The scope of contract calls for the appointment of a suitably qualified and experienced
professional Environmental Management Consultant Company specializing in Landfill
Monitoring and Development for the Msunduzi Municipality’s New England Road Landfill Site for
a period of three (3) years.
2.0 Background
2.1 On 03 July 2017, the Department of EDTEA issued to the Msunduzi Municipality a revised
Waste Management Licence [WML]: C22/WMU0061/2016 enabling it to continue operations of
the New England Road Landfill Site. The Waste Management Licence [WML] is valid for a
period of 10 years which is set to expire in July 2027 encompasses clauses that the municipality
must adhere to.
2.2 The municipality intends to carry out environmental works in accordance with the 2017 WML
[Annexure “A” – Part B] in order to maintain compliance at the New England Road Landfill Site
and as such, the municipality wishes to engage professional consulting services to meet its
obligations and provide sustainable service delivery.
2.3 The WML details the required clauses that a municipality must ensure its compliance against.
Its requirements ensures that a municipality acts at the best interest of the environment as well
as the interested and affected partly whilst providing a basis for the Department of Economic
Development, Tourism and Environmental Affairs [EDTEA] as the regulatory authority to monitor
the management of the site.
2.4 The WML is categorised into general, construction and operational items that require attention
accordingly. The licence further requires studies, audits, surveys to be undertaken at different
frequencies for the site to be deemed compliant. The Service Provider will be required to ensure
that items outside of operational management are complied with.
2.5 In addition to the above, the municipality intends to explore the renewal of its WML with the
regulatory authority to allow for landfilling over its western land area of the current working face;
which is an area previously used for disposal [Annexure “B” – Part B]. The proposed Licence
Renewal onto the western area emanates as a measure to contain the ecological footprint of
landfilling in one place. This proposal is detailed as option 2 in the 2021 Decommissioning Plan
[Annexure “C” – Part B] and is projected to extend the landfills lifespan by approximately 6
years based on 700kg/m3 compaction and 3% growth.

4.0 Tender documentation
The tender documentation comprises of two (2) parts viz:
PART A: Standard Conditions of Tender, Legislation, Definitions, Specification,
Pricing Schedule, Data Sheets, Tender Form, and Annexures.
PART B: Waste Management Licence (WML), Site Aerial Map, and Decommissioning
Plan, pertaining to the New England Road Landfill Site, Pietermaritzburg.

5.0 Scope of works
5.1 The Service Provider will be required to work closely with the resident Landfill Management
to undertake the following as per the Waste Management Licence (WML):
5.1.1 Environmental Monitoring as stipulated on the WML,
5.1.2 Design of the Waste Body Berm, and
5.1.3 Undertake WML Renewal.
6.0 Detailed specification
6.1 Section 1 – WML Compliance: Environmental Monitoring and Site Survey – Ongoing
Studies for a Period of 3 Years
6.1.1 The Service Provider will be required to work closely with the resident Landfill Management to
undertake the following as per the WML Compliance:
(a) Ground, Surface and Leachate: Water Quality Monitoring Report – Biannually
(b) Landfill Gas Monitoring Report – Quarterly per Annum
(c) Environmental Audit Monitoring – Report Biannually
(d) Air Quality, Gas and Dust Monitoring Report – Seasonally per Annum
(e) Internal Environmental Audit Report – Quarterly per Annum
(f) External Environmental Audit Report – Annual
6.1.2 The successful Service Provider will be required to appoint an External Environmentalist
company to undertake the annual External Environmental audit report to ensure impartiality.
6.1.3 The successful Service Provider will further be required to appoint a Land Surveyor company to
undertake the annual Topographical Survey to determine the height above mean sea level
accompanied by the Landfill air space availability calculation and projection report.
6.1.4 Further to the above, the Service Provider will be required to investigate and provide
recommendations for environmental exceedances i.e. Gas exceedances observed during gas
monitoring/ water exceedances observed during water/ leachate monitoring. In addition, the
Service Provider will be required to provide engineering support for landfill operations “as and
when” requested.
6.2 Section 2 – Berm Design and Development including Documentation and Procurement
6.2.1 The Service Provider will be required to undertake Berm/ Perimeter wall design and approved
for the site according to clause 5.3.11 of the WML within 3 months of its appointment; to ensure
that the site is operated in such a manner that the height of the embankment or perimeter walls
is at all times maintained to a higher elevation than the level of the operating floor. Designs must
be as per Civil Engineering standards and practices to ensure landfill stability.
6.2.2 The Service Provider will be required to design for the entire perimeter of the workface and
further design for and include the previously excluded Eastern area wherein waste pickers
previously resided illegally, for the purposes of additional landfilling space as indicated on
Annexure “B” – Part B. In addition, the Service Provider will be required to investigate and
propose feasible solutions for the repair/ correction and construction of leachate seeping areas
on previously constructed berm. The Service Provider must ensure that the proposed material to
be used to construct the berm is impermeable (Geo-synthetic liner) and available at construction
phase. In addition, the berm must be at least 2 meters in width to allow for vehicular movement
for inspection purposes.
6.2.3 The Service Provider must thereafter draft a tender specification for the appointment of a
Contractor and ensure conclusion of this process within 8 months after the berm/ perimeter wall
design has been approved by relevant structure(s). The Service Provider is to act as an
employer’s agent to the Contractor for a period of 8 months during the construction of the berm.
6.3 Section 3 – Waste Management Licence Renewal and Western Land Area Development
6.3.1 The municipality intends to submit a Waste Management Licence renewal application to the
regulatory authority for the Renewal of the 2017 WML which is set to expire in 2027. The
municipality is presently undertaking the WML validity extension license application within the
current workface as a result of the airspace availability which is informed by the latest
topographical survey. Should it be approved, it would allow for approximately 4-year additional
operation on site.
6.3.2 In addition to the above, the municipality intends to submit a WML renewal for the utilisation of
the Western land area within the landfill boundary. There is adequate space (detailed on
Annexure “C” – Part B) available within the current landfill boundary to allow for further
development of the site for landfill operations. It is anticipated that the development of this land
would yield approximately 7 additional years of to the above anticipated licence validity.
6.3.3 It be noted that the land area in question is a historically disturbed as previous waste disposal
was being undertaken in the preceding years. The extent and depth of the historic waste body
must be investigated. In addition, and not limited to the following, the Service Provider must (in
consultation with relevant interested and affected parties):
(a) Determine the emissions for testing and propose placement of all WML required testing
pits, where necessary.
(b) Investigate old-landfilled area – not limited to determining the extent to which the land
was engineered, whether the area was previously lined for disposal, the extent of old
landfilled waste, etc.
(c) Review available specialist studies/ documentation and implement relevant the
recommendations.
(d) Design a suitable piggy-back liner containment barrier system for approval by the
Department of Water and Sanitation [DWS], the regulatory authority and any interested
and affected party.
(e) Design and undertake all required studies for the development of the Western land area,
readily provide any other required information for the WML application and cell
construction. All required documentations and/or drawings must be submitted for
approval with the relevant structures i.e. EDTEA , DWS, etc. within 12 months of
appointment. Prepare reports for submissions as well as preparing and undertaking
presentations to any relevant or required committee/ structure/ department.
(f) Prepare the tender documentation for the development/ construction of the land. All
processes and appointment must be concluded within 10 months from the approval. The
Service Provider must act as an employer’s agent during the construction of the Western
land area cell. The project duration will be determined and informed by the record of
decision from the regulatory authorities.
7.0 Tender briefing meeting
There is no Tender Briefing Meeting scheduled for this tender.
8.0 Contract period
The total contract period will be three (3) years effective from the date of appointment of the
successful Service Provider. The contract will be inclusive of all three (3) sections viz:
8.1 Section 1 – WML Compliance: Environmental Monitoring and Site Survey – Ongoing
studies for a period of three (3) years.
8.2 Section 2 – Berm Design and Development including Documentation and Procurement –
19 months.
8.3 Section 3 – WML Validity Renewal and Western Land Area Development – 22 months.
9.0 Service level agreement
The successful Service Provider shall be required to enter into a Service Level Agreement with
the Msunduzi Municipality before the commencement of any services.
10.0 Place of delivery
All services are to be rendered at/to the New England Road Landfill Site, 500 New England
Road, Pietermaritzburg, 3201 (Attention: Nosihle Nzama: Manager: Landfill and Recycling).
11.0 Site meetings
Site meetings will not be required prior to the appointment. The successful Service Provider
must conduct, facilitate and attend site meetings “as and when” required.
12.0 Penalties
Upon any delay in delivery beyond the expected delivery periods, the Municipality shall be
entitled forthwith to procure services of the same description as and in lieu of those specified to
be supplied, or forthwith to cancel the contract and to procure elsewhere such services as may
be required during the contract period and the Service Provider shall bear any difference in price
between any services so procured and the tendered price. The amount of such difference shall
be paid by the Service Provider to the Municipality immediately on demand, or the Municipality
may deduct such difference from money (if any) otherwise payable to the Service Provider in
respect of services already delivered under this or any other contract.
13.0 Escalation
Price is to remain firm for the contract period as the nature of the contract is consultancy
services and the prices for the works are payable as per the relevant regulatory body
professional fee guidelines.
14.0 Insurance required
Professional Indemnity (PI) insurance will be requested from the successful Service Provider
and submitted to the Supply Chain Management Unit upon appointment of the Service Provider.
15.0 Maintenance period
The intervals for the maintenance period of the services required must be maintained on
quarterly intervals.
16.0 Drawings
The Service Provider will be required to provide the following plans as a requirement after the
contract has been awarded:
(a) Landform Plans – All Views.
(b) Topographical Surveys and Landfill Air Space Availability Calculation and Projection
Report.
(c) Berm/Perimeter Wall Designs.
17.0 Compliance with any legislation, bylaws, etc.
All works to be undertaken under this contract shall be compliant in accordance and/or

18.0 Mandatory requirements
18.1 Professional Civil Engineer/Technologist, professionally registered with the Engineering Council
of South Africa (ECSA) as a PrEng/PrTech. The Engineer that is submitted for this section, will
be the same Engineer tested under clause 19.0 (Evaluation Criteria) below and will be the
Project Lead during the full duration of the project. Copy of professional registration must be
submitted.
18.2 Environmental Scientist registered with the South African Council for Natural Scientific
Professions (SACNASP) as a Professional Natural Scientist. Must have a NQF 7 Level in
Environmental Science. Copies of professional registration and NQF Level 7 qualification
must be submitted.
Failure to provide the mentioned documents will result in disqualification. Registration
must be in good standing with the regulatory body.
19.0 Evaluation criteria
19.1 Tenderers complying with the above Mandatory Requirements shall be evaluated on a Two
Stage Evaluation System – Stage One: Functionality and Stage Two: 80/20 Point System in
accordance with the Msunduzi Municipality’s Supply Chain Management Policy (incorporating
Preferential Procurement) as prescribed in terms of the Preferential Procurement Regulations
2022, pertaining to the Preferential Procurement Policy Framework Act, Act No. and
the Public Procurement Act, Act No. .
19.2 Only tenderers who score a minimum threshold of 75% (equating to 45 points out of a total of 60
points) for Functionality in Stage One, will be further considered for Stage Two: 80/20
Preference Point System.

8.2 The Service Provider shall submit a certificate with the tender certifying compliance with all

Provider shall submit at the time of tendering the name(s), qualifications and address(es) of the
Professional Engineer(s) responsible for the various disciplines and portions of the work
comprising this contract.
9.0 General conditions of the contract
(d) At the time of appointment or project implementation, should the Service Provider’s key
personnel not be available, the Service Provider will be required to provide key
personnel staff with the same required qualifications at the same level as per the
requirement or with qualifications at a higher level than the required.
(e) The Service Provider must maintain the same key personnel submitted with the tender.

complaint to the Municipal Manager / Supply Chain Management. The appeal must be
submitted in writing with the grounds of appeal within the stipulated fourteen (14) days. No
appeal/objection will be entertained should the afore-mentioned condition not be adhered to,
and the Municipality shall not be held liable for any loss or damages sustained by the Service
Provider due to the Service Provider’s failure to adhere to the above condition.

2.0 The occupational, health and safety act (act ) (OHS act)
2.1 The OHS Act covers inter alia "any work in connection with –
a) the erection, maintenance, alteration, renovation, repair, demolition or dismantling of an
addition to a building;
b) the installation, erection or dismantling of machinery;
c) the construction, maintenance, demolition or dismantling of any bridge, dam, canal,
railway, street, runway, sewer or water reticulation system or work on any similar project;
d) the moving of earth, clearing of land or making of an excavation or work on any similar
project." (General Administrative Regulations Clause 1).
2.3 The arrangements and procedures to ensure compliance by the Mandatory with the provisions
of the OHS Act referred to in the Agreement, between the Employer and the Contractor in this
contract are:
2.3.1 The Mandatory shall keep a record of all incidents in terms of Clause 10 (1) of the
General Administration Regulations (GAR).
2.3.2 The Mandatory shall cause every incident to be investigated in terms of Clause 10 (2) of
the GAR.
2.3.3 The Mandatory shall cause all such records to be examined by a Safety Committee in
terms of Clause 10 (3) of the GAR.
2.3.4 The Mandatory shall on demand furnish the divisional inspector with such returns as
may be required in terms of Clause 14 of the GAR.
2.3.5 The Mandatory shall charge a full-time employee designated in writing by the Mandatory
with the duty of supervising the performance of the work (or the Mandatory may
personally undertake this duty) in terms of Clause 11 of the General Safety Regulations.
2.3.6 The Mandatory shall, before commencing or carrying out the work, inform the divisional
inspector in writing of: -
a) the address of the premises on which such work will be carried out;
b) the nature of such work;
c) the date on which it is expected that such work will be commenced; and
d) the date on which it is expected that such work will be completed.

2.3.7 The Mandatory shall comply with all other aspects of the OHS Act relative to the nature
of the works and shall scrupulously observe and execute any instruction given by an
official inspector with reference thereto.
3.0 The compensation for occupational injuries and diseases act (act ) (coid act)
3.1 Contractors are required to register as employers in terms of the COID Act.
3.2 Contractors must pay the assessments due in terms of the COID Act relative to their employee
records including all sub-contractors and community based labour.
3.3 In this specific contract the Contractor further acknowledges that the Employer shall have the
right, without prejudice, to deduct any shortfall in compensation due to any employee of the
Contractor (or sub-contractor) from monies due or which may become due to the Contractor,
and so effect settlement of the matter.
4.0 The labour relations act (act ) (lr act)
4.1 Contractors are required to register as employers in terms of the LR Act.
4.2 Contractors are required to pay all employee and employer contributions to the Unemployment
"Council/Municipality" means the Msunduzi Municipality.
"Senior Manager: Supply Chain Management” means the Senior Manager: Supply Chain
Management of the day of the Msunduzi Municipality or the Manager’s duly appointed Representative.
"Service Provider/Contractor" means the Person, Firm, Service Provider or Company whose tender
has been accepted by the Msunduzi Municipality and includes the Service Provider's heirs, executors,
administrators, trustees, judicial managers or liquidators, as the case may be, but not, except with the
written consent of the Council, any assignee of the Service Provider.
"Special Conditions" means any addition to or departure from or amendment of these Standard
Conditions as set out in Annexure “A” hereof.
"Drawings" means the drawings referred to in the Specification and any modification of such drawings
approved in writing by the Engineer and such other drawings as may from time to time be furnished or
approved in writing by the Engineer.
"Contract Document" means the Conditions of Tender, Scope of Contract, Terms of Reference, these
Definitions, Special Conditions (if any), Equipment Specifications, Rates, Percentages and Prices,

25.0 Council’s liability and indemnity
25.1 The Service Providers hereby indemnifies the Council and its employees and agents against all
losses and claims for injuries or damages to any person or property whatsoever which may
arise out of the execution of this contract.
25.2 The Council shall not be held liable to the Service Providers for any direct or indirect damages
or losses and the Council shall be indemnified and held free against claims arising out of:
25.2.1 any negligent or innocent misrepresentations made by the Council, its employees or
agents in respect of any data, information and statistics supplied to the Service
Providers prior to or during the contract; provided that this condition shall not deprive the
consent of the Engineer and such consent, if given, shall not relieve the Service Providers from
any liability or obligation under the contract.
