Mandatory: Sign and submit the Transnet Non-Disclosure Agreement (NDA) as part of the bid. Compliance with South African privacy laws (Section 14 of the Bill of Rights) is required for handling all bid-related information. Implement and maintain technical and organizational measures to prevent unauthorized or unlawful processing of bid data, as well as accidental loss, destruction, or damage to such data.

Pricing and payment:

• Prices are as agreed in the Schedule of Requirements or Work Orders, subject to mutual amendments.
• Invoices must comply with Section 20 of the VAT Act and be submitted as Tax Invoices.
• Payment terms and adjustments (if applicable) are governed by clauses 18–20 of the Master Agreement.
• Penalties may apply for non-compliance with Service Level Agreements (SLA) or local content obligations, as detailed in clauses 17.1 and 17.2.
• Transnet reserves the right to pay subcontractors directly under specific conditions (clause 12).
• Supplier remains liable for all contractual obligations, including subcontractor performance.

Mandatory compliance:

• Valid B-BBEE verification certificate: submit annual status updates to Transnet by March each year. Notify Transnet immediately of any downgrade, restructuring, or change in control affecting B-BBEE status.
• Provide underlying B-BBEE data upon written request within 30 calendar days.
• Full compliance with South African labour legislation, Occupational Health and Safety Act (OHSA), tax laws (VAT, PAYE, Income Tax), and environmental regulations.
• Maintain valid tax clearance and CIPC registration for the entire contract duration.
• Local content: If applicable, comply with Annexures A and C of the RFP and Preferential Procurement Regulations, 2011. Monitor, audit, and report local content monthly. Failure to meet obligations may result in contract termination.
• National Industrial Participation Programme (NIPP): If applicable, enter into and comply with a NIPP obligation agreement with the DTIC. Non-compliance may incur penalties per DTIC guidelines.
• CIDB registration: Required if subcontracting construction-related works.
• All personnel must hold valid work permits for South Africa.
• Adhere to POPIA (Protection of Personal Information Act) and confidentiality clauses.
• Maintain required licences, permits, and insurance certificates (e.g., clause 34 for insurances).
• Sign and comply with Transnet’s Supplier Integrity Pact to prevent fraud, corruption, and unethical conduct.

Bidders must: - Read the Integrity Pact document in full. - Certify in the RFX Declaration Form that they have acquainted themselves with and agree to its content. - Note that the Integrity Pact will automatically form part of the final contract if awarded.

Bidders must: - Sign and comply with the Integrity Pact to be registered as a Transnet vendor. - Uphold the ten principles of the United Nations Global Compact (UNGC) in Human Rights, Labour, Anti-Corruption, and Environment. - Disclose any conflicts of interest (family, business, or social relationships with Transnet employees or Board members) in the RFX Declaration Form or notify Transnet immediately in writing. - Not engage in corrupt practices, collusion, or anti-competitive behavior. - Not offer, promise, or give bribes, gifts, or other benefits to Transnet employees or related parties. - Ensure no previous transgressions (e.g., corruption, fraud, theft) in the last 5 years with any public or private sector entity. - Not subcontract to restricted suppliers or entities on National Treasury’s Register of Tender Defaulters or List of Restricted Suppliers. - Furnish a copy of their code of conduct if requested by Transnet. - Avoid litigation in bad faith against Transnet.

Technical evaluation threshold: 70 points. Scoring breakdown:

• Methodology/Testing Procedure (30 points): Comprehensive, detailed methodology referencing applicable standards (ASTM E446, ISO 5579, ISO 17635, ASME Section V, Article 2). Must include exposure parameters, film/digital imaging, sensitivity, defect classification/acceptance criteria, and quality control measures. Must be approved by a qualified Level III Radiographer (verifiable at submission). Partial credit (15 points) for good understanding but lacking standards/quality controls. Zero if no methodology or non-compliant.
• Personnel Qualification/Certification (30 points): Valid, current Level II and Level III radiography certificates from accredited bodies (e.g., SANAS, ISO 9712, ASNT). Partial credit (15 points) for Level II only. Zero if no certificates.
• Delivery and Turnaround Time (20 points): Clear plan defining lead times, workflow stages (receipt, inspection, exposure, processing, reporting), and alignment with production schedules. Zero if no plan.
• Quality Management System (20 points): Valid ISO 9001:2015 certificate (20 points) or comprehensive quality manual aligned to ISO 9001:2015 (10 points). Zero if neither.

Scope: Provision of radiography testing for steel castings at Koedoespoort foundry for 12 months, on an as-and-when-required basis. Requirements:

• Submit a radiographic testing methodology/procedure approved by a qualified Level III Radiographer.
• Methodology must comply with ASTM E446, ISO 5579, ISO 17635, or ASME Section V, Article 2.
• Include exposure parameters, film/digital imaging, sensitivity, defect classification, and acceptance criteria.
• Integrate quality control measures and traceability throughout the testing process.

• Submit the bid no later than the closing date and time stated in the Bid Documents; late bids will be rejected.\n Complete all Bid Documents in full, legibly, using non-erasable ink.\n Use only the official Transnet bid forms; do not substitute your own formats or terms. Non-compliance may lead to rejection.\n If space on a form is insufficient, provide additional information on company letterhead, cross-referenced in the RFX.\n Place the completed bid in a sealed envelope, clearly marking the Bid number and subject on the front and your return address on the reverse.\n Include all returnable schedules/documents listed in the RFX; missing mandatory returnables will result in disqualification.\n A non-refundable bid fee may apply, but documents are also available free on the National Treasury eTender portal.\n Bids must be signed, and any price alterations must be initialed by the signatory.\n Unauthorised communication about bids after the closing date may disqualify your bid.

• The contract will be governed by Transnet’s General Bid Conditions and any special conditions in the RFX.\n Services must comply with Transnet’s drawings, specifications, and other supplied documents.\n All goods/services must be new (unused, not second-hand or reconditioned) unless otherwise stated.\n Delivery must be on a Delivered Duty Paid (DDP) basis per the latest ICC Incoterms, to the specified destination.\n Lead times must include all non-working days, holidays, and plant downtime.\n Compulsory site visits or briefing sessions may apply; non-attendance will disqualify the bid.\n Progress reports may be required during the contract.\n In emergencies, the successful supplier has the first right of refusal for short-notice supply; if unable, Transnet may source elsewhere.\n Samples, if requested, must be clearly marked with the bidder’s name, address, bid number, and item number, and submitted by the closing date.

• All prices must be quoted in South African Rand (ZAR) unless the RFX explicitly permits otherwise.\n Prices quoted as “subject to confirmation” will be rejected.\n For local supplies, prices must be inclusive of VAT, shown separately on the tax invoice at the standard rate.\n For foreign services, VAT applies only to the local portion (e.g., commission) and must be shown separately.\n A Deed of Suretyship (security) may be required from the successful bidder, using Transnet’s form, and must be returned within 30 calendar days of the acceptance letter. Failure to comply may result in contract cancellation.\n Payment terms are defined in the Terms and Conditions of Contract; alternative payment or financing proposals may be submitted and will be evaluated.\n Conditional discounts are allowed but calculated from the date Transnet receives correct tax invoices; incorrect invoices will delay the discount period.\n Guarantees may be required for advance payments.\n For foreign currency payments, South African Reserve Bank approval is required. Transnet prefers Rand-based agreements and may request forward exchange cover to mitigate currency risk.

• Bidders must not appear on the National Treasury’s Register of Tender Defaulters or List of Restricted Suppliers.\n If the bidder is a company, full names of directors must be provided; for a close corporation, full names of members; for a partnership or individual, full names of partners or the individual.\n Foreign bidders must provide written proof of authorisation for their South African representative or agent. • Specific Goals (20 pts) – preference points awarded per the specific‑goals claim form.\n
