Conditional discounts (e.g., for early payment) are calculated from the date Transnet receives the correct month-end statement and tax invoice. Advance payments may require a guarantee. Foreign currency payments require SARB approval; Transnet prefers Rand-based agreements. Respondents may need to obtain forward exchange cover for foreign currency portions. Pro-forma/tax invoices may be requested for VAT compliance.

Must not appear on National Treasury’s Register of Tender Defaulters or List of Restricted Suppliers. If a company: list full names of all directors in the bid. If a close corporation: list full names of all members. If a partnership or individual: list full names of partners or the individual. Foreign respondents: bids may be submitted directly or via a South African representative/agent. Representatives/agents must provide written proof of authorisation to act on behalf of the principal; failure to do so disqualifies the bid. Successful foreign respondents must provide a legal Power of Attorney from their principal, complying with Rule 63 of the Uniform Rules of Court, signed under the same title as in the bid documents. The Power of Attorney must authorise the representative to enter into/sign contracts and choose domicilium citandi et executandi. If payment is in South Africa, specify whether funds should be transferred to the foreign supplier’s SA bank account or the SA agent’s account (include bank name and branch). Deed of Suretyship (from an approved SA bank/building society/insurance/guarantee corporation) may be required within 30 calendar days of acceptance; failure to provide it may result in contract cancellation. All returnable documents listed in the RFX must be submitted; failure to submit mandatory documents will result in disqualification.
