Must have and employ adequate resources, procedures, and technological systems for service delivery.

• Upon award, a Service Level Agreement (SLA) will be negotiated, based on draft indicators in the tender pack.
• The bidder's SLA must include: resources allocated to ASA, details of inclusions and exclusions, and standard turnaround times.
• Bidders must declare in their technical response that they will: act honestly and with due skill; employ effective resources and systems; act with circumspection in conflicts of interest; comply with all applicable laws; make adequate disclosures of material information; avoid fraudulent advertising; conduct business transparently; and protect confidential information.

• Tax compliance is mandatory. Awards will be withdrawn or contracts cancelled if a bidder is found non-compliant, submits a fraudulent tax certificate, or fails CSD verification. Compliance must be maintained for the full contract term.
• No award to bidders listed on the National Treasury Register of Tender Defaulters or List of Restricted Suppliers.
• Bidders must submit signed General Conditions of Contract with their bid.
• Agrément South Africa may disqualify bidders for collusive tendering, seeking unofficial assistance, offering inducements, accepting improper benefits, paying contingent commissions, past misconduct, or convictions for fraud/forgery.

• Any award is conditional on the bidder accepting the General Conditions of Contract as minimum terms and submitting a signed copy with the bid.
• A Service Level Agreement (SLA) will be negotiated post-award. Agrément South Africa reserves the right to reject proposed amendments.
• The SLA must include: resources allocated, inclusions/exclusions, and standard turnaround times.
• Agrément South Africa may disqualify bidders for collusion, seeking unofficial assistance, offering inducements, or past fraud convictions.
• Confidentiality: No disclosure of bid information without official involvement; documents remain proprietary and must be returned upon request.
• Written approval is required before releasing any information related to the tender.
• A declaration must be made in the cover letter confirming no access to proprietary information providing unfair advantage.
• Penalties for non-adherence to commission payments will be enforced as per the SLA.
• An escape clause allows termination or suspension if funds are unavailable or services are non-compliant, with payment for services delivered up to that date.
• The bidder indemnifies Agrément South Africa against costs from breaches.
• South African law governs, with exclusive jurisdiction of South African courts.
• Bidders are responsible for their personnel and subcontractors complying with all terms.
• Misrepresentations may lead to service termination and claims, even after contract conclusion.

• Agrément South Africa reserves the right to award to a bidder not scoring the highest points, in accordance with section 2(1)(f) of the PPPFA.
• The organisation may negotiate terms, including price, with preferred bidders identified during evaluation.
• Site inspections, product evaluations, or explanatory meetings may be conducted to verify service quality, before or after adjudication.
• Mistakes in bid documents or the tender process may be corrected at any stage.
• The tender process may be cancelled or terminated at any stage, including after closing date, presentations, evaluation, or notification of preferred bidders.

• The form requires:
