• All required returnable documents (SBD 1 Invitation to Bid, SBD 4 Bidders’ Disclosure, SBD 3 Pricing Schedule, SBD 6.1 Preference Claim Form, SBD 7 Contract Form where applicable) must be fully completed, signed in black ink and attached.
• Failure to provide any required returnable document or to sign correctly will lead to disqualification.

• Evaluation consists of two phases: Phase 1 – Mandatory Technical Evaluation; Phase 2 – Functionality Technical Evaluation.
• Mandatory Technical Evaluation: verify that all mandatory requirements (e.g., Legal Practice Council registration, certificates of good standing, professional indemnity, fidelity fund certificate) are met. Non‑compliance results in immediate disqualification.
• Functionality Evaluation: bidders must achieve at least 75 % overall score to be considered responsive. Scoring categories and maximum points: - Company experience (up to 5 points) based on years of public‑sector legal experience. - Reference letters (up to 5 points) – six valid letters = 5 points, five = 4 points, etc. - Lead partner/Director qualifications (up to 5 points) – ≥10 years post‑admission + LLB/B‑Proc = 5 points. - Team member qualifications (up to 5 points) – ≥8 years post‑admission = 5 points, 5‑8 years = 3 points. - Number of allocated resources (up to 5 points) – ≥5 team members = 5 points, 3‑4 = 3 points, 2 = 1 point, 1 = 0 points.
• Total functional points = 30; minimum 75 % (22.5 points) required.
• Failure to meet the minimum functional score results in disqualification.

Scope of work: provide general legal and litigation services on an ad‑hoc basis for the MHSC, covering:

• Corporate law (contract drafting, SLA drafting, compliance, IP, legislative drafting)
• Labour law (employment relations, disciplinary hearings, representation at Labour Courts/CCMA, arbitrations)
• Litigation and general legal services (legal opinions, contractual disputes, debt collection, court proceedings).
• Bidders must demonstrate expertise in one or more of these fields.
• Mandatory registrations: Legal Practice Council registration in good standing, valid Certificate of Good Standing for each practitioner, Fidelity Fund Certificate (≤6 months old), Professional Indemnity or Fidelity Cover.
• Provide a detailed organogram of all practitioners to be assigned.
• Compliance with Mine Health & Safety Act and POPIA is required.

Pricing: No price evaluation at tender stage; a detailed pricing schedule (SBD 3) must be completed and submitted.

• Payment terms: In accordance with PFMA sections 38(1)(f) and 76(4)(b) and Treasury Regulations 8.2.3 – payment within 30 days of receipt of a correct invoice after deliverables are completed.
• No bonds or guarantees are mentioned.
• All financial documents (pricing schedule, preference claim form) must be valid at the time of submission.

Mandatory compliance items:

• Registration on the Central Supplier Database (CSD) with proof of registration.
• Tax compliance – provide SARS Tax Verification PIN or CSD supplier number.
• Legal Practice Council registration and Certificate of Good Standing.
• Fidelity Fund Certificate (≤6 months) and Professional Indemnity/Fidelity Cover.
• B‑BBEE Preference Claim Form (SBD 6.1) with supporting certificate or sworn affidavit.
• POPIA adherence – personal information must be handled per the Protection of Personal Information Act.
• Occupational Health & Safety – compliance with Mine Health & Safety Act.
• All certificates and documents must be current at the time of bid submission.
