Bid documents must include the General Conditions of Contract (GCC), which cannot be amended. Special Conditions of Contract (SCC) may supplement the GCC for specific bids, and SCC provisions prevail in case of conflict. Bidders must avoid collusive bidding or bid rigging, as defined in the Competition Act No. 89 of 1998. Evidence of such practices may lead to referral to the Competition Commission, bid invalidation, contract termination, or restrictions from public sector business for up to 10 years.

Goods supplied must conform to the standards specified in the bidding documents. Suppliers must ensure packing is sufficient to prevent damage during transit, including resistance to rough handling, extreme temperatures, salt, and precipitation. Delivery must comply with contract terms, including shipping and documentation requirements as specified in the SCC.

Suppliers must ensure goods conform to specified standards. Pre-bidding testing costs are the bidder’s responsibility. Inspections during production or execution may be required, with costs covered by the purchaser if supplies comply, or by the supplier if they do not. Non-compliant supplies may be rejected and must be replaced at the supplier’s cost and risk.

Payment terms, methods, and conditions will be specified in the Special Conditions of Contract (SCC). Suppliers must submit an invoice with a copy of the delivery note. Payments will be made in Rand within 30 days of invoice submission unless otherwise stipulated. Prices must not vary from the bid unless authorized in the SCC or bid validity extension. Performance security (e.g., bank guarantee or cashier’s cheque) must be furnished within 30 days of contract award, as specified in the SCC.

Suppliers must provide a valid tax clearance certificate issued by SARS prior to bid award. No contract will be concluded with bidders whose tax matters are not in order. Suppliers must indemnify the purchaser against third-party claims of patent, trademark, or industrial design infringement. Local content and imported content definitions apply as per GCC.
