Project Scope: Renovation of the Environmental Office (B4/144) located at the Bayhead Precinct in the Port of Durban. The project duration is three months. Work involves construction and renovation activities, requiring strict adherence to health, safety, and environmental standards as outlined in the provided specifications.

Evaluation will be based on the following criteria:

• Legal Status: Bidder must be a legally registered entity in South Africa with valid tax clearance and compliance certificates.
• Experience: Proven track record in similar renovation projects, particularly in industrial or port environments, with a focus on health and safety compliance.
• Financial Capacity: Submission of financial statements or proof of financial capability to execute the project within the specified budget and timeline.
• Technical Capacity: Demonstrated technical expertise and resources (equipment, personnel) to carry out renovation works safely and efficiently.
• SHE Certifications: Valid certifications in health and safety management (e.g., ISO 45001, OHSAS 18001) and compliance with Transnet’s SHE standards.
• Insurance: Adequate insurance coverage, including public liability, employer’s liability, and professional indemnity insurance.
• B-BBEE Compliance: Compliance with Broad-Based Black Economic Empowerment (B-BBEE) requirements as per South African legislation.
• Local Content: Preference may be given to bidders with local content (e.g., use of local labor, materials, or sub-contractors) in line with Transnet’s procurement policies.

Scope: Renovation of the Environmental Office (B4/144) at Bayhead Precinct, Port of Durban, over a period of three months.

Key Requirements:

• Contractor must prepare, implement, and maintain a project-specific SHE (Safety, Health, and Environment) Management Plan based on provided specifications and applicable legislation. The plan must cover all activities from mobilisation to decommissioning.
• The SHE Management Plan must include:
• Health and Safety Policy (OHS Act Section 7).
• Hazard Identification and Risk Assessment procedures (Baseline and Task-Based).
• Legal compliance arrangements and measures to ensure accessibility of this information.
• Health and safety objectives with action plans for continual improvement.
• Resource allocation, accountabilities, and responsibilities (e.g., Construction Manager, Health and Safety Officers, Supervisors, Health and Safety Representatives, First Aiders).
• Competence, training, and awareness systems.
• Communication and consultation processes (e.g., Toolbox Talks, Daily Safe Task Instructions, meetings, notice boards).
• Documentation and document control for health and safety management.
• Operational control procedures, including Safe Work Procedures for critical risks (e.g., working at heights, confined spaces, mobile equipment, lifting operations, hazardous substances).
• Emergency Preparedness and Response procedures (firefighting, first aid, incident reporting).
• Management of Change process to assess health and safety risks before implementing changes.
• Sub-contractor alignment procedures for health and safety compliance.
• Measuring and monitoring plans, including employee exposure to hazardous substances.
• Incident reporting and investigation procedures.
• Non-conformance and action management procedures.
• Performance assessment and auditing procedures (monthly internal audits, daily inspections).
• Management review process to assess effectiveness of health and safety efforts.
• The SHE Management Plan must be submitted electronically and in hard copy to the project management representative for review and acceptance before work commences. Work may not start until the plan is accepted.
• Contractor must conduct detailed Baseline and Task-Based Risk Assessments for all work, involving site management, supervisors, technical experts, and workforce personnel. Assessments must be reviewed and approved by the Client’s Project Health and Safety Manager and Contract Manager prior to work commencement.
• Contractor must ensure all sub-contractors comply with legal and project-specific health and safety requirements.
• Specific hazards and controls must be addressed for: working at heights, confined spaces, mobile equipment, light vehicles, lifting operations, hazardous chemical substances, excavations, cranes, scaffolding, electrical safety, and asbestos management (Annexure C).
• Operational control measures include: site access rules, vehicle and equipment safety, PPE requirements, fire protection, waste management, and occupational hygiene standards.
• Contractor must appoint qualified personnel: Construction Manager, Health and Safety Officers (registered with SACPCMP), Supervisors, Health and Safety Representatives, and First Aiders. Appointments must be in writing and documented.
• Health and Safety Officers must have at least 5 years’ experience, relevant qualifications (e.g., SAMTRAC, NEBOSH), and be equipped with necessary tools (computer, mobile phone, vehicle if required).
• Supervisors must ensure daily safety task instructions, toolbox talks, and compliance with all safety procedures.
• All employees must receive health and safety induction training and be competent for their roles.
• Contractor must maintain a Health and Safety File on site, including all relevant documentation, and ensure it is available for inspection.
• Compliance with Construction Regulations 2014 and OHS Act is mandatory.

Methodology and Work Procedures:

• Develop and implement Work Method Statements for all tasks, describing how work will be performed safely and sequentially.
• Ensure all work is supervised by qualified and competent supervisors, with daily safety task instructions and toolbox talks.
• Conduct Planned Task Observations to monitor compliance with safe work procedures.
• Review and update Task-Based Risk Assessments and Work Method Statements annually or when changes occur.

Personnel Requirements:

• Appoint a Construction Manager responsible for the safe and successful completion of all work (Construction Regulations 2014, Regulation 8(1)).
• Appoint at least two full-time Health and Safety Officers (depending on project scope and risk), registered with SACPCMP. Officers must:
• Have at least 5 years’ experience in construction health and safety.
• Hold qualifications such as SAMTRAC or NEBOSH.
• Be computer literate, fluent in English, and equipped with necessary tools (computer, mobile phone, vehicle if required).
• Appoint qualified Supervisors with experience in the type of work being performed. Supervisors must:
• Ensure compliance with all applicable legislation, standards, and procedures.
• Conduct daily safety task instructions, toolbox talks, and workplace inspections.
• Maintain discipline and enforce safety rules.
• Appoint Health and Safety Representatives (minimum ratio of 1 per 50 employees) and ensure they receive accredited training.
• Appoint First Aiders (minimum ratio of 1 per 50 employees) with valid training certificates.
• All appointments must be documented in writing, with signed letters retained for proof of compliance.

Quality and Performance Management Requirements:

• Establish and maintain a system for Performance Assessment and Auditing, including:
• Health and safety performance reporting.
• Monthly internal audits to assess compliance with project health and safety requirements.
• Daily site health and safety inspections.
• Implement Non-conformance and Action Management procedures to address and track corrective actions from audits, inspections, and incident investigations.
• Conduct Management Reviews annually to assess the effectiveness of health and safety management efforts.
• Set and monitor project-specific health and safety objectives, aligned with Construction Regulations 2014, Regulation 7. Objectives must be specific, measurable, and reviewed quarterly.
• Ensure continual improvement in health and safety performance using leading and lagging indicators (e.g., inspection findings, incident rates).

Legal and Regulatory Compliance:

• Compliance with all applicable legislation, including the Occupational Health and Safety Act (OHS Act) and Construction Regulations 2014.
• All employees and sub-contractors must have valid medical certificates of fitness for construction work.
• Registration and good standing with the Compensation Fund or a licensed compensation insurer under the Compensation for Occupational Injuries and Diseases Act, 1993.

Appointments and Registrations:

• Contractor must appoint and provide written proof of appointment for the following roles:
• Construction Manager (CR 8(1)).
• Assistant Construction Manager (CR 8(2)).
• Construction Supervisor (CR 8(7)).
• Assistant Supervisor of Construction Work (CR 8(8)).
• Construction Health and Safety Officer (CR 8(5)) – must be registered with SACPCMP.
• Health and Safety Representatives (OHS Act Sections 17-18) – at least one per 50 employees.
• First Aiders (GSR 3(4)) – at least one per 50 employees, trained through an accredited institution.
• Incident Investigator (GAR 9(2)).
• Construction Risk Assessor (CR 9(1)).
• Fall Protection Plan Inspector (CR 10(1)(a), (b), (d)).
• Scaffolding Supervisor (CR 14(2)).
• Inspector of Lifting Machinery (DMR 17(2), 18).
• Material Hoist Inspector (CR 17(8)).
• Supervisor of Machinery (GMR 2(1)).
• Assistant Supervisor of Machinery (GMR 2(7)).
• All appointments must be documented with signed letters and submitted as part of the Contractor Compliance Plan.

Documentation and Reporting:

• Maintain a register of all legal and other requirements applicable to the work.
• Ensure all visitors to the site undergo health and safety induction and are provided with necessary PPE.
• Keep records of health and safety induction training and make them available for inspection.
• Report all incidents to the provincial director as required by Section 24 of the OHS Act and provide measures to ensure a safe construction site.

Asbestos Management:

• Compliance with Annexure C: Asbestos Management Plan, including specific controls for asbestos and non-asbestos fibrous silicates.

Health and Safety Management:

• Ensure all employees, sub-contractors, and visitors comply with health and safety requirements, including induction training and PPE use.
• Implement a Management of Change process to assess health and safety risks before implementing changes.
• Ensure Sub-contractor Alignment, including assessing sub-contractors for health and safety compliance before awarding contracts.
• Maintain a Health and Safety File on site, including all documentation required by the OHS Act and Construction Regulations 2014.
• Stop work if health and safety risks are not adequately controlled and report non-compliance to the relevant authorities.

Environmental Requirements:

• Comply with Annexure B: Environmental Specification, outlining environmental standards and controls for the project.
• Address environmental risks, including waste management, hazardous chemical substances, and pollution prevention.
• Ensure environmental impact is minimised and managed in accordance with applicable legislation and project-specific requirements.
