• Service: Professional Construction Monitoring Services for the ACSA VIP Lounge Refurbishment at Cluster 3 airports (King Shaka International, Chief Dawid Stuurman, King Phalo).
• Contract period: Up to 21 months.
• The construction monitoring team will be led by a project manager.
• The team must include the following resources with specified experience, qualifications, and professional registration:

• Architect (Pr.Arch - SACAP)
• Quantity Surveyor (Pr.QS - SACQSP)
• Structural Engineer (Pr.Eng/Pr.Tech.Eng - ECSA)
• Electrical Engineer (Pr.Eng/Pr.Tech.Eng - ECSA)
• Mechanical Engineer (Pr.Eng/Pr.Tech.Eng - ECSA)
• Construction Health & Safety Agent (Pr.CHSA - SACPCMP)
• Site Agent (Level 3 & Level 2 Monitoring)

• Minimum experience: 3 years post-registration experience for professionals.
• Relevant projects include new buildings, revamping, refurbishment, repurposing, expansion, or fit-outs of existing buildings.
• Key persons must attend an average of two meetings and six site inspections (2 per airport) per month.
• Access to site and information will be provided following contract signing.

• The Consultant must provide key persons' details (name, job, responsibilities, qualifications, experience).
• Professional team must include:

• Architect: Bachelor's degree, Pr.Arch (SACAP), 3+ years post-registration experience.
• Quantity Surveyor: Bachelor's degree, Pr.QS (SACQSP), 3+ years post-registration experience.
• Structural Engineer: Bachelor's degree, Pr.Eng/Pr.Tech.Eng (ECSA), 3+ years post-registration experience.
• Electrical Engineer: Bachelor's degree, Pr.Eng/Pr.Tech.Eng (ECSA), 3+ years post-registration experience.

• The Consultant must provide a quality policy statement and quality plan within 4 weeks of the Contract Date.
• The defects date is 52 weeks after Completion of the whole of the services.

• Site inspections: Key persons must attend an average of six site inspections (2 per airport) per month.
• The Price Schedule includes fees for stages covering reviews, contract administration, inspection, and close-out.

• The Time Charge is calculated from staff rates multiplied by staff time.
• Prices must be inclusive of all risks, insurances, liabilities, obligations, profit, expenses, etc.
• Variations will be priced at rates in the Price Schedule or agreed as non-scheduled items.
• Quantities are provisional and will be expended as directed by the Employer's Agent.
• The Price Schedule includes a Professional Services Fee Schedule with a basic fee as a percentage of R8,700,000 (excl. VAT).
• Stages to price: Phase 1 (Stage 1-4 Reviews), Phase 2 Normal Services (Stage 5, Stage 6), Additional Services (Level 3 and Level 2 monitoring per airport).
• A provisional amount of R50,000 for third-party costs with a mark-up percentage.

• The contract uses NEC3 Professional Services Contract, Main Option A (Activity based).
• The Time Charge is the sum of the products of each staff rate multiplied by the total staff time properly spent.
• The Activity Schedule is in the Pricing Data.
• The Price Schedule must be completed with inclusive prices covering all risks, insurances, liabilities, obligations, profit, expenses, etc.
• All costs (communication, printing, computer hardware/software, incidental disbursements like travel, accommodation) are included in the fee/rates.
• Quantities are provisional and will be expended as directed by the Employer's Agent.
• Variations will be measured and priced at rates in the Price Schedule, or agreed as non-scheduled items.
• The basic fee is a percentage of the estimated construction value of R8,700,000 (excl. VAT).
• A provisional amount of R50,000 is included for third-party costs with a mark-up percentage to be stated.
• Payment assessments occur every 4 weeks, on the 25th of each month.
• Payment is made within 4-6 weeks after receipt of a valid tax invoice.
• The currency is South African Rand.
• Interest rate is the prime lending rate of Nedbank.

• The Consultant must annually present a compliant B-BBEE Certificate. Failure is a material breach.
• The Consultant must provide insurance as stated in the Contract Data, including Professional Indemnity insurance: minimum cover of R5 million for projects under R50 million.
• Insurance must be in joint names and cover events at the Consultant's risk from the starting date until the Defects Certificate or termination certificate.
• The Consultant must comply with all laws, including the Prevention and Combating of Corrupt Activities Act.
• The Consultant must not engage in illegal or corrupt practices; breach constitutes grounds for termination.
• All professional team members must be registered with their respective professional councils (SACAP, ECSA, SACPCMP, SACQSP).
• The law of the contract is the Republic of South Africa.
• The language of the contract is English.

• The Construction Health & Safety Agent must be professionally registered with SACPCMP (Pr.CHSA).
• Minimum experience: 3 years post-registration in relevant projects.
• The Consultant must provide insurance as per Contract Data, including cover for death or bodily injury to employees as prescribed by the Compensation for Occupational Injuries and Diseases Act.

• Contract based on NEC3 Professional Services Contract, April 2013.
• Main Option A: Activity based on Built Environment Council project stages.
• Dispute resolution Option W1.
• Secondary Options include X7 (Delay damages), X9 (Transfer of rights), X10 (Employer’s Agent), X11 (Termination by Employer), X18 (Limitation of liability), and Z clauses.
• Delay damages: 1% per week up to a maximum of 10% of total professional fees.
• Limitation of liability: No liability for indirect/consequential loss; liability for other matters is unlimited except excluded matters.
• The Consultant must provide securities, bonds, guarantees, proof of insurance as required.
• The Consultant must not cede, delegate, or assign rights/obligations without Employer's written consent.
• Confidentiality: All contract information is confidential; images of the works require prior consent; rights vest in Employer.
• Ethics: Compliance with anti-bribery/corruption laws; breach grounds for termination.
• Employer step-in rights if Consultant defaults and fails to remedy within 2 weeks.
• Intellectual Property: Consultant grants Employer a licence to use IP for construction, repair, operation, maintenance.
• Disputes: Adjudication based on written submissions only; termination disputes go directly to arbitration.
• Risk Register includes availability of as-built information, site access, statutory approvals, site constraints, claims notification, financial/procurement, multi-site work.

• Fees will be based on standard professional council guidelines (ECSA, SACAP, SACPCMP, SACQSP).
• The basic fee is a percentage of the estimated construction value of R8,700,000 (excl. VAT).
• Bidders must price each stage in the Price Schedule, including:

• Phase 1: Stage 1-4 Reviews (Surveys, Inspections, Reviews, expert input).
• Phase 2 Normal Services: Stage 5 (Contract administration and Inspection), Stage 6 (Close-out).
• Additional Services: Level 3 full-time construction monitoring (5 weeks provisional per airport) and Level 2 part-time monitoring (12 weeks provisional per airport, 1 site visit per week).
