The project involves sludge sump refurbishment at Matla Power Station, located approximately halfway between Bethal and Ogies on the R545, 13 km north-west of Kriel town. The site is situated in a summer rainfall area with specific climatic conditions, including average annual precipitation of 750 mm, primarily between October and April. The project requires compliance with Eskom’s standards and regulations, including health, safety, and environmental requirements.

The period for reply is 3 working days. The starting date is to be confirmed post-award. The Contractor must submit revised programmes at intervals no longer than 2 days during project execution and once a week during procurement and engineering. The completion date for the whole of the works is to be confirmed. The defects date is 52 weeks after completion of the whole of the works. The defect correction period is 1 week, except for production loss and SHE requirements (24 hours) and low-risk defects (1 week).

Scope includes sludge sump refurbishment at Matla Power Station. Key technical requirements: Prior to applying spray concrete, all deteriorated or defective concrete must be removed. Carbonated concrete must be removed to a depth of at least 20mm behind rebar and 50mm into non-carbonated concrete. Concrete deteriorated due to chloride attack must be removed to a depth of at least 30mm behind rebar and 100mm into sound concrete. Sprayed concrete must not be used in temperatures below 2°C, on substrates exposed to windy conditions, or rainfall. Substrates must be damp but without free water prior to application. Repairs must follow Eskom Power Station remedial work standard (240-144332407) for civil concrete remedial work. A method statement for execution must be reviewed and signed off by the contractor’s Professional Engineer (ECSA registered). Sludge removal in launder channels and sump using a vacuum truck (approximately 30m³). 35 MPa Gunite concrete to walls, in accordance with Eskom Standards (240-144332407). Supply and installation of wire mesh (Ref 395, allow 700m²) and acid-resistant tiles (allow 645m²). Structural steel works include repair of existing grating and supply/installation of galvanised steel components (equal angle iron and I-beams of specified dimensions).

Contractor must develop a high-level programme and resource each activity to arrive at lump sum prices for the Activity Schedule. Activities must be well-defined, shown on a programme, and priced as lump sums. Contractor must link the Activity Schedule to their programme and ensure all activities are inclusive of everything necessary to complete the works. Method statements for execution must be reviewed and signed off by the contractor’s Professional Engineer (ECSA registered). Concrete repairs must follow Eskom’s standards, and sludge removal must use specified equipment (e.g., vacuum truck).

Contractor must provide details of key personnel, including names, jobs, and responsibilities. CVs and further key personnel data must be appended to the Tender Schedule. Contractor must demonstrate experience in similar projects, particularly in civil concrete remedial work, sludge removal, and structural steel works. A method statement for execution must be reviewed and signed off by the contractor’s Professional Engineer (ECSA registered).

Defects date is 52 weeks after completion of the whole of the works. Defect correction period is 1 week, except for production loss and SHE requirements (24 hours) and low-risk defects (1 week). Contractor must promptly replace or repair loss of or damage to the Works, Plant, and Materials until the defects certificate is issued. Each party indemnifies the other against claims, proceedings, compensation, and costs due to an event at their risk. Liability is reduced proportionally if events at the other party’s risk contributed.

Pricing follows NEC3 ECC3 Option A (Priced contract with activity schedule). Work is broken down into activities, each priced as a lump sum. Only completed activities are assessed for payment at each assessment date. Activity Schedule is a pricing document and not Works Information. Contractor must link the Activity Schedule to their programme. Prices must include everything necessary to complete the works as per the Works Information. No adjustments are made for quantity differences; changes only occur due to compensation events. Activity Schedule format includes items such as preliminaries, civil works, and structural steel works.

Contract is a priced contract with an activity schedule (NEC3 ECC3 Option A). Payment terms: Assessment interval is by the 25th of each successive month. Currency is South African Rand. Payment is made within 30 days from the date of submission of the invoice. Interest rate is the publicly quoted prime rate of interest (calculated on a 365-day year) charged by Standard Bank of South Africa. For foreign currency, the LIBOR rate applies. The Contractor must provide a tax invoice within one week of receiving a payment certificate from the Project Manager. The Employer’s VAT number (4740101508) must be included on each invoice. Retention is 5% of every payment made; 50% is paid after project completion, and the remaining 50% after 52 weeks. Performance bond amount to be advised at tender award stage. Delay damages for late completion are 1% of the total order value per week, up to a maximum of 2.5% of the order value.

Contractor must be a legally registered entity in South Africa. CIDB registration is required if applicable. Contractor must comply with all South African laws and regulations. B-BBEE compliance: Contractor must notify the Employer within 7 days of any change in B-BBEE status. An updated verification certificate and supporting documentation must be submitted to the Project Manager within 30 days of notification. Failure to notify may result in termination. If B-BBEE status decreases, the Employer may renegotiate or terminate the contract. Contractor must not cede, delegate, or assign rights without written consent from the Employer. Joint ventures are permitted but require joint and several liability. Contractor must provide proof of insurance as per the Insurance Table A and B. Contractor must comply with Construction Regulations 2014 and all applicable health, safety, and environmental laws. Asbestos handling must comply with Eskom’s Asbestos Standard 32-303 and South African regulations.

Contractor must spend 2% of the contract value on Corporate Social Investment (CSI) projects, as specified by Matla Power Station. Contractor must develop local skilled labour at Kriel and hire non-skilled employees from the Kriel community. The list of CSI projects and potential employees will be provided by Matla Power Station. Contractor must notify the Employer within 7 days of any change in B-BBEE status and submit an updated verification certificate within 30 days. Failure to notify may result in termination. If B-BBEE status decreases, the Employer may renegotiate or terminate the contract.

Contractor must take all reasonable precautions to maintain health and safety, including compliance with Construction Regulations 2014 and all applicable health and safety laws. Contractor may be appointed as the Principal Contractor for the site. Prices must include sufficient amounts for compliance with health and safety requirements. Contractor must ensure subcontractors, employees, and others under their control comply with health and safety regulations. Non-compliance with statutory SHE and legal requirements is included in the Risk Register. Covid-19 is also considered a risk. Asbestos handling must comply with Eskom’s Asbestos Standard 32-303. The OEL for asbestos is 0.2 fibres/ml (4-hour TWA) and 0.6 fibres/ml (10-minute TWA). Contractor’s personnel may stop work and leave contaminated areas until declared safe. Removal and disposal of asbestos must be done by a registered asbestos contractor at the Employer’s expense.

Contractor must comply with all applicable environmental laws, regulations, and procedures specified in the contract. Environmental risks include Matla Power Station stack emissions, dry dust (fly ash) handling, dust from coal stock yards, roads, and seasonal activities. Contractor must ensure subcontractors and employees comply with environmental requirements. Weather data for compensation events is recorded at Matla Power Station and available from the South African Weather Bureau. Adverse weather conditions beyond assumed 1-in-10-year return figures may qualify as compensation events. The site is in a summer rainfall area with specific climatic conditions, including high hail frequency and variable temperatures.

Contract is governed by NEC3 Engineering and Construction Contract (ECC3), April 2013. Main Option A: Priced contract with activity schedule. Secondary Options include X2 (Changes in the Law), X5 (Sectional Completion), X7 (Delay Damages), X13 (Performance Bond), X16 (Retention), X17 (Low Performance Damages), and X18 (Limitation of Liability). Dispute resolution follows Option W1 with adjudication by ICE-SA or AFSA. Arbitration is conducted in Johannesburg under the Association of Arbitrators (Southern Africa) rules. Contractor’s liability for indirect or consequential loss is limited to R0.00. The end of liability date is one year after the defects date for latent defects. Tenderer’s covering letter must not be included in the final contract document. Any deviations from tender documents must be limited to those permitted in the Conditions of Tender. The Schedule of Deviations must record all agreed deviations and amendments. No other matters, whether written, oral, or implied, have any effect in the contract unless contained in the Schedule of Deviations.

Evaluation includes compliance with CSI and local labour development requirements. Contractor must spend 2% of the contract value on CSI projects provided by Matla Power Station. Contractor must develop local skilled labour at Kriel and hire non-skilled employees from the Kriel community. The list of potential employees will be provided by Matla Power Station. Any deviations from tender documents must be limited to those permitted in the Conditions of Tender and recorded in the Schedule of Deviations.
