Submit the completed Sworn Affidavit form for EME or QSE status with the RFP. Evaluation includes: (1) Enterprise type must be EME (annual revenue ≤ R10M) or QSE (annual revenue R10M–R50M). (2) B-BBEE compliance: declared ownership percentages for Black, Black Woman, and Black Designated Group beneficiaries per Amended Code Series 100. (3) Legal registration status (e.g., NPO, PBO). (4) Citizenship of Black beneficiaries must align with B-BBEE Act definitions (Africans, Coloureds, Indians who are SA citizens by birth, descent, or naturalization before/after 27 April 1994).

B-BBEE Compliance: Submit a Sworn Affidavit (valid for 12 months from Commissioner of Oaths' signature) declaring: (1) Black Beneficiaries percentage, (2) Black Woman Beneficiaries percentage, (3) Black Designated Group Beneficiaries percentage, all per Amended Code Series 100 of the B-BBEE Act. EMEs: Annual total revenue ≤ R10,000,000.00. QSEs: Annual total revenue between R10,000,000.00 and R50,000,000.00. Enterprise must be legally registered (e.g., NPO, PBO).

This tender is open to any natural or juristic person. Bidders must adhere to principles of transparency, accountability, impartiality, and ethics as per the South African Constitution and relevant legislation. A signed SBD 4 (Bidder’s Disclosure) form is required to confirm compliance with these principles.

Submit the SBD 4 form (Bidder’s Disclosure) as part of your bid. Disqualification risks: Bidders listed in the Register for Tender Defaulters or the List of Restricted Suppliers will be automatically disqualified. Ensure all declarations in the SBD 4 form are true and complete; false or incomplete disclosures will result in bid disqualification.

Exclusions: Bidders listed in the Register for Tender Defaulters or the List of Restricted Suppliers are automatically disqualified. State affiliation: Bidders or their directors/trustees/shareholders must not be employed by the state unless fully disclosed. Relationships: Any personal or professional relationships with employees of the procuring institution must be declared. Collusion: Bidders involved in collusive practices (e.g., price-fixing, bid-rigging) are ineligible and may face legal consequences.

Bidders must declare: Any employment by the state (for the bidder or directors/trustees/shareholders/members/partners or controlling persons). Any relationship with employees of the procuring institution. Any interest in related enterprises bidding for this contract. Bids must be independent, without collusion with competitors. No disclosure of bid terms to competitors before official opening. No prior consultation with procuring institution officials except for clarification. Non-compliance may lead to rejection, reporting to the Competition Commission, or restrictions from public sector business for up to 10 years under the Prevention and Combating of Corrupt Activities Act.
