Submit one original tender offer in a single sealed envelope. Clearly mark the envelope with: "CONSTRUCTION OF INTERNAL ROADS AND STORMWATER MANAGEMENT - BID NUMBER: MLM/W5/R-SP/P1/26-27 IN WARD 5 – SUTELONG PH 1". Include the Employer’s address: Moretele Local Municipality, 4065 B, Mathibestad, Makapanstad 0404.

• Submit all returnable documents (T2.1 and T2.2) fully completed, signed, and in their original format. This includes pricing schedules (bill of quantities).
• No late submissions, facsimile, or email submissions will be accepted.
• Only one offer per bidder is allowed. Alternative tender offers will not be considered.
• Photocopies of original tender documents may be used, but original signatures must appear on them. Do not retype or redraft tender forms.
• Ensure all copies are clear and certified where required.
• Tender validity period: 90 days from the closing date.
• Disqualification risks: Late, incomplete, unsigned submissions, or submissions not meeting mandatory requirements.

Evaluation occurs in four phases:

Phase 1: Responsiveness

• Mandatory requirements: CIDB registration (5CE or higher for roads/stormwater), legal entity status, no tender defaulters/fraud/corruption, tax compliance (verified via CSD), municipal rates not in arrears >90 days, and submission of all mandatory documents (e.g., MBD 4, MBD 5, MBD 8, MBD 9, CSD report, CIDB certificate). Failure to comply results in automatic disqualification.

Phase 2: Functionality (Minimum 70/100 points required)

• Similar projects experience (roads/stormwater): >5 projects (30 pts), 3–5 (20 pts), 1–2 (10 pts), none (0 pts).
• Financial capacity: Bank rating (A&B = 5 pts, C = 3 pts, D = 2 pts, E = 1 pt, none = 0 pts) and audited financial statements.
• Key personnel: Contract Manager (BScEng/BTechEng + 5–10 years = 15 pts; NDipEng + 5–10 years = 10 pts; Certificate + 5–10 years = 5 pts), Site Agent (NQF 5 + 5 years = 10 pts; NQF 5 + 3 years = 5 pts), Site Foreman (NQF 5 + 5 years = 5 pts; NQF 3 + 3 years = 3 pts).
• Plant/equipment: Ownership (10 pts), lease agreement (5 pts), intent to hire (0 pts) for Grader, TLB, Water Tanker, Tipper Trucks, Roller.

Phase 3: Price and Preference (80/20 PPPFA system)

• Price: 80 points (formula: A = (1 - (P - Pm)/Pm)

• W1, where W1 = 80 for tenders ≤ R50M).

• Specified goals: 20 points (HDI ownership = 5, 51% Women’s Equity = 5, Black Disability = 2.5, 51% Youth-owned = 5, Locality in North West Province = 2.5).

Phase 4: Objective Criteria and Risk Analysis

• Tenders may be disqualified for: past contract failures, penalties, health/safety non-compliance, litigation with the Employer, poor financial health, unduly high/low rates, or incomplete pricing.
• Financial risk analysis compares bid prices to market averages and municipality estimates.

• Scope: Construction of internal roads and stormwater management in Ward 5, Sutelong Phase 1.
• Deliverables: Full compliance with CIDB Standard for Uniformity in Construction Procurement (August 2019), General Conditions of Contract for Construction Works (GCC 2015), Occupational Health and Safety Act No. 85, and Construction Regulations 2014.
• Standards: Standard Specifications (C3.1), Project Specifications (C3.2), Particular Specifications (C3.3), Drawings (Part C5), and Site Information (Part C4).
• Capacity: CIDB registration (5CE or higher). Joint ventures must have each member CIDB-registered, with the lead partner’s grading not lower than one level below 5CE. Combined grading must meet or exceed 5CE.

• Pricing: Fixed, final, and binding rates for the full contract duration. No adjustments for inflation or foreign fluctuations. Submit pricing per C2.1 (Pricing Instructions) and C2.2 (Schedule of Quantities). All trades in Bills of Quantities must be priced (except provisional sums/allowances).
• Bonds/Guarantees: Form of Guarantee (C1.3), Retention Money Guarantee (C1.5), OHSA Section 37(2) Agreement (C1.4), Transfer of Rights (C1.6). Submit all required securities, bonds, guarantees, policies, and insurance certificates before contract formation.
• Payment Terms: Tender validity period is 90 days from closing date. Financial risk analysis will be conducted; unduly high/low rates may lead to disqualification.
• Cost of Tender Documents: Limited to actual printing costs incurred by the Employer.

• CIDB Registration: Must be registered at close of tender in 5CE or higher for roads/stormwater. Registration must remain active from advert to award stage.
• CSD Registration: Must be registered on the Central Supplier Database prior to award. Tax compliance verified via CSD.
• B-BBEE: Submit B-BBEE Verification Certificate and complete MBD 6.1 (Preference Points Claim Form). Non-completion of Section 1.3.1.2 forfeits preferential points.
• Tax Compliance: All tax matters must be in order prior to award.
• Municipal Rates: Proof of municipal rates not in arrears >90 days (or equivalent for leased properties).
• Legal Entity: Must be a legal entity, partnership, joint venture, or consortium. Joint ventures require a Certificate of Authority and signed JV agreement.
• Health and Safety: Submit Contractor’s Health and Safety Declaration (T37) and comply with OHSA and Construction Regulations 2014.
• COID: Letter of Good Standing with the Compensation for Occupational Injuries and Diseases (T47).
• Past SCM Practices: Complete MBD 8 (Declaration of Bidder’s Past SCM Practices) and MBD 9 (Certificate of Independent Bid Determination).
• Tender Defaulters: Must not be listed on the Tender Defaulters Register.
• Fraud/Corruption: Declare no involvement in corrupt/fraudulent practices (MBD 4).
• State Employees: Declare if any principals are in the service of the state (MBD 4).
• Non-Elimination: MBD 1 form and audited financial statements for the past 3 years (or since establishment).
