employer’s name, address, contact person, nature of works, and duration. CVs for key personnel must include biographic data, educational qualifications, and experience. Consortia/joint ventures are permitted and must identify the lead organization for contract signing.

All goods delivered must comply with relevant South African National Standards (SANS). The service provider must ensure the confidentiality of all information distributed. Goods must be insured as per the annual contract supply terms.

Submit pricing in the official Pricing Schedule for the following items:

• Demolition Breaker (1 unit).
• High-Pressure Cleaner (1 unit).

Pricing must include:

• Total cost excluding VAT.
• VAT at 15%.
• Total cost including VAT.

All prices must be VAT-inclusive, regardless of the bidder’s VAT status. The pricing schedule must be signed by the Tenderer’s authorized representative.

Pricing: Submit pricing in the official Pricing Schedule (MBD 3.1/3.2/3.3). All prices must include VAT, regardless of VAT status.

Payment terms: Payment within 30 days of receipt of a certificate of payment issued by the Engineer, via cheque. No cash payments. For invoices exceeding R3,000.00 (excl. VAT), quote the Council’s VAT Registration No. (460 010 783 5).

Bank account: Must be in the legal name of the Tenderer as per the Tax Clearance Certificate.

Price firmness: Prices must remain firm for the contract period (no escalation).

Insurance: Goods must be insured as per annual contract supply terms.

Mandatory compliance:

• Registration on the Central Supplier Database (CSD). Provide CSD Supplier Number and Unique Registration Reference Number for verification.
• Valid Tax Clearance Certificate and Tax Compliance Status Verification PIN (or CSD verification if TCS is unavailable).
• CIPC Registration Certificate (Annexure F).
• CIDB Registration Number (if applicable for construction-related works).
• ECB registration (for electrical works) or IOPSA registration (for plumbing works), with certified proof.

Additional requirements:

• Complete Declaration of Interest (MBD 4).
• Declaration of Municipal Fees (proof of payment or payment arrangements).
• Certificate of Independent Bid Determination (MBD 9).
• Declaration of Past Supply Chain Management Practices (MBD 8).
• No bids accepted from persons in the service of the state or listed on the National Treasury’s Database of Restricted Suppliers or Register for Tender Defaulters.

B-BBEE: Preference points for 60%+ Black ownership (10 points) or 60%+ female ownership (10 points). Verified via CSD report.

The contract must be carried out in compliance with the Occupational Health and Safety (OHS) Act and any other applicable legislation or bylaws. The onus rests with the Tenderer to ensure the safekeeping of all property belonging to the Tenderer while working on Council sites, as no claims for loss or damages will be entertained.

Contract terms are governed by the Msunduzi Municipality’s Standard Conditions of Contract and the General Conditions of Contract (GCC 2015) for Supply, Delivery, and/or Installation of Plant & Equipment. Key terms include:

• Prices must include all costs (materials, labor, freight, insurance, etc.) and are VAT-inclusive.
• Prices remain firm for the contract period with no escalation.
• Late delivery penalties: R500.00 per calendar day, deducted from payments due.
• Contract may be terminated for non-performance, with the Contractor liable for price differences if the Municipality procures elsewhere.
• Insurance for goods must be maintained for the contract duration.
• Payment is made within 30 days of receipt of a certificate of payment, via cheque.
• The Council reserves the right to reject any bid and is not bound to accept the lowest offer.

Evaluation uses the 80/20 Preference Point System under the Preferential Procurement Regulations 2022 and Public Procurement Act. Price accounts for 80 points, with the lowest price scoring highest. Specific Goals account for 20 points: 10 points for 60%+ South African Black ownership/management control (Black Owned Enterprise) and 10 points for 60%+ female ownership/management control. Verification is via a full CSD report. The Municipality reserves the right to accept any quotation and may make partial awards.
