Evaluation follows a 4-stage process: Stage 1: Administrative compliance (SBD1, SBD3.1, SBD4, SBD6.1, latest CSD report). Stage 2: Non-negotiable requirements (valid SAHPRA Certificate, willingness to supply samples at own cost if requested). Failure in either stage results in disqualification. Stage 3: Price (80 points) and Specific Goals (20 points) using the PPPFA 80/20 system. Stage 4: Sample evaluation (only for recommended bidders if necessary). Specific Goals points are allocated as follows: HDI Ownership (4), Women Ownership (4), Youth Ownership (2), Disability Ownership (2), Military Veterans Ownership (2), Locality Ownership (6). Submit proof (e.g., CIPC certificates, municipal accounts) for claimed points.

Supply and deliver non-contracted neurosurgical implants on a rate-based basis to Frere Hospital. Items include: 1.5mm plates (various sizes and hole configurations), 1.5mm t-plates, y-plates, double y-plates, orbital plates, square plates, rectangle plates, shunt plates, burr hole plates, neuro gap plates, sub-temporal plates, panels, contourable mesh, ultra pre-contoured mesh, self-drilling bone screws (1.5mm x 3.5mm to 1.8mm x 8mm), aneurysm clips (TEMP/PERM, various sizes), cranioplasty substitutes, and Crainiofix titanium clamps (11mm–20mm). Suppliers must declare capacity and capability to supply and deliver.

Goods must conform to standards specified in bidding documents. Pre-bidding testing costs are the bidder’s responsibility. Premises must be open for inspection by the Department at reasonable hours if required. Inspection costs: Purchaser covers costs if goods comply; supplier covers costs if goods do not comply. Non-compliant goods may be rejected and must be replaced at supplier’s expense. Packing must protect goods from damage, rough handling, extreme temperatures, salt, and precipitation. Packing, marking, and documentation must comply with contract requirements. Supplier must indemnify purchaser against third-party claims of patent/trademark infringement.

Complete the pricing schedule (SBD3.1) with VAT-inclusive unit prices for each item. Specify whether prices are per individual item or per packaged set (e.g., per box). Validity period: 90 days. Include all listed items (e.g., plates, screws, aneurysm clips, cranioplasty substitutes). Company name and representative details must be provided.

Tax Compliance: Submit a valid Tax Compliance Status (TCS) PIN (via SARS e-Filing) or CSD number if registered on the Central Supplier Database. Foreign suppliers not resident in RSA or without a branch/permanent establishment/source of income/tax liability in RSA are exempt from TCS PIN requirements. Consortia/joint ventures/sub-contractors must each submit separate TCS certificates/PINs/CSD numbers. No bids accepted from persons in the service of the state or companies with directors/members in state service. SAHPRA Certificate: Valid certificate required, indicating supplier type (sole supplier, manufacturer, distributor, agent, etc.). B-BBEE: Submit proof of ownership (CIPC certificate) for claimed points (HDI, Women, Youth, Disability, Military Veterans, Locality). Updated CSD report mandatory.

Contract terms: Governed by General Conditions of Contract (GCC) and Special Conditions of Contract (SCC), with SCC prevailing in conflicts. Key clauses: Payment within 30 days of invoice submission (Rand unless specified otherwise). Prices fixed as quoted unless adjusted per SCC. Contract amendments require written agreement. Supplier cannot assign obligations without purchaser’s consent. Subcontracts must be notified in writing. Delays incur penalties (prime interest rate per day) or termination. Force majeure exempts supplier from liability if notified promptly. Termination for default or insolvency allowed. Disputes resolved via mediation or South African courts. Supplier liable for taxes/duties (local or foreign). Anti-dumping/countervailing duties are supplier’s responsibility. Warranty: 12 months post-delivery or 18 months post-shipment. Supplier must repair/replace defects at no cost. Insurance required for goods during transit/storage. Packing must prevent damage during transit. Performance security (bank guarantee or cashier’s cheque) due within 30 days of award.
