Bids must be: sealed in an envelope with bidder name, bid number (ZNB5296/2026-H), and closing date; submitted on official forms (not retyped); complete in all respects; and initialed on every page. Scope: Provide comprehensive 'cradle-to-grave' Health Care Risk Waste Management (HCRWM) services for ~600 KZN Department of Health institutions (hospitals, CHCs, clinics, mortuaries, EMS bases) over 36 months. Services include: labelling, internal transportation, interim/central storage, collection, external transportation, treatment, disposal, tracking/traceability, and provision of legally compliant containers for all HCRW generated. The system must be sustainable, cost-effective, environmentally acceptable, efficient, and uniform. Compliance required with: National Health Act, National Environmental Management Act, Waste Act, Environmental Conservation Act, Road Traffic Act, Water Act, Waste Information System Regulations, Hazardous Substances Act, and other relevant legislation. Annexures provide: list of facilities (Annexure A), container specifications (Annexure B), waste vehicle allocation (Annexure C), and indicative HCRW volumes per district/area (Annexure D).

Standards: Goods/services must conform to bidding documents and SANS/SABS/ISO standards. Inspections: Premises must be open for inspection at reasonable hours. Pre-bidding testing costs are bidder’s responsibility. If inspections reveal non-compliance: supplier pays for tests; goods/services may be rejected. Rejected items must be removed/replaced at supplier’s cost. Purchaser may procure substitutes at supplier’s expense if delays occur. Supplier must permit audits of performance records. Packing: Must prevent damage/deterioration during transit (rough handling, extreme temperatures, precipitation). Marking/documentation must comply with contract/SCC requirements.

Pricing: Submit detailed pricing schedules for Area 1, Area 2, and Area 3 (see Annexures). Payment terms: Invoices must be accompanied by delivery notes; payments made within 30 days of invoice submission. Currency: South African Rand (ZAR). Performance security: Successful bidder must furnish a bank guarantee or irrevocable letter of credit (or cashier’s/certified cheque) within 30 days of contract award, denominated in ZAR or freely convertible currency. Security will be discharged 30 days after contract completion (including warranty obligations). Penalties: Delayed delivery/performance incurs daily penalties calculated at the current prime interest rate on the delayed goods/services value. Contract may be terminated for persistent delays.

Mandatory compliance: CSD registration (www.csd.gov.za) – non-registration at bid closing disqualifies the bidder. Tax Compliance: Submit SARS Tax Compliance Status (TCS) PIN (apply via eFiling at www.sars.gov.za). If no TCS PIN, provide CSD number. For consortia/joint ventures, each party must submit separate TCS/CSD documentation. B-BBEE: Submit B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs/QSEs) to qualify for preference points. Foreign suppliers: Must confirm RSA residency/branch/permanent establishment or income/tax liability; if none, no SARS TCS PIN required. Disqualification: Bids from state employees, companies with state-employed directors, or close corporations with state-employed members are invalid. Bidder’s Disclosure Form (SBD4) must declare any conflicts of interest or relationships with procuring institution staff. Environmental compliance: Must adhere to National Environmental Management Act, Waste Act, Environmental Conservation Act, Water Act, Waste Information System Regulations, and Hazardous Substances Act. HCRW management must ensure: proper containerization, storage, collection, transportation, treatment, and disposal. The system must be environmentally acceptable, with tracking/traceability for all waste streams. Annexure D provides indicative HCRW volumes per district/area to guide service planning. Non-compliance with environmental regulations may result in contract termination or legal penalties.

Contract duration: 36 months. Key terms: Performance security (bank guarantee/letter of credit/cashier’s cheque) due within 30 days of award; discharged 30 days post-completion. Payment: Invoices + delivery notes; paid within 30 days in ZAR. Prices fixed per bid; adjustments only via SCC or validity extensions. Penalties: Daily prime interest rate on delayed goods/services. Termination: For default (non-delivery, breach, corruption/fraud), insolvency, or force majeure. Disputes: Mediation first, then South African courts. Liability: Supplier liable for defects (12-18 month warranty); aggregate liability capped at contract price (excluding repair/replacement costs). Subcontracts: Must be notified in writing; supplier remains liable. Force majeure: Exempts supplier from penalties if beyond their control. Anti-dumping/countervailing duties: Supplier bears costs. Confidentiality: Contract documents/information may not be disclosed without purchaser’s consent.

Evaluation uses the 80/20 preference point system. Price accounts for 80 points (scored via formula: Ps = 80(1 - (Pt - Pmin)/Pmin)), and Specific Goals (e.g., B-BBEE ownership) account for 20 points. Companies at least 51% Black-owned may claim 10-20 points, with verification via CSD, B-BBEE scorecard, CIPC, or municipal databases. Failure to submit proof forfeits preference points. The organ of state may request additional substantiation. The lowest acceptable bid determines the scoring system.
