• PPE Procedure outlining issue, use, storage, maintenance, and limitations for the scope of work.
• Acknowledgement of Eskom SHE rules (Annexure B).

Note: If tendering as a supplier (not OEM), the manufacturer must be available for factory assessment if the tender advances.

• Pricing: Submit fully completed Bill of Quantities (BOQ)/Price List as included in the NEC3 Term Services Contract (TSC3). Incomplete pricing (missing line items) renders the tender non-responsive and disqualified.
• Performance Security: Details are specified in the NEC3 TSC3 document.
• Payment Terms:

• Contracts valued below R50 million (incl. VAT): Payment within 30 days of receipt of undisputed invoice.
• Contracts valued above R50 million (incl. VAT): Payment within 60 days of receipt of undisputed invoice.

• Price Negotiation: Eskom reserves the right to negotiate prices with preferred bidders if tendered prices are not market-related.
• Alternative Tenders: Not allowed.

• Central Supplier Database (CSD): Valid CSD registration with tax-compliant status is a mandatory contractual requirement for contract award.
• Tax Compliance: Provide tax clearance certificate or SARS e-filing PIN for verification. Foreign suppliers with no South African footprint complete SBD1 only.
• B-BBEE: Submit proof for preference points (valid B-BBEE certificate from SANAS-accredited agency, sworn affidavit, or CIPS affidavit). Include proof of ownership/shareholding (CIPC documentation), certified ID copies of shareholders, and proof of disability (if applicable). Non-compliance results in 0 points for B-BBEE but does not disqualify the tender.
• Local Content: Designated sector (Transformer Components Windings and Conversion Activities) requires 50% local content threshold. SBD 6.2 Declaration Form and Annexures G1-G4 (Local Content Declaration) are mandatory where designated materials are included.
• Employment Equity: If a designated employer, provide proof of compliance with the Employment Equity Act and submission of reports to the Department of Labour.
• Compensation for Occupational Injuries and Diseases (COID): Valid Letter of Good Standing (COID, FEMA, RMA) required, certified no older than 3 months at tender closing.
• Quality Compliance: Evidence of Quality Management System (ISO 9001 certified or documented QMS). Submit Form A, draft Contract Quality Plan, and Quality Control Plan (QCP/ITP).
• Safety, Health & Environment (SHE): Comprehensive SHE plan, Baseline Risk Assessment (BRA), SHE policy, competency training certificates, company organogram, medical certificates, driver licenses/PDP, emergency plan, PPE procedure. Must acknowledge Eskom SHE rules (Annexure B).
• Integrity: Submit signed Integrity Pact Declaration (Annexure D).
• Subcontracting: Declare if subcontracting with subsidiary companies. Subcontracting 100% of the scope disqualifies the tenderer.
• Objective Criteria: Inclusion of objective criteria is a condition for contract award. Failure to meet objective criteria may lead to the second-ranked tenderer being awarded the contract.
