Evaluation uses the 80/20 Preferential Procurement Regulations 2022 system:

• Mandatory Compliance: Non-submission of required documents (e.g., SBD 1, CSD report, Tax PIN, B-BBEE certificate, SBD 4, SBD 6.1) results in immediate disqualification. Bidders must comply with the specification/terms of reference and submit full pricing details.
• Price (80 points): Formula: Ps = 80(1 - (Pt - Pmin)/Pmin), where Ps = points scored, Pt = bid price, Pmin = lowest acceptable bid price.
• Specific Goals (20 points):
• B-BBEE Level 1–4: 10 points (submit certificate or sworn affidavit).
• Women-owned enterprises: 5 points (verified via CSD).
• Enterprises owned by disabled people: 5 points (medical report required).
• Administrative Compliance: All forms must be completed and signed. Non-submission of SBD 6.1 leads to zero points for Specific Goals.

Mandatory compliance requirements:

• Central Supplier Database (CSD): Must be registered on CSD to conduct business with C-BRTA. Submit CSD Registration Report (Schedule 2).
• Tax Compliance:
• Submit Tax Compliance Status (TCS) PIN issued by SARS (Schedule 3). Apply via e-Filing at www.sars.gov.za.
• Alternatively, submit a printed TCS certificate with the bid.
• If no TCS PIN is available but registered on CSD, provide CSD number.
• For consortia/joint ventures, each party must submit separate TCS certificate/PIN/CSD number.
• B-BBEE: Submit sworn affidavit or valid B-BBEE certificate (Schedule 4). Points allocated for B-BBEE Level 1–4 (10 points), women-owned enterprises (5 points), and enterprises owned by disabled people (5 points).
• Disclosure: Complete and sign SBD 4 (Bidder’s Disclosure) and Annexure A (Schedule 5 and 6).
• Preference Points Claim: Complete and sign SBD 6.1 (Schedule 7).
• Exclusions: No bids accepted from persons in the service of the state, or companies/close corporations with directors/members in the service of the state.
• Foreign Suppliers: If not a resident of RSA and has no branch/permanent establishment/source of income/tax liability in RSA, no requirement to register for TCS PIN. Otherwise, comply with tax requirements.
• Additional: Bidders must declare any relationship with state employees or interest in other bidding enterprises. Independent bidding without collusion is required.

B-BBEE requirements for preference points:

• B-BBEE Level 1–4: 10 points (submit certificate or sworn affidavit with the bid).
• Women-owned enterprises: 5 points (verified via CSD).
• Enterprises owned by disabled people: 5 points (medical report required).
• Total points claimed: D = A + B + C (where A, B, C are points for each category).
• For consortia/joint ventures, points claimed for ownership must be detailed separately, including:
• Percentage of contract allocated to each member.
• Percentage ownership by race category for each member.
• Total points claimed calculation: sum of (percentage contract allocation × percentage weighting for race category × percentage ownership in the relevant specific goal).
• Failure to submit proof or documentation for specific goals will result in zero points for those goals.

Contractual terms include:

• Successful bidder must fill in and sign a written contract form (SBD7).
• Contract is subject to the Preferential Procurement Policy Framework Act, 2000, and Preferential Procurement Regulations, General Conditions of Contract (GCC), and any special conditions.
• Fraudulent claims or non-fulfillment of contract conditions may result in:
• Disqualification from the tendering process.
• Recovery of costs, losses, or damages incurred by the organ of state.
• Contract cancellation and damages claimed.
• Restriction from obtaining business from any organ of state for up to 10 years.
• Criminal prosecution.
• Contractor may be required to furnish documentary proof to substantiate claims.
• Bidders or their agents may not make news releases about the RFQ or its award without C-BRTA’s consent.
• This RFQ is subject to Government Procurement: General Contract Conditions – July 2011, Special Contract Conditions, and any other contract conditions finalised during contracting.

General requirements:

• Bidders must be registered on the Central Supplier Database (CSD) to conduct business with C-BRTA.
• Bidders must ensure compliance with their tax obligations.
• Submit Tax Compliance Status (TCS) PIN issued by SARS or CSD number if no TCS PIN is available.
• For consortia/joint ventures, each party must submit a separate TCS certificate/PIN/CSD number.
• No bids will be considered from persons in the service of the state, or companies/close corporations with directors/members in the service of the state.
• Bidders must declare any relationship with state employees or interest in other bidding enterprises.
• Bidders must submit bids independently without collusion.
• Bidders listed in the Register for Tender Defaulters or List of Restricted Suppliers will be disqualified.
• Bidders must inform C-BRTA within three (3) days if they believe the RFQ specification is based on a specific brand.
• Bidders will be given seven (7) days to correct non-tax compliance and three (3) days to fully disclose any information on Standard Bidding Documents; failure may result in disqualification.
