Submit one (1) original bid document plus one (1) memory stick (USB) containing a duplicate of the original. Deliver to: The Procurement Manager, NERSA, Kulawula House, 526 Madiba Street, Arcadia, Pretoria. Closing date and time: 15 June 2026 at 11:00. Late bids will not be considered. The original must be fully completed and signed in ink; do not retype or convert to Word format. The envelope must be sealed and endorsed with: bid number, closing date/time, and bidder’s name and address. Bidders must sign a tender register at reception upon delivery. Failure to submit the memory stick or submitting a blank USB will result in disqualification. Required returnables: completed SCM forms, CSD registration proof, SARS Tax Compliance Status, B-BBEE certificate/sworn affidavit, Bidder’s Disclosure, Preference Points Claim Form, Invitation to Bid, Special Conditions acceptance, proof of experience, CVs of team members, and reference letters.

Evaluation is conducted in four stages: (1) Administrative compliance (mandatory: CSD registration, SARS tax compliance, B-BBEE certificate, completed forms, no fraud/corruption history). (2) Selection criteria (100 points total, minimum 60 points to proceed): 60 points for online legal publication titles covered (0-60 based on Table 1), 30 points for track record of similar projects (0-30 based on references), 10 points for Account Manager experience (0-10 based on years). (3) Presentation (100 points, minimum 60 points to proceed): 10 points for tool/system demonstration, 15 points for Search/Print/Navigation/Annotation functionality, 15 points for download/print options, 60 points for titles presented. (4) 80/20 Preference Point System: 80 points for price (lowest acceptable bid scores 80), 20 points for Specific Goals (10 for Black Owned, 10 for Black Woman Owned). Bids failing to meet minimum thresholds at any stage are disqualified. Final award is to the highest-scoring bidder, though a lower-scoring bid may be selected on justifiable grounds.

Scope: Provide online legal publications to NERSA for five years. Minimum requirements: access to 29 online legal publication titles (Table 1), including law reports, journals, statutes, and digital textbooks. Tool/system must: allow simultaneous access for 10 user departments/units (one shared licence per department), support training for Librarian, Knowledge Manager, and 28 users annually, assign an Account Manager with ≥3 years of accounts management experience (CV and completed Table 2 required), and demonstrate ≥3 years of experience in similar services with contactable references (completed Table 3 required). System functionality: categorise publications by subject, enable effective search/print/navigation, provide quick access to information, support downloads in Word/PDF/RTF, and allow 10 concurrent users.

Financial proposal must be submitted separately in a sealed envelope. All amounts in ZAR, inclusive of VAT. Price increases/adjustments for years 2–5 must be discounted. Ceiling price for the five-year contract must be indicated. Payment terms: NERSA pays within 30 days after receipt of a valid tax invoice. Invoices must be detailed and emailed to [email protected]. Payment via bank transfer to a South African bank account only.

Mandatory: CSD registration (submit summary report or MA number on Invitation to Bid), SARS Tax Compliance Status (PIN letter or printed TCS), valid B-BBEE certificate or sworn affidavit (SANAS-accredited), completed and signed SCM forms (Bidder’s Disclosure, Preference Points Claim Form, Invitation to Bid, Special Conditions acceptance), proof of ≥3 years’ experience in similar services, CVs of proposed team (including Account Manager), reference letters for listed projects (submit by closing date or 22 June 2026 at 16:00). Compliance with General Conditions of Contract (GCC) required. No history of fraud, corruption, or SCM system abuse.
