• Three‑stage evaluation: 1) Administrative & Substantive Responsiveness (on‑time submission, all mandatory returnables, signed documents, priced offer). 2) Functionality (technical) – minimum threshold 80 points out of 100. Scoring includes: company experience (0‑10 pts), resources’ experience/qualifications (Partner/Director, Senior Attorney, Junior Attorney, Candidate – up to 10 pts each), Quality Management Plan (up to 20 pts), client references (up to 35 pts). 3) Price – weighted 80 % of total score; price schedule must be fully completed and hourly rates must not exceed the prescribed maximum percentages (Tier 1 no deviation, Tier 2 up to 20 %, Tier 3 up to 30 %, Tier 4 up to 50 %). Preference points (20 % of total) awarded based on B‑BBEE status and other specific goals (e.g., black‑owned, youth‑owned, disability, location, sub‑contracting). Overall weighted score: Price 80 % + Preference 20 % = 100 %. Disqualification occurs if any mandatory document is missing or if the 80‑point technical threshold is not met.

Scope: Provide supplementary legal services for ACSA over 2 years + 6 months covering: – Corporate & Tax law (cross‑border transactions, SARS objections, Tax Court representation). – Property law & conveyancing (sale, lease, rates, zoning, financing). – Administrative, Litigation & Employment law (advice, court representation, urgent applications). – Forensic investigations. – Criminal law (defence, court processes). Required team per service: Partner/Director, Senior Attorney, Junior Attorney or Candidate Attorney (all admitted to the High Court; Candidate Attorney must hold a recognised law qualification). Key deliverables: legal opinions, research reports, litigation support, progress reports, compliance with ACSA instructions, timely invoicing, adherence to service‑level agreements. Professional requirements: valid Fidelity Fund Certificate, Letter of Good Standing from the Legal Practice Council, registration with the Legal Practice Council, CSD number, tax compliance PIN, B‑BBEE certificate (if claiming preference). Quarterly performance reviews and a Quality Management Plan (template management, billing system, electronic research tools, business continuity plan) are mandatory.

• Complete the Pricing Schedule (SBD 3.3) in full; hourly rates are final and become contractual rates.
• Maximum tariff caps: Tier 1 R1 000 (no deviation), Tier 2 R2 000 (up to 20 % above base), Tier 3 R2 500 (up to 30 % above base), Tier 4 R3 700 (up to 50 % above base).
• Prices must remain firm for 120 working days from the bid closing date (validity period).
• No mention of performance bonds or guarantees; bidders should ensure compliance with any post‑award payment terms stipulated in the service contract.

• Tax compliance: provide SARS Tax Compliance Status (TCS) PIN or CSD number; submit printed TCS certificate if available.
