Scope: Appointment to a 5-year panel (01 August 2026 start) for chairpersons and initiators of disciplinary hearings, as and when required by FSCA. Categories: - Category 1: Chairpersons. - Category 2: Initiators. Bidders must specify category(ies) applied for; failure to select may result in elimination. Chairpersons: - Study evidence presented during hearings. - Provide guilty/not guilty findings with detailed reports. - Recommend sanctions aligned with FSCA disciplinary procedures. Initiators: - Investigate and gather evidence. - Conduct interviews with accused and witnesses. - Assess evidence (case law research, document perusal, bundle preparation). - Produce investigation reports with recommendations. - Lead evidence for the employer (call witnesses, present documents). - Prepare closing arguments. Grievance Management: - Establish facts relating to grievances. - Engage with witnesses to verify facts. - Evaluate evidence. - Provide reports with recommendations. Requirements: - Must demonstrate impartiality, neutrality, and no bias. - Advanced labour law knowledge required. - Extensive experience in dispute resolution, evidence assessment, and distinguishing facts from opinions/hearsay. - Ability to justify verdicts and sanctions with clear reasoning. Contract Conditions: - Appointment does not guarantee work; assignments issued via purchase orders. - No subcontracting without FSCA written consent. - Must declare conflicts of interest; FSCA may cancel assignments if conflicts arise. - FSCA may appoint outside the panel in exceptional cases (BAC-approved). - Must liaise directly with FSCA’s delegated person for instructions and administration.

Rate-based tender with hourly tariffs (including VAT): - Junior Professional (3-5 years experience): Up to R1,800/hour. - Senior Professional (5-7 years experience): Up to R2,500/hour. - Professional Practitioner (8+ years experience): Up to R4,000/hour. Final rates negotiated based on experience/expertise. Agreed tariffs reviewed annually at FSCA’s discretion; deviations not permitted. Pricing: - All-inclusive fee statement required. - Pricing must cover all obligations under the contract. - Bid must be signed and priced in South African Rand. - No correction fluid allowed; changes must be scratched out and signed. - Separate schedules may be submitted if space is insufficient, bound with contents page.

• Central Supplier Database (CSD): Mandatory registration as a prospective supplier (National Treasury Circular No. /2016 and SCM Instruction Note 4A of 2016/2017). CSD number must be provided and kept updated. - Tax Compliance: Submit Tax Compliance Status (TCS) PIN (via SARS e-filing) or printed TCS certificate. For consortia/joint ventures, each party must submit separate TCS PIN/CSD number. - B-BBEE: Submit valid B-BBEE certificate or sworn affidavit (for EMEs/QSEs) to qualify for preference points. - Standard Bidding Documents: SBD 1 (Invitation to Bid), SBD 4 (Bidder’s Disclosure), SBD 6.1 (Preference Points Claim Form) must be completed and signed.
