Endorse the envelope with the exact “CONTRACT No.” and “CONTRACT DESCRIPTION”.
Deliver the sealed envelope to the Tender Box at Central Stores, 2 Abattoir Road (off Kershaw Road), Pietermaritzburg 3201 (coordinates ‑29.6126297, 30.3610014) no later than 12:00 on 08 July 2026. No extensions will be granted.
Only tenders placed in the Tender Box will be accepted; courier or other delivery methods are permitted but the supplier bears all risk of loss or delay.
Tender validity: 4 calendar months from the closing date.

Stage 1 – Functionality (max 75 pts)

Previous railway track projects (up to 5 projects) – 10 pts each, max 50 pts.
Track Master/Plate Layer experience – 15 pts (≥10 yrs = 15 pts, 5‑10 yrs = 10 pts, <5 yrs = 0).
Health & Safety Officer – 10 pts (SACPCMP registration required; ≥5 yrs = 10 pts, 3‑5 yrs = 5 pts, <3 yrs = 0).

Minimum functionality threshold:

CIDB Grading 1‑2 – at least 25 pts.
CIDB Grading 3+ – at least 35 pts.

Stage 2 – Preference Point System (80 % price, 20 % specific goals)

Price score – 80 pts (lower price = higher points).
Specific Goals – 20 pts total:

Black‑owned enterprise (≥51 % SA black ownership/management) – 10 pts.
Company based in KwaZulu‑Natal – 10 pts.
Proof of specific goals must be submitted (B‑BBEE certificate via CSD, and KZN locality proof such as CIPC registration or recent utility/lease document).
Preference points are awarded only when supporting documentation is provided; otherwise the 20 pts are forfeited.
Overall adjudication follows the two‑stage system; the Council is not bound to accept the lowest or any tender.

Scope: Repair and maintenance of railway sidings for Msunduzi Municipality on an “as‑and‑when” basis (36‑month contract, 12‑month maintenance per completed work).
Site: Willowton Industrial Area, Pietermaritzburg – approx. 3 km of track from the Greytown Transnet line after Midlands Liberty Mall.
Key deliverables: site establishment, lift/pack box slacks, slew track, sleeper replacement, turnout maintenance, rail welding (joints, clips), ballast screening/replacement, supply & fitting of rail components (12 m × 48 kg rails, fishplates, etc.), vegetation control, drainage maintenance, stop blocks, miscellaneous track work.
Personnel: qualified Track Master/Plate Layer on site at all times; two qualified Railway Flagmen; Railway Safety Officer (SACPCMP‑registered) to manage SMS per Railway Safety Regulator (RSR) standards; Railway Occurrence Investigator with RSR‑approved qualifications.
Standards: Spoornet E 10‑1996, Spoornet Platelayer’s Manual 2000, SABS 1200NB, SANS 3000; all materials must be SANS‑approved and RSR‑compliant.
Testing & samples: Engineer may direct tests at manufacture, fabrication or delivery sites; contractor must provide assistance, instruments, labour and materials for testing; samples may be required at contractor’s cost and approved samples become standards.
Coordination: notify Transnet Freight Rail for line closures; submit work programmes to TFR and Municipality; response time for works orders is 48 hours (including emergencies).

CIDB: Minimum grading 1 CE (active) – must be shown on the Tender Form.
Track Master/Plate Layer: Must have railway track experience; provide certified trade‑test copy (Commissioner of Oaths).
Health & Safety Officer: SACPCMP registration required; submit CV showing railway safety management experience.
Railway Occurrence Investigator: RSR‑approved qualifications required.
Railway Flagmen: Two qualified flagmen; submit qualifications.
All key personnel certificates/CVs must be attached to the tender; any replacements must be submitted immediately with proof of employment.

The Council reserves the right to purchase any sample submitted at the tender price. Samples not purchased will be recoverable from the contractor at cost.

If price control applies, the contractor must clearly identify controlled items; otherwise no payment will be made for amounts exceeding the controlled price. If price control is withdrawn, the contract price cannot exceed the last controlled price.

Pricing format: Schedule of Rates (no quantities). Rates must be all‑inclusive (labour, plant, transport, materials, compliance, profit) and VAT‑inclusive.
VAT: Quote Council VAT No. 4600107835 on all invoices for works > R3 000 (excl. VAT).
Payment terms: Within 30 days of receipt of Engineer’s certificate of payment, by cheque; contractor must have a bank account in the legal name shown on the Tax Clearance Certificate.
Escalation: Rates fixed for the first year; thereafter CPI (base index = June 2026) applied using formula E = V × (Ie‑1)/Io unless an alternative formula is expressly stated.
Forward cover: Forward foreign‑exchange cover for imported goods must be included in the price.
Rate adjustments: Pro‑rata adjustments for freight, insurance or railage rate changes must be supported by original proof of payment.
Penalties: 2 % of the Works Order value per day for late delivery.
Guarantees: Public liability insurance of at least R5 million required before award; other bonds/guarantees not expressly required in the tender document.

Legislation compliance: OHS Act, COID Act, Labour Relations Act, BCE Act, Income Tax Act, VAT Act, Engineering Profession Act, Railway Safety Regulator standards, SANS standards, and any other applicable Acts.
Municipal fees: Declaration that municipal fees are in order must be signed.
Joint ventures/consortia: All parties must submit Tax PINs, CSD reports, declarations of interest, past SCM practices, independent bid determination certificates, and a signed undertaking.
Prohibited awardees: No award to persons in the service of the State, their directors/shareholders, or advisors/consultants of the Municipality.

Preference points are awarded only when Annexure B is completed in full and all B‑BBEE documentation is provided, in line with the Preferential Procurement Regulations 2022.

OHS Act coverage includes erection, maintenance, alteration, renovation, repair, demolition or dismantling of railway infrastructure, installation or dismantling of machinery, and related works. The contractor must keep incident records, investigate incidents, present records to a Safety Committee, and furnish returns to the divisional inspector. A full‑time site supervisor must be designated.

General compliance: Contractors must be aware of and comply with all current legislation (OHS Act, COID Act, Labour Relations Act, etc.) for the entire contract duration.

Any alterations to the contract conditions, specifications, quantities or drawings must be listed in Annexure A. Failure to do so will render the tender unqualified.

Joint ventures/consortia must submit Tax Compliance Status Verification PINs, CSD reports, declarations of interest, past SCM practices, independent bid determination certificates, and a signed undertaking from all parties.

The tender will be evaluated using a Two‑Stage system: Stage 1 – Functionality (as detailed above); Stage 2 – 80/20 Preference Point System (price 80 %, specific goals 20 %). The evaluation follows the Msunduzi Municipality’s Supply Chain Management Policy and the Preferential Procurement Regulations 2022.
