• Each bid must be in a separate sealed envelope with bidder's name, address, bid number (DARD06/2026), and closing date clearly marked.

• Price: 80 points.
• Specific Goals (B-BBEE): 20 points.
• The lowest acceptable tender determines the system.
• Bidders must submit B-BBEE documentation (certificate or sworn affidavit for EMEs/QSEs) to claim preference points.
• The department reserves the right to verify claims and may cancel the tender process at any stage.
• Bidders must not be listed on the Register for Tender Defaulters or Restricted Suppliers.
• No bids from state employees, directors/members in state service, or their associated entities.

Scope: Establishment of a Contractors Panel to assist the KZN Department of Agriculture and Rural Development with drilling and equipping boreholes for 36 months.

• Bidders must demonstrate capability to perform drilling and equipping of boreholes as per department specifications.
• Premises must be open for inspection by the department at reasonable hours if required.
• Supplies and services may be inspected, tested, or analyzed; non-compliant items will be rejected at supplier's cost.
• Suppliers must replace or repair defective goods or services at their own expense.
• Provide evidence of past experience via Annexure B (Bidders Past Experience).
• Document key personnel qualifications and technical capacity.

Bidders must provide evidence of past experience and qualifications:

• Complete Annexure B: Bidders Past Experience (page 62).
• Submit details of previous projects related to drilling and equipping boreholes.
• Provide proof of technical capacity and capability.
• Document key personnel qualifications and experience where applicable.

Quality assurance and control:

• Pre-bidding testing costs are for the bidder's account.
• Premises must be open for inspection by the department at reasonable hours if required.
• If inspections are later decided, purchaser will arrange and pay for testing.
• If supplies/services comply, inspection costs are covered by purchaser; non-compliance costs are borne by supplier.
• Non-compliant supplies/services may be rejected and must be removed/replaced at supplier's cost and risk.
• Purchaser may cancel contract for breach of conditions or act under Clause 23 of the General Conditions of Contract (GCC).

Pricing schedule requirements:

• Submit pricing in ZAR, including all applicable taxes (VAT, PAYE, income tax, UIF, skills development levies).
• Offers valid for 180 days from closing date (29 June 2026).
• Only firm prices accepted; non-firm prices or those subject to exchange rate variations will not be considered.
• For professional services, provide a ceiling price based on total estimated time, including all expenses and taxes.
• Detail hourly and daily rates for personnel involved.
• Break down costs per phase, including man-days and travel expenses (specify rate/km, total km, class of air travel, etc.).
• Travel expenses must be actual costs, recoverable only with proof via certified invoices.
• Indicate if rates are firm for the contract period; if not, provide adjustment details (e.g., CPI).
• Include brand, model, country of origin, and compliance with specifications for all items.

Pricing must be in South African Rand (ZAR) and include all applicable taxes (VAT, PAYE, income tax, UIF, skills development levies).

• Offers must be valid for 180 days from the closing date (29 June 2026).
• Only firm prices accepted; non-firm prices or prices subject to exchange rate variations will not be considered.
• For professional services, provide a ceiling price based on total estimated time, including all expenses and taxes.
• Detail hourly/daily rates for personnel and break down costs per phase.
• Travel expenses must be actual costs, recoverable only with proof via certified invoices.
• Indicate if rates are firm for the contract period; if not, provide adjustment details (e.g., CPI).

Mandatory requirements:

• Registration on the Central Suppliers Database (CSD) by closing date. Register at www.csd.gov.za.
• Tax compliance: Submit a Tax Compliance Status (TCS) PIN from SARS or a printed TCS certificate. Apply via e-filing at www.sars.gov.za. If no TCS PIN, provide CSD number.
• For consortia/joint ventures/sub-contractors, each party must submit separate TCS/CSD documentation.
• Declare that CSD information is correct and up to date.
• B-BBEE compliance: Submit a B-BBEE Status Level Verification Certificate or sworn affidavit (for EMEs/QSEs) to qualify for preference points.
• Confirm not listed on the Register for Tender Defaulters or List of Restricted Suppliers.
• Foreign suppliers must complete a questionnaire and provide proof if applicable.

Contract terms:

• Supplier warranty: Goods must be new, unused, and incorporate recent improvements. Warranty valid for 12 months after delivery or 18 months after shipment, whichever is earlier.
• Supplier must repair or replace defective goods at no cost upon notification.
• If supplier fails to remedy defects, purchaser may take remedial action at supplier's expense.
• Performance security (bank guarantee, irrevocable letter of credit, or cashier’s cheque) must be provided within 30 days of contract award. Security discharged 30 days after completion of obligations.
• Supplier must indemnify purchaser against third-party claims of patent, trademark, or industrial design infringement.
• Contract documents and information must not be disclosed without purchaser's consent.
• Supplier must permit inspections and audits of records related to contract performance.
