• The contract is a NEC3 Professional Services Contract (PSC) with Main Option A: Lump Sum Contract with Activity Schedule.
• Evaluation will consider the offered fee for each project stage (Stage 3: 30%, Stage 4: 15%, Stage 5: 25%, Stage 6: 5% of basic fee).
• A Tender Scorecard Matrix will be used during evaluation (as mentioned in project stage deliverables).
• Preference points may apply as per B-BBEE requirements.
• Bidders must meet minimum eligibility: registered professional civil engineering consultant, relevant experience, and compliance with B-BBEE and tax requirements.
• The evaluation will also consider the proposed key personnel qualifications and experience.
• The Employer may terminate the contract for reasons not stated in the contract by notifying the Consultant (X11).

• Provision of professional civil engineering services for stages 3 to 6 for airside and landside service roads and Bravo taxiway rehabilitation at King Phalo Airport.
• Scope includes:
• Airside: Rehabilitation of taxiway Bravo, construction of road bell mouth on both sides of Golf taxiway, paving service road along perimeter fence (at least 90m from taxiway Foxtrot), rehabilitation of roadway to fuel farm including access from apron.
• Landside: Upgrade entrance roadway to two lanes, pothole repairs on parking areas, two lanes at drop-off area, install canopies to protect parking equipment.
• Specific maintenance/rehabilitation actions:
• Bravo taxiway: limited mill and infill, crack seal, rejuvenator spray, restriping.
• Golf taxiway: crack seal, rejuvenator spray, restriping, new bell mouth construction (remove gravel surfacing to 150mm, compact subbase to 98% Mod AASHTO, new 150mm base using recycled asphalt, compact to 100% Mod AASHTO, 40mm asphalt surfacing).
• Fuel farm to apron: crack filling, rejuvenator spray, reconstruction of limited areas, add fillets to improve turning circle.
• Airside roads: crack filling, rejuvenator spray, limited mill and infill, restriping.
• Gravel road link: shape and compact to 98% Mod AASHTO, add 150mm recycled asphalt base, compact to 100% Mod AASHTO, optional emulsion spray.
• Landside access ring: mill out 130mm deep (adjust based on borehole), apply tack coat, composite geogrid, inlay 80mm BTB, 50mm asphalt surface, restriping.
• Work may require night work on landside access ring to maintain terminal access.
• Quality requirements: quality policy statement and quality plan within 2 weeks of contract date; defects date 52 weeks after completion.

Consultant must provide key persons with qualifications and experience. The contract data requires details of key persons (name, job, responsibilities, qualifications, experience). The completion date for services is as required by ACSA. Risk register includes availability of as-built information, access to site, progress vs programme, cash flow management. Staff rates as stated in Pricing Data. Employer provides access to as-built information, relevant personnel, and airside/landside access after permit vetting.

Quality policy statement and quality plan must be provided within 2 weeks of Contract Date. Defects date is 52 weeks after Completion. Project site monitoring includes constant review of work procedures and materials for compliance to plans. Landside access ring: mill out 130mm deep, apply tack coat, composite geogrid, inlay 80mm BTB, 50mm asphalt surface, restriping.

PROFESSIONAL SERVICES (Act No. 46/2000) as per Government Gazette, 4 December 2015. Descriptions % of basic fee Offered Fee (Excl. VAT) for each stage: PHASE 1 Stage 3 - Detail Design (Finalization) 30%, Stage 4 - Documentation and Procurement 15%, Stage 5 – Construction 25%, Stage 6 – Close-Out 5%. SUB TOTAL (Excluding VAT), ADD 15% VAT, TOTAL (Including VAT). PROFESSIONAL SERVICE RATE OFFERED FEE (excl VAT): 1. Land Surveyor/Topographical Studies, 2. Construction Health and Safety Agent (Professional registered with SACPCMP as Safety Agent), 3. Geotechnical Studies. SUB-TOTAL (Excluding VAT), ADD 15% VAT, TOTAL (Including VAT).

• Additional services (e.g., land surveyor, construction health and safety agent, geotechnical studies) to be priced separately.
• Disbursements: only those listed in the pricing schedule will be reimbursed.
• Payment: assessment interval ends at 12h00 on 25th of each month; payment within 4 weeks of receipt of tax invoice.
• Currency: South African Rand (ZAR).
• Insurance requirements: Professional Indemnity Insurance cover of R5 million; Public Liability Insurance cover of R10 million; COID coverage as prescribed.
• Delay damages: 2% per week, max 10% of contract value.
• Limitation of liability: indirect/consequential loss nil; total direct liability not exceeding 100% of contract value.

• Valid Tax Clearance Certificate required.
• B-BBEE Certificate required annually; failure to present compliant certificate is a material breach and may lead to cancellation.
• For sub-consultant procurement: 3-quote system in line with National Treasury regulations, ACSA approval required, track and report amounts paid and BBBEE level.
• Must be in good standing with Compensation Fund or Licensed Insurer (COID).
• Professional registration: e.g., Pr Eng for key personnel; Construction Health and Safety Agent must be registered with SACPCMP.
• Compliance with OHS Act and Construction Regulations 2014, including Section 37(2) agreement.
• Must provide proof of insurance as specified.

The Consultant shall be expected to annually present a compliant BEE Certificate. Failure to adhere to these requirements shall be considered a material breach of the conditions of this Contract, the sanction for which may be a cancellation of this Contract.

THE UNDERTAKING: The Mandatary undertakes to comply with: INSURANCE: 1. All employees covered under COID Act, letter required confirming good standing with Compensation Fund or Licensed Insurer. 2. Possess Public Liability Insurance Cover as required by Subcontract Agreement and any other insurance for losses. COMPLIANCE WITH OHS ACT: 1. Work under close supervision of trained employees. 2. Assigned responsibility under Section 16(1), copy of written assignment to Client. 3. Familiarise with OHS Act and ensure compliance. 4. Baseline risk assessment performed by competent person before work. 5. Appoint competent persons trained on OHS aspects. 6. Strict discipline regarding OHS. 7. PPE issued and worn at all times. 8. Written safe working practices available and enforced. 9. No unsafe equipment/machinery used. 10. Incidents/accidents reported to Provincial Director and Client. 11. No use of Client's machinery without prior written approval. 12. Permits obtained before work requiring permits. 13. No alcohol or intoxicating substances allowed. 14. Full participation with Client's employees on OHS inquiries. FURTHER UNDERTAKING: 1. Only authorised 16.2 appointee can sign agreement, with written designation from CEO. 2. Report anything unhealthy/unsafe to Client's management in writing. 3. Not endanger health & safety of Client's employees. 4. No work may commence until procedure completed, signed and received by Client. 5. Non-compliance may lead to immediate cancellation of contract.

With reference to clause 24.2 of NEC3 PSC, Procurement of any sub-consultant or specialist services shall be on a 3-quote system, in line with National Treasury regulations, and shall be submitted for ACSA approval before services are rendered. The amounts paid and BBBEE level shall be tracked and reported to ACSA for the duration of the contract. Documentation shall include the services not being approved for payment. DISBURSEMENTS (Allowance for reimbursable expenses) Amount not set out below shall not be paid under Disbursements.

The project stages are: 3 Detailed Design Verification, 4 Documentation and Procurement, 5 Contract Administration and Inspection, 6 Close-out. Key deliverables at end of each stage: Stage 3 - Design Development Report, ACSA Stage 4-6 Report for approval; Stage 4 - Completed Documentation and Procurement, Bill of Quantities, Scope of Work, Activity Schedule, Quality of Works management system, Tender Scorecard Matrix, Financial forecast, Project Program; Stage 5 - Construction works capable of being used, Project Site Monitoring; Stage 6 - As Built, operations and maintenance manuals, final approval certificates.
