Scope: Provision of 24/7 armed close protection officers on an 'as and when' required basis for 3 years. Refer to Annexure 1.1.18 (Scope of Work) and Appendix A (Detailed Technical Evaluation Criteria) for full technical requirements. Mandatory documents: Valid PSIRA registration, personnel registration and grading, firearm legality and governance, armoury management, vetting readiness, and security clearances for directors. Additional requirements: Project-specific baseline OHS hazard identification and risk assessment, SHE Plan, Valid Letter of Good Standing, OHS Policy signed by CEO, Quality Requirement (Category 4).

Pricing Schedule/BOQ must be submitted in PDF and Excel. Include a line item for cataloguing if required. Alternative tenders are not allowed. Pricing evaluation: inclusive of VAT, corrected for errors, excluding contingencies, adjusted for acceptable variations. Unconditional discounts are considered; conditional discounts are not. Prices are scored out of 80 or 90 points. Refer to NEC Contract (Annexure 1.1.19) for additional pricing terms.

Cataloguing may be required post-award; include a line item for cataloguing in the Pricing Schedule if applicable. Eskom reserves the right to negotiate prices if not market-related. Financial statements (latest approved, not draft) required: Background, signed director’s report, signed auditor’s/reviewer’s/compiler’s report, statement of financial position, comprehensive income, changes in equity, cash flows, notes. For unincorporated JVs/SPVs, each partner must submit financials. Public Interest Score (if applicable) must include actual score, owner-management status, and external preparation confirmation.

Mandatory: CSD registration (CSD number/report), Tax Clearance Certificate (SA tenderers or foreign tenderers with SA footprint; SARS PIN for verification), COIDA Certificate (SA tenderers only), Employment Equity compliance (SA designated employers only), CIDB grading (if applicable, within 21 working days post-closing), NEC Contract completion, SBD forms (1, 4, 6.1, 6.2). Integrity Pact Declaration (Annexure D) and Supplier Integrity Pact acknowledgment required. Joint Ventures: Valid JV agreement with joint/several liability, lead member designation, profit-sharing ratios, and single designated bank account. Subcontracting with subsidiaries must be declared. B-BBEE: Proof of status (certificate, sworn affidavit, or other prescribed requirement). Foreign suppliers: SBD1 mandatory; no tax compliance proof required if no SA footprint.

Mandatory OHS requirements: COIDA Certificate of Good Standing or proof of application (SA tenderers only), Project-specific baseline OHS hazard identification and risk assessment, SHE Plan, Valid Letter of Good Standing, OHS Policy signed by CEO. Additional SHEQ requirements may apply as stipulated in the contract. Quality Requirement: Category 4. All safety/quality documents must align with the scope of work.

Contract terms: NEC3 Term Service Contract (TSC3). Payment terms: 30 days for contracts ≤ R50M (incl. VAT); 60 days for contracts > R50M (incl. VAT). Eskom reserves the right to negotiate prices post-bid if not market-related. Subcontracting with subsidiaries must be declared to avoid fronting allegations. Contractual requirements (e.g., CSD registration, SHEQ, financial viability) are assessed post-evaluation. Failure to meet contractual requirements may result in disqualification. Tender validity period: 180 days from closing date.

Functionality requirements apply. Desktop Evaluation (Technical: 100%, minimum threshold 80%) and Site Evaluation (100%, minimum threshold 100%). Pricing scored out of 80 or 90 points, inclusive of VAT, with corrections for errors and adjustments for acceptable variations. Unconditional discounts considered; conditional discounts excluded. Specific Goals (B-BBEE) scored out of 10 or 20 points per PPPFA 2022. Failure to submit Specific Goals evidence scores zero but does not disqualify. Final ranking uses 80/20 or 90/10 system. Objective criteria may override highest score if justified.
